How to Raise a Concern About Construction on Railway Land (UK Guide)

Use the route that matches both the danger and the organisation responsible. Call Network Rail’s 24-hour emergency helpline on 03457 11 41 41 for an immediate threat near the operational railway. For non-urgent work affecting you, use the responsible railway or project body’s complaint process. Send public railway health-and-safety concerns to the Office of Rail and Road (ORR) at [email protected]. Planning objections belong with the local planning authority, while HS2 and Transport and Works Act projects have their own procedures.

This is UK-oriented guidance. No single complaint system covers every railway, operator, landowner, devolved railway body or construction project, so identify the site and project before choosing a channel.

Choose the right route before you report

“Railway land” can mean an operational railway, a station estate, a maintenance compound, land owned by an infrastructure manager, or a project site beside the railway. The correct contact depends on four questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • How urgent is it? Is someone at immediate risk, or is this an ongoing nuisance, damage or planning issue?
  • Who is responsible? Is the work being carried out by Network Rail, a named project promoter, a train operator, a contractor or another infrastructure manager?
  • What kind of concern is it? Safety, noise, access, property impact, environmental damage, planning or a question about an application procedure?
  • What action do you need? Immediate intervention, an investigation, mitigation, information or a review of a decision?
Situation First contact What to ask for
People or objects on or near the track, a damaged crossing, a vehicle strike, or a broken fence or open gate allowing access Network Rail emergency helpline: 03457 11 41 41 Immediate safety response
Network Rail work, vegetation, graffiti, level-crossing issue or railway-work noise that is not an immediate emergency Network Rail’s complaint route Investigation and practical mitigation
Public concern about railway health and safety where the responsible body is unclear or the matter requires regulatory attention ORR: [email protected] Referral to the relevant railway safety team
Concern about the transport effects of a planning application The local planning authority’s consultation process A planning decision that addresses the specific railway-related effect
Construction complaint on HS2 HS2’s complaint process, then the Residents’ and Construction Commissioner if unresolved Project review and, where appropriate, independent complaint review
Procedure or decision question about a Transport and Works Act application The application’s named case officer A procedural explanation or correction

Do not enter railway land, approach workers on the track or cross a barrier to gather evidence. A good report can be made from a public road, footway, property boundary or other safe, lawful position.

Report an immediate danger to the railway

Use the emergency route when delay could expose people to harm or disrupt the operational railway. Network Rail publishes 03457 11 41 41 as its 24-hour emergency helpline. Examples include:

  • A person, animal, vehicle or object on or close to the track.
  • Damage at a level crossing that could make the crossing unsafe.
  • A vehicle striking a railway bridge.
  • A broken fence or open gate that gives the public access to the track.
  • Construction activity that has created an immediate hazard to trains, passengers, workers or nearby members of the public.

Give the operator the precise location first: a station, crossing or bridge name, address, line or route if known, and a visible landmark. Describe what is happening now, whether anyone is in danger, and whether trains, road traffic or pedestrians are affected. Stay in a safe place while calling and follow the operator’s instructions. Do not try to resolve the hazard yourself.

Network Rail states: “If you report a safety threat to you or others, we will prioritise this and respond as quickly as possible.” That priority applies to a reported safety threat; it is not a promise of a universal response time for every type of complaint.

Make a routine complaint about Network Rail work

For a non-urgent concern involving Network Rail land or activity, use Network Rail’s complaint route rather than the emergency line. Suitable examples include persistent construction noise, disruption, vegetation work, graffiti, a level-crossing problem, or another impact from railway works.

Information to provide

  1. Identify the place. Give the full address if available, or the nearest station, crossing, bridge, road, postcode, field entrance or other fixed landmark.
  2. Set out the chronology. State when the work started, the dates and times of incidents, how often the impact occurs and whether it is continuing.
  3. Describe the activity. Explain what you can lawfully observe: machinery, deliveries, lighting, dust, vegetation clearance, blocked access, vibration, noise or changes to fencing.
  4. Explain the personal effect. Say how the work affects your home, business, access, sleep, safety, property or ability to use a public route. Network Rail asks complainants to explain what happened, where and when, and how it affected them.
  5. Request a specific outcome. For example, ask for an investigation, a named contact, revised working hours, dust or noise controls, repairs, reinstatement or an explanation of the planned duration.
  6. Attach safe evidence. Network Rail says photographs can help with some issues on its land. Take them only from a safe, lawful position; never step onto railway property, a worksite or the track.

Keep the complaint factual. Separate what you directly saw or heard from assumptions about permissions, contractors or breaches. If you have already reported the issue, include the reference number and the response received.

Contact the Office of Rail and Road about railway safety

The Office of Rail and Road (ORR) is the railway regulator, not a general customer-service desk for every construction complaint. It accepts public health-and-safety enquiries at [email protected] and forwards them to the relevant railway safety team.

Use this channel when the concern is genuinely about railway health and safety and you need regulatory attention, particularly if you cannot identify the responsible railway body. For a routine service, noise, access or land-management complaint, contact the operator, infrastructure manager or project promoter first so that it has an opportunity to investigate.

What ORR can and cannot decide

ORR’s remit covers risks that exclusively or primarily concern railway construction or operation. Railway safety enforcement is shared within a statutory framework: the allocation between ORR and the Health and Safety Executive (HSE) depends on the facts and work context under the enforcement-authority regulations. It is therefore inaccurate to assume that every construction-site or workplace issue belongs exclusively to ORR.

In an email, explain why the risk is railway-related, identify the site and activity, state whether anyone is currently exposed, and list any report already made to the operator or project. Attach only information obtained safely and lawfully.

Raise a planning concern about railway construction

A planning objection is different from a complaint about how an approved project is being built. If a planning application is open for consultation, submit your representation through the local planning authority handling that application. Find the application reference and follow the authority’s stated online, email or postal process.

Make the representation specific

Explain the transport effect that concerns you rather than making a general objection to the railway. Relevant points may include construction traffic at a junction, pedestrian or highway safety, access to a crossing, noise and vibration, impacts on a road used by emergency services, or how the proposal interacts with railway operations. Include the application number, site address, the part of the proposal you are addressing and the change you want the authority to require.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

ORR is a statutory consultee for planning applications likely to affect the rail transport industry. Its role is to consider transport matters; it does not replace the local planning authority or determine the application for you. Send your formal representation to the planning authority by its deadline, even if you also alert ORR to a railway-safety issue.

If construction has already begun under an approval, a planning representation may no longer be the right remedy. Check the permission, construction-management requirements and the project’s complaint route, then report a suspected breach to the local planning authority if appropriate.

Use the HS2 construction complaint route where it applies

HS2 has a project-specific process for construction complaints. Start with HS2’s published complaint process and give the site location, date, description of the impact, previous reference numbers and the outcome you seek.

If HS2 does not resolve the matter, its published route allows referral to the independent Residents’ and Construction Commissioner. If you remain dissatisfied after that review, the guidance says an MP may be asked to refer the complaint to the Public Service Ombudsman. This escalation route is specific to HS2; do not assume that it applies to other rail projects.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the emergency railway channel instead if the HS2 activity has created an immediate danger to the operational railway. A complaint about noise, dust, deliveries or working hours should normally follow the project complaint process first.

Ask about a Transport and Works Act application

Transport and Works Act applications can grant powers to construct and operate railways and associated infrastructure. A procedural question about a particular application should go first to the named case officer listed for that application. The case officer can explain the status of the application, consultation arrangements, documents and deadlines.

For general questions about the application process and decisions on applications for powers to construct and operate railways, the Department for Transport’s Transport Infrastructure Planning Unit handles enquiries. Give the application title or reference, the project location and the precise procedural point you need clarified.

This route is for the application process. It does not replace an emergency report, a construction complaint to the project promoter or a planning representation where a separate planning consultation is running.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the railway is not Network Rail or HS2

Other infrastructure managers, train companies, devolved railway bodies, local authorities and private project promoters may use different contact details and escalation stages. Before sending a complaint, look for the organisation named on:

  • Site hoardings, public notices and construction newsletters.
  • Planning documents and the decision notice.
  • Environmental statements, transport assessments or consultation material.
  • Station, crossing or project websites and displayed emergency information.
  • Landowner, lease or access information available from the local authority.

Confirm that the contact is current and that it accepts the type of issue you are reporting. If the sign identifies a contractor but not the infrastructure manager, report the concern to the contractor’s published community or site contact and copy the project owner where possible. For an immediate railway danger, do not delay while trying to identify the contractor: use the published emergency channel.

Prepare a report that can be acted on

Use a precise location

“Near the railway” is rarely enough. Provide an address, postcode, nearest station, crossing or bridge, road name, direction of travel and a landmark visible from your safe position. If the work extends along a route, identify the start and end points or the nearest two fixed landmarks.

Keep a dated incident log

Record the date, start and finish time, type of work, sound or vibration, blocked route, vehicle movement, lighting or other impact. Note weather or unusual conditions only when they help explain what happened. A short chronology is more useful than a long undated narrative.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Describe impact and risk separately

State the observable fact first, then the consequence. For example: “Reversing alarms operated from 23:40 to 01:10 on three nights this week; bedroom windows face the compound and sleep was disrupted.” If you believe there is a safety risk, explain who could be exposed and why, without claiming a legal breach you cannot establish.

Request a proportionate remedy

Ask for the outcome that would resolve the concern: confirmation of the work schedule, a site inspection, repaired fencing, a safer pedestrian route, noise controls, dust suppression, a named liaison officer or an explanation of why work cannot be changed. A clear request helps the recipient decide what action is possible.

Preserve your records

Keep copies of emails, web forms, photographs, videos, reference numbers, call dates and responses. Store original files with their timestamps. Do not publish images that reveal personal information, children, security arrangements or workers’ identities when that is unnecessary.

What to do after submitting the concern

  1. Check the acknowledgement. Confirm that the organisation has your location, contact details and the correct issue category.
  2. Answer reasonable requests for clarification. Provide missing dates or landmarks, but do not put yourself in danger to obtain additional evidence.
  3. Follow the stated complaint stages. If the response is incomplete, use the organisation’s published review or escalation step and quote the original reference.
  4. Escalate to the appropriate body. A railway safety concern may be sent to ORR; a planning representation belongs to the local planning authority; HS2 complaints can use the project-specific commissioner route; a Transport and Works Act procedural issue should go to its case officer.
  5. Use emergency services where appropriate. If there is an immediate threat to life or a serious incident in progress, call the emergency services as well as reporting the railway hazard through the published railway channel.

There is no universal response deadline or nationwide escalation ladder for all railway construction complaints. The timeframe and review route depend on the organisation, project and issue, so ask for the next step if the acknowledgement does not explain it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What not to do

  • Do not enter railway land, construction compounds, embankments, tunnels or track areas to inspect the work.
  • Do not approach workers on the track or obstruct plant, vehicles or trains.
  • Do not rely on protective clothing or equipment as permission to enter a restricted site.
  • Do not use the emergency number for a routine noise complaint unless there is an immediate safety threat.
  • Do not send a general planning objection to ORR instead of the local planning authority’s consultation process.
  • Do not assume that an ORR referral, HS2 escalation or Transport and Works Act procedure applies to a different railway project.
  • Do not allege criminality, trespass or a planning breach as fact unless an authorised body has established it.
