How to Qualify Subcontractors for a Nuclear Construction Project

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Qualify a nuclear-construction subcontractor against the exact work package, safety function, governing jurisdiction, approved quality-assurance (QA) program, and procurement documents—not against a certificate or a generic vendor questionnaire. For U.S. commercial nuclear work covered by NRC requirements, the purchaser must flow down applicable regulatory and design requirements, evaluate the supplier’s ability to meet them, obtain objective evidence, and use audits, source inspections, testing, or receipt examinations in proportion to the work’s importance, complexity, and quantity.

This is a project-specific procurement decision. The information below describes a defensible U.S. framework; it cannot determine whether any particular firm qualifies without the project scope, licensee or contracting entity, safety classification, procurement specification, and approved QA commitments. DOE nuclear work follows a different route in some cases.

As an Amazon Associate I earn from qualifying purchases.

Start with the work package, not the company name

A subcontractor is qualified only for a defined scope under defined controls. Begin by writing a package description that another reviewer could use to determine exactly what the supplier will do and what evidence must be produced.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Define the technical scope

  • Describe the activity, deliverables, locations, interfaces, installation boundaries, and acceptance points.
  • Identify whether the supplier is designing, fabricating, inspecting, testing, installing, repairing, supplying replacement parts, or providing engineering or consulting services.
  • List the drawings, specifications, calculations, procedures, codes, standards, and design-basis or functional-design-criteria documents that control the work.
  • State the records that must be delivered, their format, retention period, traceability requirements, and approval points.

Identify the governing regime

For a U.S. commercial nuclear project, determine which NRC requirements and licensee commitments apply. Appendix B to 10 CFR Part 50 is central for covered safety-related procurements. It requires applicable regulatory requirements, design bases or functional design criteria, and other quality requirements to be included or referenced in procurement documents, including purchases made through contractors and subcontractors.

  • Stronger Solid Lead: This work pencil is matched with a 2.8 mm thick lead , which is much thicker and stronger during the drawing process of construction work, it will not break or damage easily
  • Marks on Various Surfaces: 3 colors solid construction pencil can marks on various surfaces, such as metal, plastic, wood, paper etc. Ideals for woodworkers, contractors, craftsmen, builders, merchants and masons

Do not automatically apply the NRC licensee framework to a Department of Energy project. DOE states that QA requirements for nuclear facilities and activities are found in 10 CFR 830 Subpart A; DOE Order 414.1D governs other DOE QA applications. The contract and facility-specific procurement process must determine the required flowdown.

Classify the safety and quality significance

The project owner, licensee, engineering organization, or approved QA program establishes the applicable quality classification or safety function. The sources do not establish one universal classification scheme for every project. Record the classification used by the project, the basis for it, and the controls it triggers before asking suppliers for bids.

Flow requirements into the procurement documents

Procurement documents are the control point between the project’s obligations and the subcontractor’s work. A purchase order that says only “perform to industry standards” is not a reliable nuclear-quality flowdown.

Include or reference the requirements that apply

For the package, state or reference the applicable:

  • Regulatory requirements and licensee commitments.
  • Design-basis, functional-performance, and technical requirements.
  • QA-program provisions and implementing procedures.
  • Inspection and test plans, hold points, witness points, and acceptance criteria.
  • Material identification, traceability, preservation, handling, storage, and environmental controls.
  • Calibration, test-equipment, software, qualification, and personnel-competence requirements.
  • Nonconformance, corrective-action, change-control, records, and records-retention requirements.
  • Notification and escalation duties, including any applicable 10 CFR Part 21 responsibilities.
  • Requirements that must flow to the subcontractor’s lower-tier suppliers.

Appendix B requires procurement documents to include or reference the requirements needed to assure quality and, where necessary, to require contractors or subcontractors to provide a QA program consistent with relevant Appendix B provisions. The package should identify which provisions apply rather than demanding an undefined “full compliance” claim.

Make acceptance enforceable

State what constitutes an acceptable deliverable, who may approve deviations, which records must accompany delivery, and whether the buyer may inspect at the supplier’s facility. Include rights to audit, witness tests, review records, stop work for quality concerns, and reject nonconforming material or services. These clauses turn a quality expectation into a controllable purchasing requirement.

A defensible subcontractor-qualification workflow

Use the following sequence for each package. The depth of review should match the product or service rather than the supplier’s marketing claims.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

1. Define the package and acceptance boundary

Create a scope sheet showing work activities, safety or quality classification, interfaces, deliverables, acceptance points, and required records. Identify whether the subcontractor’s output can affect a basic component, safety function, design basis, or credited analysis. Resolve ambiguous boundaries with the licensee, owner, engineering authority, or DOE contracting organization before supplier selection.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

2. Screen for capability and conflicts

Confirm that the firm has the personnel, equipment, facilities, supervision, capacity, and relevant experience to perform the defined work. Check whether it relies on lower-tier suppliers for material, special processes, testing, engineering, or inspection. Record conflicts of interest and any limitations on independence for inspection or verification activities.

3. Review the written QA program and procedures

Map the supplier’s manual and procedures to the requirements in the procurement package. Look for controls covering document approval, design or process changes, purchasing, supplier control, identification and traceability, inspection, testing, calibration, nonconformance, corrective action, records, audits, and training. A manual that lists requirements without showing how work is controlled is not evidence of implementation.

4. Obtain objective implementation evidence

Request records that demonstrate performance on comparable work, such as completed inspection and test records, material certificates and traceability logs, calibration records, personnel qualification records, nonconformance and corrective-action files, audit reports, and delivered quality records packages. Select evidence relevant to the proposed package; do not treat a large document volume as proof of effectiveness.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Select the assessment method proportionately

Appendix B calls for appropriate source evaluation and supplier selection, supplier-furnished objective evidence, source inspection, and delivery examination. Choose one or more methods based on importance, complexity, and quantity:

Assessment method Best use What it can establish
Document review Lower-complexity or well-bounded services, or an initial screen Whether stated procedures and qualifications address the package requirements
Supplier audit Safety-significant, complex, novel, or high-value work Whether personnel, records, equipment, supervision, and procedures operate as written
Source inspection Fabrication, special processes, or manufacturing where defects may be difficult to detect after shipment Conformity at defined hold or witness points before release
Witnessed testing Performance characteristics that must be demonstrated Results against specified acceptance criteria under controlled conditions
Receipt examination Delivered material, equipment, records, or services Identity, condition, completeness, documentation, and conformity before installation or use

One certificate, one audit, or one previous project does not create a universal regulatory pass. The buyer must decide what evidence is sufficient for this package.

6. Document findings and disposition

Write each finding against a specific procurement or QA requirement. Assign an owner, corrective action, due date, and objective acceptance criterion. Decide whether a gap blocks award, limits the subcontractor to a narrower scope, requires additional source inspection, or can be accepted with an approved corrective-action plan. The governing project procedure should define who may make that decision.

7. Approve the supplier for the defined scope

Issue a qualification or approved-supplier decision that names the exact commodity, service, facility, process, quality classification, and restrictions. Record the assessment date, evaluators, evidence reviewed, open conditions, and re-evaluation interval. Avoid an unrestricted “qualified supplier” label when the evidence supports only a particular package.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Control performance through completion

Qualification continues after award. Monitor required inspections, tests, records, changes, nonconforming work, corrective actions, and lower-tier supplier controls. Verify conformity before material or equipment is installed or used. Appendix B requires purchased material, equipment, and services to conform to procurement documents and requires contractor and subcontractor quality-control effectiveness to be assessed at intervals consistent with importance, complexity, and quantity.

Documents to request and verify

The exact submittal list belongs in the procurement specification. The following evidence categories help a buyer test whether the supplier can implement the requirements.

Evidence category Questions for the buyer Typical review point
Organization and responsibility Who controls quality, who performs inspections, and who has authority to stop or reject work? Before award and during audits
QA manual and procedures Do procedures address the package’s regulatory, technical, inspection, testing, records, and nonconformance requirements? Pre-award document review
Personnel competence Are welders, inspectors, engineers, testers, and supervisors qualified for the specified methods and codes? Before work and when personnel change
Equipment and calibration Are measuring and test devices identified, calibrated, protected, and suitable for the required accuracy? At audit, source inspection, and test
Material traceability Can heat, batch, lot, part, or serial information be traced from receipt through installation or testing? Procurement review and receipt
Inspection and test records Do records identify the item, procedure, acceptance criteria, results, inspector, date, and approvals? Source and delivery acceptance
Nonconformance and corrective action Are discrepant conditions controlled, evaluated for impact, corrected, and closed with evidence? Pre-award history and ongoing oversight
Lower-tier procurement Are requirements and records flowed to critical sub-suppliers, with their performance verified? Contract review and audit
Records package Will the final records package be complete, legible, retrievable, and retained for the required period? Progress reviews and final acceptance

These are practical evidence categories, not a regulator-issued universal checklist. The package specification and approved QA program control the final list.

How to audit implementation rather than paperwork

An effective audit follows a requirement through the supplier’s actual work. Select a sample job, material heat, inspection, or test and trace it from purchase through final record. Interview the person performing the task, observe the equipment and conditions, and compare the result with the approved procedure and acceptance criteria.

Test the controls that commonly fail

  • Procedure use: Verify that the current approved revision is available at the work location and that obsolete copies are controlled.
  • Inspection independence: Confirm that required inspections are performed by qualified personnel with the authority and independence specified by the project.
  • Traceability: Follow identification markings through cutting, fabrication, coating, testing, shipment, and installation.
  • Change control: Check that substitutions, deviations, design changes, and process changes receive the required technical and QA review before use.
  • Records integrity: Confirm that entries are attributable, legible, contemporaneous, original or appropriately controlled copies, and protected from unauthorized alteration.
  • Corrective action: Review whether recurring findings receive a cause evaluation and effectiveness check rather than repeated short-term fixes.

Set oversight intervals rationally

Use more frequent surveillance for complex fabrication, first-of-a-kind work, poor prior performance, high defect consequences, or large quantities. Reduce frequency only when objective performance demonstrates stable control and the project procedure permits it. Appendix B ties assessment intervals to importance, complexity, and quantity; it does not prescribe one audit frequency for all suppliers.

What NQA-1 establishes—and what it does not

ASME NQA-1 is a recognized reference for establishing and executing QA programs for nuclear facility applications. NRC’s Regulatory Guide 1.28, Revision 6, identifies NQA-1-2017, NQA-1-2019, and NQA-1-2022 as current implementation guidance for design and construction phase QA programs, subject to NRC exceptions and clarifications. Verify which edition and commitments the project’s approved QA program requires.

NQA-1 does not automatically qualify a subcontractor. Possessing the standard, claiming alignment, holding a certificate, or passing an audit does not prove that the organization can perform every package. The purchaser still has to evaluate the supplier against the work scope, procurement documents, and applicable QA commitments, then verify conformity and maintain oversight.

Use the standard correctly in procurement

  1. Name the NQA-1 edition or project-specific commitment that applies, including any NRC exceptions or clarifications.
  2. Identify the NQA-1 requirements relevant to the subcontracted activity rather than imposing unrelated provisions.
  3. Require the supplier to describe its implementing procedures and records for those provisions.
  4. Verify actual implementation through objective evidence, audits, source inspections, or receipt examination.

A physical reference such as ASME NQA-1, Quality Assurance Requirements for Nuclear Facility Applications can help a QA team work from the applicable standard, but buying the publication does not qualify an organization. The project’s approved QA program and procurement documents govern.

Determine whether 10 CFR Part 21 applies

Part 21 applicability depends on what the subcontractor supplies, not simply on whether it has an Appendix B QA program. NRC guidance states that Part 21 applies to domestic suppliers of basic components, whether or not they maintain an Appendix B QA program.

The basic-component description includes safety-related design, analysis, inspection, testing, fabrication, replacement parts, and associated consulting services. Map the subcontractor’s deliverables and services to that scope with the licensee or responsible engineering and QA organizations.

Put responsibilities into the contract

  • Identify who evaluates deviations, defects, and failures for potential Part 21 significance.
  • Define immediate escalation contacts and time-sensitive notification routes.
  • Require preservation of technical evaluations, supporting records, and affected-item identification.
  • Explain how suspected defects or noncompliance are communicated to the licensee, purchaser, and relevant lower tiers.
  • Ensure the subcontractor’s procedures address Part 21 when its supplied work falls within the applicable scope.

Do not assume that a supplier without an Appendix B program is outside Part 21, or that an Appendix B program alone resolves every Part 21 duty.

Keep commercial-grade dedication separate from supplier qualification

Commercial-grade dedication is an item- or service-specific procurement and acceptance process. NRC Generic Letter 91-05 discusses licensee commercial-grade procurement and dedication programs and characteristics of effective dedication programs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Dedication can provide an acceptance pathway for an appropriate commercial-grade item or service when the project’s current procedures establish the critical characteristics, acceptance methods, and documentation. It does not qualify the supplier’s entire organization for every nuclear scope, and not every commercial item is eligible. Treat the source as historical guidance and execute dedication under current regulations, licensee procedures, and project controls.

Ask two separate questions

  • Supplier qualification: Can this organization control and perform the contracted work under the required QA program?
  • Item dedication: Can this specific commercial-grade item or service be shown, through defined acceptance activities, to be suitable for the safety-related application?

Answering the second question does not answer the first.

Compare subcontractors on evidence, not certificates

Compare bidders only after giving them identical scope, classification, specifications, and acceptance requirements. A practical evaluation can use the following axes; they are procurement decision dimensions, not a regulator-issued numerical rating system.

Comparison axis Evidence to examine Why it matters
Implemented QA controls Observed work, completed records, audit results, corrective-action effectiveness Shows whether the program operates in practice
Comparable experience Relevant projects, processes, materials, codes, classifications, and interfaces Reduces uncertainty from unfamiliar work
Traceability and records Sample material histories, inspection/test records, final records packages, retention controls Supports acceptance and future reconstruction of what was done
Inspection and testing capacity Qualified staff, calibrated equipment, laboratories, procedures, scheduling capacity Prevents quality activities from becoming schedule bottlenecks
Response to findings Nonconformance aging, root-cause quality, recurrence, escalation behavior Indicates how the supplier handles adverse information
Part 21 awareness Procedures, training, evaluation records, notification interfaces Clarifies responsibilities when basic components or related services are involved
Capacity and continuity Staffing, facilities, workload, key-person dependence, lower-tier controls Tests whether controls can be maintained through delivery

Maintain qualification during execution

Projects often fail at the transition from an approved supplier to production. Establish surveillance and reporting points in the subcontract and monitor them throughout performance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

At kickoff

  • Confirm the latest procurement specification, drawings, procedures, inspection-and-test plan, and approved personnel list.
  • Review lower-tier suppliers and special processes.
  • Set the records-submittal schedule and identify hold, witness, and notification points.

During work

  • Review progress records and inspect defined hold points before work becomes inaccessible.
  • Control deviations, substitutions, design changes, and nonconforming work before continuation.
  • Verify that calibration, personnel qualifications, material identification, and environmental conditions remain current.
  • Track corrective actions to verified closure and reassess recurring issues.

At delivery and closeout

  • Perform the specified receipt examination before installation or use.
  • Reconcile item identity, quantities, damage status, certificates, inspection and test results, and unresolved conditions.
  • Accept only a complete, approved records package that meets the procurement documents.
  • Update the supplier’s performance history for future scope decisions.

Common qualification failures and corrective responses

“The supplier is ISO-certified, so it is qualified.”

A general management-system certificate may be useful background evidence, but it does not demonstrate conformity to the project’s nuclear QA requirements. Map the certificate’s scope and exclusions, then perform the package-specific review and verification.

“The supplier has an NQA-1 manual.”

Review implementation records, observe work, and test traceability. A manual without controlled execution is not sufficient evidence.

“The purchase order contains a generic nuclear-quality clause.”

Replace generic language with the actual regulatory, design, inspection, testing, records, notification, and lower-tier requirements for the package.

“The item is commercial, so dedication solves everything.”

First determine whether dedication is permitted and appropriate under current project procedures. Then define critical characteristics and acceptance methods. Dedication does not qualify the supplier organization.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The audit found no major findings, so oversight can stop.”

Continue proportionate surveillance through fabrication, testing, delivery, and records closeout. Quality effectiveness must be assessed at intervals consistent with the work’s importance, complexity, and quantity.

“Part 21 is only the licensee’s concern.”

Determine whether the subcontractor is a domestic supplier of a basic component or associated safety-related service. Assign evaluation, escalation, notification, and record responsibilities contractually and operationally.

Practical approval checklist

Before releasing a nuclear construction subcontract, confirm that the qualification file answers each question below.

  • Is the subcontracted scope, interface, location, classification, and acceptance boundary defined?
  • Are the applicable NRC, DOE, licensee, owner, design, code, QA, inspection, testing, records, and notification requirements identified?
  • Do the procurement documents flow those requirements to the subcontractor and relevant lower tiers?
  • Has the supplier’s written QA program and implementing procedures been mapped to the package?
  • Is there objective evidence that personnel, equipment, supervision, and records can support actual implementation?
  • Was the assessment method selected according to importance, complexity, and quantity?
  • Were findings documented with owners, due dates, acceptance criteria, and an approved disposition?
  • Is the supplier approval limited to the demonstrated scope, process, facility, and classification?
  • Are source inspections, witnessed tests, receipt examinations, and records reviews defined where needed?
  • Has Part 21 applicability and responsibility been evaluated?
  • If DOE rules govern, has the contract-specific 10 CFR 830 Subpart A or DOE Order 414.1D route been confirmed?
  • If commercial-grade dedication is proposed, are item-specific eligibility, critical characteristics, acceptance methods, and records defined?
  • Are ongoing surveillance, change control, nonconformance handling, corrective action, and closeout requirements scheduled?

What a defensible qualification decision looks like

The final record should allow an independent reviewer to see why the subcontractor was selected, what scope was approved, which requirements were flowed down, what evidence was examined, how gaps were resolved, and how conformity will be verified through delivery. It should also show the limits of the decision: a supplier qualified for one fabrication package is not automatically qualified for design, installation, testing, or a different safety classification.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For NRC-regulated work, the controlling principle is stated in 10 CFR Part 50 Appendix B, Criterion VII: “Measures shall be established to assure that purchased material, equipment, and services, whether purchased directly or through contractors and subcontractors, conform to the procurement documents.” Build the qualification process around that obligation, then tailor the evidence and oversight to the actual project.
