In the first hours, read the executed contract, identify its notice and direction procedures, notify the required people in the required form, and obtain written instructions for disputed work. Then track the event’s actual effect on the schedule and cost instead of assuming that every interruption delays completion.
The actual contract and applicable law control. Notice periods, authorized representatives, change-order authority, suspension rights, schedule requirements, and dispute procedures vary by contract and jurisdiction. Public-agency clauses discussed below are examples, not universal rules.

What to do in the first hours
A dispute becomes harder to manage when decisions are made informally or records are created weeks later. Use this sequence as an operational checklist, then conform every step to the contract.
- Assemble the controlling documents. Locate the executed prime contract, relevant subcontracts, amendments, incorporated specifications, exhibits, insurance requirements, and the current approved schedule. Confirm which document controls if terms conflict.
- Define the event. Record what happened, when it was discovered, the affected work areas and trades, the people involved, and any immediate safety, environmental, security, or protection-of-work concern.
- Map authority. Identify the owner’s authorized representative, architect or engineer, construction manager, contract administrator, and anyone authorized to issue a change, suspension, field order, or interpretation. A direction from an on-site person may not be a contractual authorization.
- Check notice requirements. Find the clause governing delay, differing conditions, changes, claims, suspension, payment, and disputes. Note the deadline, delivery method, required recipients, required form, and whether continuing notice is required.
- Send an initial written notice. Describe the event, discovery date, affected operations, and possible time or cost effect. State that the impact is developing if it cannot yet be quantified. Do not wait for a final number when the contract requires prompt notice.
- Request written direction. Ask whether the disputed activity should continue, pause, be resequenced, or be performed as changed work. Keep unaffected, authorized work progressing when feasible and safe.
- Open an issue file and cost code. Give the event a unique identifier and use it consistently in correspondence, daily reports, schedule narratives, photographs, invoices, and time records.
ASCE advises prompt notice in accordance with the contract. Its July 26, 2026 article also emphasizes that a first notice can be supplemented as the facts develop; an incomplete early estimate is not a reason to remain silent.

Read the contract for the rules that will decide the dispute
Do not rely on a standard form from another project. Build a one-page contract map showing where each rule appears and who must act.
| Contract topic | Questions to answer immediately | Operational consequence |
|---|---|---|
| Notice | What event triggers notice? How many days are allowed? Is notice written, electronic, certified, or sent through a project platform? Who must receive it? | A late or misdirected notice can affect entitlement even when the underlying event is real. |
| Direction and authority | Who may direct a change, suspend work, interpret the documents, or approve payment? Is a field instruction binding only after confirmation? | Proceeding on an unauthorized instruction can create payment and scope risk. |
| Changes and field orders | How are scope, price, overhead, time, and contract completion date adjusted? Are time-and-material tickets, unit prices, or force-account rules prescribed? | Use the contract’s form and pricing method; do not substitute an informal email for a required order. |
| Suspension and termination | What events permit suspension, who may order it, and what protection, demobilization, or termination costs are addressed? | Stopping without authority can be characterized as default or abandonment; continuing against an authorized suspension can create safety and payment problems. |
| Schedule updates | Which update format, narrative, logic, calendars, milestones, and critical-path information are required, and when are updates due? | Use the required schedule record to show whether the event actually affected completion. |
| Records and claims | What daily reports, cost codes, time sheets, photographs, meeting minutes, and claim forms are mandatory? Are contemporaneous records required for disputed work? | Missing records weaken both entitlement and the amount claimed. |
| Dispute resolution | Does the contract require project-level escalation, partnering, mediation, a dispute board, arbitration, or court? Are there continuing-work obligations? | Follow the sequence and preserve deadlines while the project continues. |
Acquisition.gov schedule clauses illustrate why the incorporated clause matters: some require schedule narratives, logic ties, critical-path activities, and regular updates, while alternates differ. The clause actually incorporated into your contract governs.
Send a notice that preserves rights without overstating the impact
An effective first notice is factual and timely, not argumentative. Include:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- the contract and project identification;
- the event or disputed direction, including the date and location;
- the work, trade, material, or access condition affected;
- the date you discovered it and the people who were notified;
- the immediate action taken to protect people, property, and work;
- the potential effect on activities, milestones, completion, labor, equipment, or procurement; and
- the reservation or statement required by the contract, plus a request for written direction.
If the duration, critical-path effect, or cost is unknown, say so expressly and explain when a supplement will be provided. A later notice should identify what changed, provide updated facts and calculations, and refer back to the original notice. Do not label a forecast as an established loss.
Send the notice exactly as the contract requires and retain proof of delivery. A courtesy copy to a superintendent or project manager does not replace delivery to the contractually designated recipient.

Build a contemporaneous project record
Open a searchable issue file on the day of the event. Preserve the original versions, metadata, and dates; do not overwrite a schedule or edit a photograph after the fact. ASCE’s framework treats the record as the foundation for both a change order and a defense against one.
Documents to collect
- baseline, accepted, and every updated schedule, including native files and narratives;
- emails, letters, texts, meeting minutes, daily reports, site diaries, and superintendent logs;
- RFIs, submittals, design responses, sketches, field orders, change proposals, and executed change orders;
- purchase orders, quotations, delivery tickets, inspection reports, test results, and nonconformance records;
- photographs and video with date, location, subject, and photographer identified;
- pay applications, invoices, payroll, time sheets, equipment logs, and payment records; and
- weather, access, outage, safety, and security records when they bear on the event.
Record the resources affected
For each affected operation, track worker names or crews, regular and overtime hours, equipment and standby time, materials used or wasted, location, production quantities, interruptions, remobilization, and the reason each resource was incurred. Use a separate cost code for the event so ordinary production costs are not mixed with claimed costs.
A construction daily logbook or field notebook can help capture observations at the work face, but it does not replace required notices, official daily reports, photographs, digital records, or schedule updates. Make entries objective: record who directed what, when, where, and the observable result rather than conclusions about blame.
Keep work moving only within authorized and safe boundaries
There is no universal rule to stop or proceed during a dispute. The contract, written direction, safety requirements, and applicable law determine the permitted response. Separate unaffected work from the disputed operation and ask for direction before performing extra scope.
| Response path | Schedule and trade effect | Authorization and evidence issues |
|---|---|---|
| Resequence unaffected work | May protect controlling activities and use available float, but can create out-of-sequence work, congestion, or later remobilization. | Confirm that the resequencing does not change scope or commit unapproved cost. Record the logic change, affected trades, and productivity result. |
| Obtain written interim direction | Clarifies whether a limited activity continues or pauses while a final decision is pending. | Ask who bears time and cost, what records are required, and when the direction will be revisited. Preserve the notice and response. |
| Perform authorized changed work | Can avoid a critical-path stoppage when the revised method or scope is clear. | Use the contract’s change form, price and time provisions, and daily tickets. Do not treat a verbal suggestion as authorization. |
| Proceed before price agreement | May avoid delay where the contract and authorized official permit it, but uncertainty remains over payment. | Use the prescribed time-and-material or force-account records and seek agreement as soon as practicable. FTA guidance describes this approach in applicable public-procurement settings; it is not a private-project rule. |
| Pause disputed work | Protects against unsafe or unauthorized performance but may affect milestones, procurement, and other trades. | Confirm that the contract authorizes the pause or that an authorized representative directed it. Protect installed work and document idle and remobilization effects. |
| Use mediation or another formal procedure | Can bring a decision-maker into the issue without immediately stopping all work, depending on the contract. | Follow the contract’s escalation order and deadlines. Record interim agreements and any work-continuation obligation. |
New York State Department of Transportation specifications effective January 1, 2026 illustrate a contract-specific exception to generic “do not perform extra work” advice: the contractor may be directed to continue disputed work while preserving a compensation dispute through written notice and daily records. That mechanism applies only when the contract incorporates those terms.

Analyze whether the dispute actually delays completion
Connect the event to the schedule through contemporaneous updates. A disrupted activity does not automatically move the project completion date; it must affect the controlling path after logic, float, mitigation, and other delays are considered.
Start with the right schedule snapshots
- Save the accepted baseline and the update immediately before the event.
- Identify the activities, relationships, calendars, milestones, and available float at that point.
- Compare actual progress and the latest update, marking the date and source of each status.
- Identify other events occurring at the same time, including owner changes, design information, procurement issues, weather, access constraints, and contractor-caused delays.
- Document mitigation attempted, such as resequencing, additional crews, alternate procurement, or extended shifts, and its cost and result.
Use a prospective analysis while facts are developing
A prospective fragnet inserts the developing event into the current schedule to estimate possible movement of milestones or completion. Label the assumptions, durations, logic ties, and mitigation scenario. ASCE cautions that a fragnet can focus on the inserted event and miss concurrent delays or later mitigation, so update it as facts change rather than treating the first forecast as final.
Use retrospective snapshots when the path has changed
Once enough updates exist, compare contemporaneous schedule snapshots to show how the critical path changed, what work actually controlled completion, and whether the event consumed float or displaced another controlling activity. Retrospective analysis is often more thorough but more labor-intensive. Follow the methodology and format required by the contract; do not impose a preferred method unilaterally.
Separate concurrency from causation
For each claimed day, identify the event, the affected activity, the logic connection to a milestone, the contemporaneous status, and any concurrent event. Explain whether the claimed effect is delay, disruption, acceleration, extended duration, or merely reduced productivity. The same day should not be attributed twice without a contractually supported basis.
Joseph Hellenbrand, P.E., M.ASCE, director of claims resolution at K2 Construction Consultants, states: “Use the contemporaneous project records to develop a delay and damages analysis to create or defend against change orders.”

Connect cost to the event
Time and cost claims are stronger when each amount can be traced to a dated event and a project record. Build a calculation that distinguishes:
- direct labor, material, and equipment used for changed or disrupted work;
- idle, standby, overtime, shift, remobilization, and inefficiency costs;
- extended field supervision, temporary facilities, insurance, and other time-related costs where contractually recoverable;
- credits, avoided costs, salvage, or work that was performed regardless of the dispute; and
- forecast amounts that remain assumptions rather than established costs.
Reconcile the calculation to payroll, invoices, equipment logs, delivery tickets, daily reports, and payment records. Explain the allocation method when a resource served several activities. Keep disputed entitlement separate from arithmetic so the decision-maker can see what is agreed, what is calculated, and what remains contested.
Control changed work and price before it becomes a larger dispute
Where practicable, agree scope, method, price, and time adjustment before changed work begins. If immediate action is necessary to avoid a larger delay, obtain written direction under the contract and use its prescribed records.
- Describe the original requirement and the proposed change.
- Identify the authorized issuer and the contract clause granting authority.
- State the effect on quantities, sequencing, milestones, completion, and safety or quality requirements.
- Submit the required price and time proposal, including assumptions and exclusions.
- If price is not yet agreed, obtain the applicable force-account or time-and-material authorization and have daily records signed as required.
- Submit updated pricing and schedule effects as information becomes reliable, then seek final agreement promptly.
FTA contract-administration guidance discusses proceeding before price agreement in applicable public procurement when doing so may avoid delay, with records and agreement as soon as practicable. Oregon’s public procurement manual likewise directs agencies to use the original contract’s change provisions and notes that standards can vary among agencies. Neither source creates a universal private-project procedure.

Issue minutes promptly. Record decisions, dissenting positions, open items, responsible people, deadlines, and interim directions. Meeting minutes are not a substitute for formal notice or a signed change order, but they establish what was discussed and what remained unresolved.
Know the limits of public-contract examples
Public clauses can illustrate useful controls, but their deadlines and remedies do not automatically apply to private work or to another agency.
| Example | What it illustrates | Limit |
|---|---|---|
| New York State DOT specifications effective January 1, 2026 | A cited time-related dispute provision uses 15-calendar-day written notice and requires daily records for affected work; disputed work may be directed to continue while compensation rights are preserved. | Those terms apply only to contracts incorporating the specification. Fifteen days is not a general deadline. |
| Acquisition.gov schedule clause | Schedule narratives, logic, critical-path activities, milestones, and updates can be contractual deliverables. | Alternates differ. The incorporated clause controls. |
| FTA change guidance | In applicable public procurement, authorized changed work may sometimes proceed before price agreement to avoid delay, with detailed records and prompt price settlement. | Authority and regulations of the grantee control; do not generalize it to every project. |
| Oregon Department of Administrative Services manual | Use the original contract’s change provisions and agency process. | It applies within the relevant Oregon procurement context; other agencies’ standards may vary. |
| FAR 22.504 project labor agreements | Covered agreements can include strike and lockout guarantees plus prompt, mutually binding labor-dispute procedures. | This is a federal-project labor context, not a remedy for every contractor dispute. |
Escalate before a deadline or safety problem becomes irreversible
Seek construction-law or claims-professional review when a notice deadline may have been missed, a party threatens termination, a suspension or acceleration demand is issued, safety or quality is compromised, exposure is substantial, or litigation is threatened. Provide the adviser the contract map, notices, schedule snapshots, issue file, cost records, and meeting minutes. A review cannot replace a missed contractual step, so escalate as soon as the trigger appears.
Keep communications professional and factual. Avoid accusations, admissions, or promises about entitlement before the contract and records have been analyzed. Preserve relevant electronic messages and do not delete or alter project records.
A repeatable protection system for the rest of the project
After the immediate dispute is stabilized, make the controls routine:
- review the notice and change clauses at every major subcontract award and amendment;
- require a current schedule update and narrative at each reporting cycle;
- use issue files and event cost codes for every potential change or delay;
- train supervisors on who may direct work and how to confirm verbal direction in writing;
- hold regular risk meetings that identify procurement, access, design, labor, and sequencing threats before they affect the critical path; and
- close each issue with a signed change, documented decision, or formal dispute submission, then update the schedule and forecast.
These habits do not guarantee recovery of time or money. They give the contract administrator, owner, contractor, and any later neutral a reliable way to distinguish authorized work, actual delay, mitigation, concurrent events, and unsupported assumptions.
