How to Plan a Safe Move When Your New Home Is Still Under Construction

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

You can move into a home that is still being finished only after the local building authority has approved occupancy of the specific home or portion you will use, and only when the occupied area is separated from active work. A builder’s estimated completion date, a passed private inspection, or a nearly finished interior is not the same as legal occupancy approval.

Start by obtaining the permit and occupancy document, checking its scope and expiration, and walking the approved access route with the builder. Then verify life-safety systems, utilities, exits, barriers and basic habitability. Keep the move date flexible until those gates are documented, and arrange storage or a rescheduled move as a contingency rather than assuming unfinished work will be harmless.

Make occupancy approval the first gate

Ask the builder which government authority controls the project and what document authorizes people to occupy the home. Depending on the jurisdiction, that document may be a final Certificate of Occupancy (CO), a Temporary Certificate of Occupancy (TCO), or another locally defined approval. Confirm the document with the building department, not only with the project manager.

New York City illustrates the legal principle clearly: its Department of Buildings says, No one may legally occupy a building until the Department has issued a CO or Temporary Certificate of Occupancy (TCO). That statement describes NYC requirements; it is not a universal rule you can apply without checking your own city, county or state. The NYC Certificate of Occupancy page explains that the certificate records required approvals and inspection sign-offs.

New Jersey’s Spring 2026 construction-code newsletter likewise distinguishes construction-related site visits from furnishing or occupying a building before the applicable approval. The details depend on the project and code path, so use the state guidance as a warning to verify your own approval rather than as a substitute for the local building department’s decision. Read the New Jersey Department of Community Affairs guidance if your project is in that state.

Understand what a CO or TCO actually covers

A certificate is not a general statement that every part of a construction site is safe. Read the document for the address, unit, floor, use, approved exits and any listed conditions. A TCO is conditional: it allows the specified occupancy while identified work or inspections remain, subject to local rules and an expiration or renewal process.

Situation What it means for planning What you must verify
Final CO The authority has completed the approvals required for the described use and area. That the CO covers your exact dwelling, all intended rooms and the route movers will use; confirm that no separate phase, access or utility approval is outstanding.
Temporary CO Occupancy is allowed only under stated conditions while specified work or sign-offs remain. Issue date, expiry date, covered portion and use, outstanding inspections, renewal procedure, and the person responsible for completing them.
No occupancy approval yet You do not have a documented basis for moving furniture or living in the home. Which inspections or corrections remain, when the authority will revisit, and what possession or move-date change will apply if approval slips.

Duration is local, not a universal TCO rule. Current official examples show why you must read the actual document:

Authority Published typical term Planning implication
New York City Department of Buildings TCOs typically expire after 90 days. Track the expiration and the remaining construction, plumbing and electrical sign-offs; ask about renewal before booking a move that could outlast the authorization. See the NYC TCO page.
City of Oakland A TCO is typically valid for up to 60 days. Confirm the exact end date and whether the project qualifies under Oakland’s stated policy. Review Oakland’s TCO requirements.
City of Eugene A typical TCO occupancy period is 30 days. Ask how the inspection visit, corrections and any extension are handled. See Eugene’s building-occupancy guidance.

These periods illustrate local variation; they are not interchangeable legal instruments or a prediction for another jurisdiction. A TCO can also cover only one unit, floor, phase or use. Do not infer that a cleared bedroom means the driveway, stairs, garage, common area or exterior route is included.

Collect and verify the documents before setting a firm move date

  1. Identify the authority having jurisdiction. Obtain the permit number, project address, legal description or unit identifier, and the building department’s contact details from the builder.
  2. Request the occupancy document. Ask for the final CO, TCO or locally named equivalent that applies to the home or phase you will occupy. Get the document itself, not a verbal assurance that it is “in process.”
  3. Check the record independently. Use the building department’s permit or certificate search where available. NYC, for example, provides a property-address search for CO records through its certificate page; other jurisdictions use different systems or require a direct request.
  4. Read the scope and conditions. Note the unit, floors, rooms, occupancy type, approved exits, utility status, restrictions and every outstanding item. Ask whether any portion of the site remains construction-only.
  5. Confirm dates and responsibility. For a TCO, record issue and expiry dates, renewal steps, required inspection appointments and the named person who will schedule corrections. Put those details in writing.
  6. Recheck after final inspections. A document can change when the authority approves additional work or a TCO expires. Request the updated record before movers arrive, especially if the move is weeks after the first approval.

Map a safe boundary between living space and active work

Walk the property with the builder or site superintendent after reviewing the occupancy document. Mark the rooms and routes that are approved for residents and the areas that remain under construction. Use the approved entrance, stairs, elevator, driveway and parking area only; do not create a shortcut through a work zone because it is closer.

Oakland states that, for its TCO process, Areas where work is still taking place must be effectively separated from areas being occupied or open to the public, including parking areas or outdoor spaces. Treat that as a practical test even where your local wording differs: barriers must prevent casual entry, remain stable during the move and protect both residents and workers.

New York City’s work-site safety and tenant/occupant-protection guidance identifies egress, fire safety, structural safety, health hazards such as dust, and protective means including barricades and signs. Ask who will install, inspect and maintain those protections while furniture is being carried.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document the boundary

  • Photograph the approved route and the barrier line before move day.
  • Mark doors or gates that residents and movers must not pass.
  • Confirm that temporary fencing, signs, covers and lighting will remain in place during deliveries.
  • Ask how noisy, dusty or overhead work will be isolated from occupied rooms and when that work will stop on move day.
  • Give the route and prohibited areas to every mover, subcontractor, visitor and household member.

Verify life-safety systems and basic habitability

Do not treat cosmetic completion as readiness. The local inspector’s checklist controls, but Oakland’s published TCO requirements show the categories to discuss: functional sprinklers and alarms where required, safe egress and exit signage, required rated construction, accessibility features, utilities, and dwelling-unit habitability. Your jurisdiction may use different terminology or require additional items.

Life safety

  • Ask whether required fire alarms, smoke alarms, carbon-monoxide alarms and sprinkler systems have passed their inspections and are functioning.
  • Walk every required exit from the occupied area to the approved exterior discharge. Check that doors open as intended, stairs are complete, handrails and guards are installed, and exit signs and emergency lighting are operational where required.
  • Confirm that fire-rated walls, doors and penetrations separating the home from unfinished areas are complete and have not been propped open.
  • Verify that temporary barriers do not narrow or block an approved egress route.

Utilities and habitability

  • Confirm permanent or authority-approved temporary electrical service, functioning outlets, safe panels and completed electrical sign-off.
  • Test water supply, drainage, toilets, hot water, heating or cooling, ventilation and lighting in the rooms you will occupy.
  • Ask whether plumbing fixtures can be used continuously during the move or whether shutoffs are scheduled.
  • Check that floors, stairs, windows, doors and ceilings in occupied rooms are complete enough to prevent falls, weather intrusion or contact with exposed materials.
  • Ask how dust, fumes, moisture, noise and debris from remaining work will be controlled, and who will clean the route before delivery.

These checks supplement, not replace, the authority’s inspection. If a system is incomplete or an inspector has imposed a condition, record it and obtain the builder’s written correction plan before approving the move.

Coordinate the move around approved access

Once the document and boundary are confirmed, create a written move plan. Include the delivery window, truck size, loading location, entrance, stair or elevator reservation, parking rules, protective coverings, site contact and emergency contact. Ask the superintendent to confirm that the route will be open, lit and free of materials at that time.

Schedule movers when construction activity is least likely to conflict with deliveries. A route that is safe during a quiet inspection can become unsafe when scaffolding, lifts, concrete trucks or subcontractors occupy it. Establish a stop-work signal: any household member or mover should be able to pause the move if a barrier moves, an alarm sounds, water appears, power fails or an unapproved hazard enters the route.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep children, pets and visitors out of construction-only zones. Do not ask movers to carry items across unfinished floors, around open shafts or beneath suspended loads. If the approved route changes, stop unloading and have the builder or authority confirm the replacement route before continuing.

Set go/no-go checkpoints and a fallback

Use at least two decision dates: an early verification date and a final go/no-go checkpoint shortly before the truck is due. At the early checkpoint, confirm the expected inspection schedule, remaining corrections, TCO term and route. At the final checkpoint, require a current occupancy document, confirmation that its scope includes your move route, and a site walk showing the required protections in place.

Write down what happens if any condition fails. Options may include revising the possession date, arranging temporary accommodation, storing furniture, or rescheduling the movers. Short-term storage or flexible moving services are reasonable contingency categories because approvals and inspection dates can shift; availability, cost and suitability depend on your location and contract. Do not move belongings into the home while waiting for a promised approval.

For a TCO, set a renewal reminder well before expiry. Ask the builder whether renewal is automatic, requires a new inspection, or is unavailable if certain work remains. A move that is legal on the issue date can become problematic if the authorization expires while you are living there.

Compare the practical scenarios before you commit

Scenario Advantages Risks and required controls Move decision
Final CO issued Most predictable legal status for the covered use and area. Unfinished work may still exist elsewhere on the property; verify separation, route and utilities. Proceed only after the site walk and access plan match the CO’s scope.
Valid TCO issued Allows conditional occupancy while listed work continues. Expiration, renewal, limited scope, remaining inspections and changing work zones. Proceed only with written conditions, a renewal owner, protected boundaries and a fallback date.
Approval delayed or absent Time to correct deficiencies without residents on site. Possession, storage, accommodation and mover costs may change. Do not occupy; activate the contractual and logistics contingency.

Account for jurisdiction-specific rules

New York City

NYC distinguishes a final CO from a TCO and publishes a TCO process involving construction, plumbing and electrical inspection sign-offs and a schedule of occupancy. Use the city’s certificate and TCO pages to verify the address, covered portion, conditions, expiration and any renewal steps. NYC lists a $130 TCO fee on its current page, although exemptions may apply; treat that as a local administrative detail, not a general moving cost.

Oakland

Oakland’s published policy emphasizes functional life-safety systems, minimum habitability and effective separation from occupied or public areas. It also states that its TCO policy applies to new projects, new units or changes in occupancy and excludes additions, remodels, alterations and tenant improvements. Those eligibility limits belong to Oakland’s policy; another city may classify your project differently. Confirm the exact project type before relying on a TCO path.

Eugene

Eugene describes a readiness process and an inspection visit before occupancy, with a typical TCO period of 30 days. Ask the building department what must be ready for the inspection, which areas the approval covers and how corrections or extensions are handled.

Other jurisdictions

Outside these examples, terminology, inspection order, fees, duration and renewal rights can differ. Give the building department your permit number and ask for the occupancy rule that applies to your exact project, rather than quoting another city’s TCO period.

Use this move-day checklist

Before the truck arrives

  1. Carry a current copy of the CO, TCO or local occupancy approval and the builder’s contact details.
  2. Walk the approved route; check lighting, stairs, floors, doors, barriers, signs and weather protection.
  3. Confirm that alarms, sprinklers, utilities, heating, ventilation, plumbing and electrical service are operating as agreed.
  4. Verify the truck’s parking and loading location with the site contact.
  5. Brief movers and household members on the boundary and the stop-work signal.

During unloading

  1. Keep the truck, ramps and dollies on the agreed surface; do not enter unapproved parking or outdoor work areas.
  2. Maintain clear exits and do not stack boxes in stairs, corridors, door swings or in front of alarms and electrical panels.
  3. Stop immediately if construction activity changes the route, a barrier fails, utilities are interrupted or a new hazard appears.
  4. Keep children, pets and visitors with an adult outside the work area.

After the last item

  1. Remove packaging and debris from the approved path without entering construction-only areas.
  2. Check that exit doors, fire equipment, panels and ventilation openings remain accessible.
  3. Report damage, leaks, dust intrusion or missing barriers to the builder in writing.
  4. Save photographs, the day’s access confirmation and any incident or correction record.

What to ask the builder and building department

  • What is the permit number and which authority issued the occupancy approval?
  • Is the approval final or temporary, and exactly which unit, rooms, floors and uses does it cover?
  • What are the issue and expiry dates, outstanding inspections and renewal steps?
  • Which entrances, stairs, elevators, driveways, parking spaces and exterior paths are approved for residents and movers?
  • How are active work zones separated from occupied and public areas?
  • Which fire, alarm, sprinkler, egress, accessibility, plumbing, electrical, heating, ventilation and lighting checks are complete?
  • Who will be on site during the move, and who can stop work or respond to an emergency?
  • What is the written plan if approval, an inspection or the approved route is delayed?

Apply a simple decision rule

Schedule the move only when three conditions are simultaneously true: the local authority has issued occupancy approval for the area and use you need; life-safety, utility and habitability requirements for that area are confirmed; and the route and boundaries keep residents and movers away from active work. If any one condition is missing, delay occupancy and use the fallback plan until the authority and builder document a safe, approved change.
