For an England project, show the legal determination period separately from recent Building Safety Regulator (BSR) performance. The Building (Higher-Risk Buildings Procedures) (England) Regulations 2023 set a 12-week determination period for a valid application unless a longer period is agreed in writing. BSR guidance updated 1 October 2026 describes assessment as up to 12 weeks for new higher-risk buildings (HRBs) and up to eight weeks for existing HRBs, subject to an agreed extension. In the latest BSR dataset (decisions from July to September 2026, data correct on 5 October 2026), median approval times were 23 weeks for new HRBs and conversions, 32 weeks for external remediation, 31 weeks for HRB internal works and 20 weeks for NHS internal works.
Those medians describe past cohorts, not a service-level commitment for your application. Build a live programme with separate submission, validation, assessment, decision and post-approval milestones; allow project-specific contingency; and prohibit relevant building work from starting until approval is issued.

What Gateway 2 controls
Gateway 2 is the building-control approval application stage for relevant higher-risk building work in England. The application must be approved before the relevant work starts. It is therefore a contractual, procurement and financing dependency as well as a regulatory task. A programme that treats submission as permission to mobilise can create unlawful start-on-site exposure, abortive procurement and unrecoverable preliminaries.

First confirm that the building and proposed work fall within the HRB regime and that a building-control approval application is required. BSR guidance identifies exceptions that can include certain exempt work, work carried out under a competent-person scheme and emergency repairs. The classification must be checked against the current guidance for the actual building and scope; do not use a generic checklist to decide that Gateway 2 is unnecessary.
#1 Best Overall
Legal period versus observed approval time
These figures answer different scheduling questions:
- Statutory determination period: for a valid application, the 2023 Regulations provide 12 weeks from receipt unless a longer period is agreed in writing.
- BSR guidance assessment period: guidance updated 1 October 2026 says assessment is up to 12 weeks for a new HRB and up to eight weeks for an existing HRB, unless an extension is agreed.
- Observed performance: BSR’s quarterly medians show how long decisions in particular cohorts took. A median is the middle result in that reporting group, not a promise about a new case.
The guidance limits and observed medians do not align in every cohort. Use both in the programme narrative: the legal period explains the procedural framework, while the current median is a historical benchmark for risk discussion. Never present either as a guaranteed approval date.
Current BSR benchmarks for England
The latest BSR release covers decisions during July–September 2026 and states that its data were correct on 5 October 2026. Match the category to the actual project before using a benchmark.

| Application category | Decisions or cohort reported | Median approval time | How to use it |
|---|---|---|---|
| New HRBs and conversions | 57 decisions: 55 approvals and two rejections | 23 weeks | Use for the overall new-build/conversion cohort, not automatically for complex cases. |
| Complex new-build cases | 30 complex cases in progress | 34 weeks | A distinct in-progress cohort; do not substitute it for the 23-week decision median. |
| External remediation | 110 decisions | 32 weeks | Use only where the work is external remediation. |
| HRB internal works | 185 decisions | 31 weeks | Use for the relevant HRB internal-works category. |
| NHS internal works | Reported separately by BSR | 20 weeks | Use only for NHS internal works, not for other internal projects. |
For new HRBs and conversions, BSR reported a 96% approval rate excluding invalid or withdrawn applications in this period. That rate does not remove the need to plan for requests, rejection or redesign; an approval percentage is not a forecast for an individual application.
Why the benchmark moves
The preceding June–August 2026 release reported medians of 22 weeks for new-build applications, 33 weeks for external remediation, 32 weeks for HRB internal works and 22 weeks for NHS internal works. It also reported a 16-week median for internal-works applications submitted in 2026, while older 2025 cases increased the overall internal-works figure. The change demonstrates why a single number should not be copied into a fixed programme. Reporting windows, application vintage and case mix alter the median.

Build the programme around five separate milestones
- Scope and route confirmed. Record the HRB determination, work category, building description, proposed stages and any potential exception. Obtain the project team’s agreement on what must be approved.
- Submission-ready package. Set an internal freeze date for drawings, specifications, fire and structural information, change control and supporting evidence. This is a project-management milestone, not an official BSR allowance.
- Application received and validation outcome. Keep evidence of submission and monitor whether BSR deems the application valid. Validation means the required information has been supplied sufficiently for the application to proceed; it is not approval.
- Assessment and information responses. Maintain a response log, owner and due date for each BSR request. Revisions should be coordinated across architecture, structure, fire, building services and construction details before being returned.
- Decision and post-decision start controls. Record approval conditions or required actions, issue the notice of intention to start work and complete applicable commencement steps before relevant work begins.
Show the statutory 12-week period and the category-relevant BSR median on the same programme, but label them differently. Add a decision milestone, not just an assessment bar, so procurement and mobilisation cannot drift ahead of the legal gate.
Make completeness a schedule-control activity
BSR says an application containing all required information is deemed valid and moves to assessment. Missing information may lead to a request for information or rejection. Treat the package like a design deliverable with independent checking, not like an administrative upload.

Pre-submission quality review
- Use the current BSR application guidance and confirm the requirements that apply to the building, work type and proposed stages.
- Check that architectural, structural, fire-safety, building-services and construction information describes the same building and interfaces.
- Resolve assumptions that would otherwise require an assessor question, including interfaces with existing construction and proposed temporary or phased works.
- Assign a single information manager to control versions, transmittals, responses and the evidence supporting each design decision.
- Hold a formal readiness review with the client, principal designer, principal contractor and relevant specialists before submission.
Do not call the application “approved” when it has only been uploaded, accepted for validation or deemed valid. Use those states in the project controls and in reports to lenders, insurers and the board.
Allow for complexity instead of applying a universal percentage
BSR’s guidance states: “The time it takes BSR (Building Safety Regulator) to assess your application will depend on the quality of the application and the complexity of the work.” The latest release’s 34-week median for 30 complex new-build cases illustrates the practical effect, but it is not a prediction for every complex project.
Assess complexity through a documented review rather than an arbitrary contingency percentage. Consider:
Rank #3
- novel or unusual structural, fire-safety or building-services solutions;
- interfaces with occupied or existing buildings;
- the number of disciplines and design organisations whose information must remain aligned;
- the number of towers, work packages or proposed approval stages;
- the maturity of evidence at submission and the likelihood of design changes during assessment;
- dependencies on surveys, tests, specialist designs, planning conditions or third-party information.
Set an allowance that the project manager can explain in terms of these factors, then review it whenever BSR issues a new quarterly dataset or the project scope changes. No source establishes a universal contingency percentage or an individual approval-date formula.
Plan staged and multiple-tower work carefully
BSR handles staged applications case by case and advises applicants to contact it before submitting a staged multiple-tower project. A staged submission can support a workable delivery strategy, but it should not be assumed that one approval clears every tower, stage or work package.
Controls for a staged strategy
- Define the physical and regulatory boundary of each stage and the work that cannot proceed until that stage is approved.
- Map shared foundations, fire strategy, services, access, logistics and temporary works so that an early stage does not depend on an unapproved later stage.
- Show a separate submission, validation, assessment and decision sequence for each approval dependency.
- Obtain BSR’s view on the proposed staged multiple-tower approach before submission, as advised in the guidance.
- Write contracts and procurement releases so that an unapproved stage cannot be treated as an authorised construction start.
Align procurement, finance and site mobilisation with the gate
Long-lead procurement can be prepared before approval, but the programme must distinguish design development, manufacturing, delivery and installation. A purchase order or off-site fabrication decision should identify what happens if the approval is delayed, conditioned or refused. Avoid irreversible commitments that assume a decision date unsupported by evidence.
Finance reports should show at least three dates: the planned submission, the risk-adjusted decision window and the earliest lawful start. Handover, drawdown and practical-completion forecasts should be linked to the latter, with explicit dependencies for post-decision actions. If the approval window moves, update the cash-flow and preliminaries forecast rather than quietly moving the site start.
Use a live dashboard and escalation rules
A useful Gateway 2 dashboard records:
- application category and whether the project is new, existing, remediation, internal or NHS work;
- submission date, validation status and the current assessment status;
- open BSR information requests, responsible owner and response due date;
- the current category median, reporting period and date on which BSR says the data are correct;
- the project’s complexity assumptions and the contingency rationale;
- the earliest lawful start and the activities expressly prohibited before approval;
- commercial and financing decisions that depend on the decision.
Escalate when information requests expose a design gap, when a response changes another discipline’s design, when the application is rejected or when the latest BSR data materially change the planning range. Re-baseline only after the project team records the cause and downstream effects.
Common planning errors and corrections
Using 12 weeks as a guaranteed date
Correction: label 12 weeks as the statutory determination period for a valid application, subject to a written longer period, and show the relevant observed median separately.
Assuming validation equals approval
Correction: keep validation, assessment and decision as different statuses. A valid application can still receive questions, be rejected or require design work before approval.
Applying the new-build median to remediation
Correction: select the category that matches the work. The July–September 2026 medians were 23 weeks for new HRBs and conversions, 32 weeks for external remediation, 31 weeks for HRB internal works and 20 weeks for NHS internal works.
Using the 34-week complex figure as the normal new-build time
Correction: the 34-week figure covers 30 complex new-build cases in progress, while 23 weeks is the median for 57 new-HRB and conversion decisions. They are different cohorts.
Starting relevant work after submission
Correction: prohibit the relevant building work until approval and applicable commencement steps are complete. Keep enabling activities under legal and technical review rather than assuming they are automatically permitted.

Freezing the programme after one quarterly release
Correction: check the latest BSR performance release and project communications before committing to procurement, financing or handover dates. Historical medians change with reporting windows and case mix.
A practical decision framework for your baseline
- Classify the project. Identify the HRB status, work category, geography and whether it is staged or single-stage.
- Select the closest benchmark. Use the latest BSR median for that category and record its July–September 2026 period and 5 October 2026 data date, unless a newer release is available when you plan.
- Test complexity. Decide whether the project resembles a complex case and document why. Do not mathematically combine the 23-week and 34-week figures.
- Check evidence readiness. Rate the package against the current guidance and schedule internal review time before submission.
- Set a range, not a promise. Present the statutory period, the observed median and a project-specific contingency as three different planning inputs.
- Protect the gate. Tie site start, installation, drawdown and downstream dates to approval and commencement actions.
- Refresh the forecast. Revisit the range after validation, each substantive information request, any scope change and each new BSR quarterly release.
What clients should require in reporting
Ask the project team to report the application category, submission and validation dates, open requests, current forecast range, contingency rationale and earliest lawful start. Require written notice when a design change affects the approval package or when a staged dependency changes. This creates an auditable explanation for any movement in procurement, cost, financing or completion dates without implying that BSR has guaranteed a result.
The central planning rule is simple: Gateway 2 is a decision gate. Use the 12-week statutory framework and BSR’s current category medians to frame the risk, but let application quality, complexity, project dependencies and live regulator information determine the working programme.
Frequently Asked Questions
Does the 12-week Gateway 2 period guarantee approval within 12 weeks?
No. The 12 weeks is the statutory determination period for a valid application unless a longer period is agreed in writing. BSR’s observed medians for July–September 2026 were longer for several categories, so it should not be presented as a guaranteed project date.
Can construction start while a Gateway 2 application is being assessed?
Relevant building work must not start before approval. Keep the start-on-site milestone after the decision and applicable commencement actions.
Which BSR median applies to a refurbishment project?
It depends on the defined work category. The July–September 2026 release reported 32 weeks for external remediation, 31 weeks for HRB internal works and 20 weeks for NHS internal works. Confirm the category against the current BSR guidance.
Is a validated application approved?
No. Validation means the application contains the information needed to proceed to assessment. Approval is a separate decision, and BSR may request information or reject the application.
