In Australia, you can generally photograph a building from a place where you are lawfully present. You do not, however, acquire a right to enter private land, ignore a site’s conditions, record private activities, or fly a drone wherever the building is visible. The legal result depends on your vantage point, what the image reveals, who is taking it, and— for drone work—aviation and airspace rules.
Use three checks before pressing the shutter: confirm you may stand at the proposed location, inspect the frame for identifiable people or private activity, and verify any drone flight with the Civil Aviation Safety Authority (CASA), the land manager and the relevant state or territory rules. This is a national overview as at October 2026, not a substitute for advice about a particular site or dispute.

The three questions that decide whether the photograph is lawful
- Where will you stand? You need a right to be on the land or in the place from which you take the image. A clear view from a footpath does not authorise you to cross a boundary, climb a fence, enter a construction site or remain after an authorised person tells you to leave.
- What does the frame reveal? An image can contain personal information when a person is identifiable or could reasonably be identified. A building exterior is very different from a view through a window, a secluded courtyard or a scene showing someone’s private activities.
- Are you using a drone? A drone flight must satisfy CASA’s safety rules as well as land-manager, site and state or territory requirements. An open public space or an unobstructed view of a building does not by itself make the flight legal.
Taking a building photograph from the ground
Public streets, footpaths and other places where you are entitled to be
When you are lawfully on a public street, footpath or other accessible place, an ordinary photograph of a building’s exterior will usually present fewer access problems than a photograph taken from private land. Keep the camera in the place you are entitled to occupy, obey signs and directions, and avoid equipment or behaviour that obstructs people or creates a safety hazard.
“I can see it” is not the same as “I may stand there.” A better angle may be inside a driveway, garden, car park, building foyer or fenced work area. Obtain permission before moving onto private property, even if you intend to take only one picture. Permission to make an image also does not automatically grant permission to enter; ask specifically about both access and photography.

Private property and trespass
Ask the person or organisation with authority to control access before entering private land. Follow any conditions attached to that permission, such as a specified route, time, escort, high-visibility clothing or a prohibition on photographing workers, plans or neighbouring properties. Leave when an authorised person withdraws permission or directs you to leave.
Office of the Australian Information Commissioner (OAIC) guidance on Australian Privacy Principle 3 gives trespassing on private property as an example of collecting personal information by a means that may constitute a civil wrong. That guidance highlights why lawful access matters; it is not a complete statement of every state and territory trespass rule. The legal consequences of entering, refusing to leave, or damaging a gate or fence depend on the jurisdiction and circumstances.
Managed places and conditions of entry
National parks, heritage properties, cultural places, transport facilities, galleries, tourism attractions and privately operated sites can impose conditions separate from general public-access rules. A site may require a permit, prohibit tripods or commercial photography, restrict flash, close an area temporarily, or ban images of sensitive objects. Australia has no single national permit rule covering every such location. Check the named land manager’s current access and photography conditions before you arrive.

Privacy: when a building image also captures people
Identifiable people can make an image personal information
OAIC guidance treats a photograph or video as personal information when a person’s identity is clear or could reasonably be worked out. Identification may come from a face, a uniform, a vehicle, a name badge, the location and time, or a combination of details. A person need not be the main subject for the image to contain personal information.
Check the entire frame, including reflections, balconies, windows, security monitors and metadata that you plan to publish alongside the image. Crop, blur or retake the photograph when people are incidental and identifiable details are unnecessary to your purpose. Do not assume that being outdoors removes all privacy concerns: a secluded area, a telephoto view into a home or a recording of a private activity raises a different question from a wide streetscape.
Private individuals and the federal Privacy Act
The federal Privacy Act generally does not cover an individual acting in a private capacity. That means a person photographing a house for a personal album is not automatically subject to the Australian Privacy Principles merely because another person appears in the frame. Other laws can still apply, including state or territory rules concerning surveillance, harassment, confidentiality, defamation or trespass. The personal-capacity exception is not permission to intrude into someone’s private life.

Organisations and agencies
The Australian Privacy Principles apply when a covered organisation or agency collects the image. OAIC guidance says relevant entities should tell people before recording them, protect recorded personal information, and dispose of or de-identify it when it is no longer needed, subject to applicable retention duties. Establish why the image is needed, limit collection to that purpose, control access to the file and set a retention and deletion process.

For a construction company, this means separating an exterior progress photograph from a worker-identification exercise. Use the least identifying view that documents progress, brief staff and contractors about photography, and obtain any consent or notice required for identifiable workers, residents, visitors or clients. A sign at an active site may help communicate the practice, but it does not cure an unsafe entry or an intrusive image.
The statutory tort for serious invasions of privacy
A statutory tort for serious invasions of privacy commenced on 10 June 2025. The OAIC describes it as an additional avenue for privacy harms and notes that it is broader in application than the Privacy Act’s usual coverage. The OAIC does not administer the tort; a person considering a claim should obtain independent legal advice.

The current Act requires the elements of the particular claim to be met. They include an intrusion upon seclusion or misuse of information, a reasonable expectation of privacy, intentional or reckless conduct, seriousness, and a balance in which the person’s privacy outweighs countervailing public interest. The Act allows a claim without proof of damage. It defines intrusion upon seclusion as including watching, listening to or recording the person’s private activities or private affairs
. A photograph of a building alone does not automatically meet those tests; the vantage point, method, subject matter and purpose are decisive.
Ground-photography scenarios compared
| Method | Access question | Privacy question | Extra permissions or checks |
|---|---|---|---|
| Public footpath or street | Remain within the area you may lawfully use; do not step onto a verge, driveway or work zone controlled by someone else without checking. | Review people, windows, balconies and reflections in the frame. | Obey local signs, road-safety directions and any event or crowd-control restrictions. |
| Private driveway, yard or building interior | Obtain permission from the person or entity controlling access and follow its conditions. | Agree what may be photographed, including neighbouring lots and occupants. | Confirm whether the permission covers publication, commercial use and repeat visits. |
| National park, heritage or cultural site | Use only routes and areas open under the site’s current conditions. | Respect sensitive cultural or private activities and avoid unnecessary identifiable people. | Check the named land manager for permits, closures, equipment limits and no-photography areas. |
| Construction or industrial site | Enter only under the site controller’s approval and safety induction. | Protect worker, resident, client and security information. | Follow personal-protective-equipment, escort, exclusion-zone and confidentiality requirements. |
Drone photography: the recreational baseline
CASA’s published recreational rules, on the page last updated 11 October 2024, set the following national baseline. Rules can change, so check the current CASA material and safety-app information immediately before each flight.
| Rule | What it means for a building photograph |
|---|---|
| Maximum height: 120 m above ground level | Measure from the ground below the drone, not from the photographer’s launch point or the top of a nearby hill. |
| At least 30 m from other people | Keep the drone at least 30 m away and never fly over another person. Treat 30 m as the ordinary recreational minimum. |
| Daylight only | Plan launch, flight and landing during daylight; a well-lit building at night does not make a night flight recreationally permissible. |
| Visual line of sight | Keep the aircraft visible to the operator throughout the flight, without relying solely on the screen feed, binoculars or another observer. |
| No hazardous operation | Do not fly in a way that endangers people, property, emergency operations or public safety. |
| Privacy must be respected | A technically safe flight can still create privacy problems if it records private activities or peers into places where people reasonably expect privacy. |
Populous areas and restricted airspace
CASA says a populous area can include residential areas, parks, beaches, roads, footpaths, city areas, festivals, sporting events and weddings. A drone must not be flown in a populous area under the recreational baseline. Many iconic buildings and tourism sites are also in restricted airspace. The fact that a building is visible from a public place does not establish that its surrounding airspace is open.

Before every flight, use CASA’s drone safety app to identify airspace restrictions and safe locations. Check temporary restrictions and emergency activity as well as permanent controlled or prohibited areas. National parks and wildlife zones may impose additional limits, and a private property owner may require permission for launch, recovery or access. State and territory rules can add requirements.
Flying near people
CASA describes limited conditions under which certified operators may operate closer than 30 m with consent; other situations require CASA approval. Those exceptions are not a shortcut for an ordinary recreational photographer. If people may enter the operating area, postpone, relocate, create a lawful exclusion zone or use a ground camera instead. Never fly over people.

For a ground camera
- Identify the exact viewpoint. Mark the spot where your feet, tripod and vehicle will be. Check whether it is public, privately controlled or subject to a site manager.
- Confirm access. Obtain permission before crossing a boundary. Record the name of the person granting access, the date, permitted areas, time limits and any publication conditions.
- Read signs and site rules. Look for photography bans, permit requirements, safety directions, cultural restrictions and temporary closures.
- Survey the frame. Look for faces, workers, children, house interiors, private courtyards, vehicle plates, documents, screens and reflections. Recompose, crop or blur where those details are not necessary.
- Decide who controls the image. Personal use, a builder’s project record, an agency’s marketing campaign and editorial publication may create different privacy, confidentiality and consent obligations.
- Photograph without creating a nuisance or hazard. Keep clear of roads, pedestrians, emergency routes and active work. Follow the site controller’s instructions.
- Store and share carefully. Restrict access to identifiable images, remove unnecessary copies and apply the organisation’s retention and deletion process where the Privacy Act applies.
For a drone
- Confirm the operator category. These baseline limits are for recreational operation. Commercial, certified or otherwise approved operations may have additional obligations.
- Check the CASA safety app immediately before launch. Verify airspace, temporary restrictions and the proposed flight area.
- Check the land manager and launch site. Obtain permission for private land and review national-park, wildlife-zone, heritage and venue conditions.
- Map people and the 30 m buffer. Do not launch if you cannot maintain at least 30 m from every person and never plan a flight over people.
- Set the operating limits. Keep below 120 m above ground level, fly in daylight, maintain visual line of sight and plan a route that avoids hazardous operation.
- Assess privacy before recording. Do not point the camera into windows or secluded areas. If a person or private activity is not necessary to the building record, exclude it.
- Abort when conditions change. Land if people enter the buffer, visibility is lost, an emergency begins, a restriction appears or a site controller withdraws permission.
What to do when someone objects
If a landholder or site manager asks you to stop
Stop recording, lower or secure the equipment and leave if the person is entitled to control the area. Do not argue that the building is visible from outside or that you have already taken the picture. If you believe you had permission, preserve the written approval and resolve the issue later through the site’s contact channel.
Windows Errors? Fix Them Before They Spread

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteIf someone raises a privacy concern
Ask what part of the image concerns them, avoid publishing while you assess it, and consider deleting or de-identifying an unnecessary copy. An organisation should route the complaint through its privacy process, restrict access to the file and document the decision. A private photographer should not treat the absence of a Privacy Act obligation as a licence to continue an intrusive recording.
If a drone flight becomes unsafe or restricted
Land immediately in the safest available place, provided doing so does not create a greater hazard. Record the relevant time and location, then check CASA and the land manager before any further operation. Do not relaunch merely because the building remains in view.
Quick decision guide
| Question | If the answer is yes | If the answer is no or uncertain |
|---|---|---|
| May you lawfully stand or launch at the proposed location? | Continue to the frame and safety checks. | Obtain permission or choose a lawful public viewpoint. |
| Could the image identify people or reveal private activities? | Recompose, de-identify, obtain appropriate consent or document a lawful purpose and safeguards. | Continue, while checking reflections and background details. |
| Is an organisation or agency collecting the image? | Apply the relevant Australian Privacy Principles, notice, security and retention controls. | Other laws and site conditions may still apply. |
| Is a drone involved? | Run the CASA, airspace, people-distance and land-manager checks. | Follow the ground-photography access and privacy checks. |
| Is the location managed, heritage-listed, culturally sensitive or inside an active work area? | Follow the named manager’s current conditions and safety directions. | Use the ordinary lawful-access and privacy analysis. |
Limits of a national answer
Australian privacy, trespass, surveillance, heritage, park and public-space rules are not contained in one uniform national code. The national guidance does not establish a complete state-by-state list of permits or trespass offences. For a particular address, identify the state or territory, the landowner or land manager, the building’s status and the intended use of the image before relying on a categorical answer.
