There is no single statewide “restaurant planning permit” in California. Permission is assembled from the city or county that controls the property, the local building and fire departments, the local environmental-health agency, and—if you will sell alcohol—the California Department of Alcoholic Beverage Control (ABC). Start with the exact address, confirm zoning and any required entitlement before committing to the site, then coordinate the food-facility, construction, health, business and alcohol approvals that apply to your project.
The sequence matters. California Retail Food Code section 114380 requires food-facility plan approval before new construction or remodeling, and the building department cannot issue a building permit until it has received that approval. Alcohol licensing follows a separate process that includes local review, public notice and an ABC investigation. Requirements, fees and waiting times vary by jurisdiction and project scope.

What “planning permission” means for a California restaurant
California does not issue one permit that covers every restaurant project. Instead, several agencies decide whether the proposed use is allowed, whether the building can be occupied safely, whether the food facility meets the Retail Food Code, and whether alcohol may be sold.

The property address is the starting point because the city or county determines the zoning district, planning procedures, building and fire contacts, and environmental-health authority. A restaurant that is permitted without a land-use hearing in one jurisdiction may need a zoning clearance or a Conditional Use Permit (CUP) at another address. A new build, a conversion of a retail space, and a takeover of an existing restaurant can therefore have very different approval paths.

CalGOLD is useful for identifying the agencies and contacts that may apply to a business, but California GO-Biz expressly states that “CalGOLD does not issue permits or licenses.” Each listed agency controls its own forms, fees, review and inspection decisions.
Step 1: Verify zoning before signing a lease or buying a site
Ask the city or county planning department to review the exact address and proposed operation. Obtain the answer in writing where possible, and describe the restaurant accurately rather than simply calling it a “retail” use.
Questions to put to the planning department
- Is restaurant use permitted in the zoning district, or is a zoning clearance required?
- Is a Conditional Use Permit or another land-use entitlement required for this site?
- Do the proposed hours, late-night service, deliveries, outdoor dining, entertainment or amplified sound change the review?
- What parking, traffic, loading, signage and occupancy rules apply?
- Does serving alcohol require a CUP or additional local approval?
- Are there special rules for patios, sidewalk dining, shared parking or a change from the previous tenant’s use?
A CUP is conditional, not automatic. The planning department decides whether the proposed use and site trigger it. Oakland, for example, requires zoning clearance for proposed businesses and notes that a CUP may also be necessary. Los Angeles explains that a project that does not meet zoning requirements may need a planning land-use entitlement. Those examples do not establish a statewide rule; they show why the address-specific determination must come first.

An existing restaurant can reduce construction risk, but it does not guarantee that your menu, hours, patio, entertainment, occupancy or alcohol service is already authorized. Ask planning and building officials to confirm which approvals can be reused and which changes require a new review.
Map the project before choosing between locations
Compare candidate sites by the factors that drive approvals, not just by rent or visibility. The following framework helps identify the likely critical path.
| Project factor | Lower-complexity path | Higher-complexity path | Why it matters |
|---|---|---|---|
| Zoning certainty | Restaurant permitted by right | Zoning clearance, CUP or another entitlement | Planning review can add application requirements, public notice or conditions before construction can proceed. |
| Existing infrastructure | Prior food use with compliant utilities | Major remodel or new construction | More structural, equipment, utility and inspection work is likely. |
| Construction scope | No building work | Tenant improvement or new build | Building, fire, accessibility, mechanical, electrical and plumbing review increases with the scope of work. |
| Food operation | Ordinary preparation | Processes needing additional health review or HACCP controls | The environmental-health agency may require additional documentation or controls for the proposed processes. |
| Alcohol plan | No alcohol | Beer and wine or broader on-premises privileges | License type, local zoning review, public notice and ABC investigation differ by the proposed privileges. |
| Local service level | Standard review | Qualifying streamlined restaurant program where offered | Some jurisdictions, such as San José, offer programs for qualifying restaurants, but eligibility and scope are local. |
Step 2: Confirm business, tax and local registrations
California’s Secretary of State warns that requirements vary by county and city and directs applicants to check local rules for zoning, licensing, employment, permits and taxes. Confirm the registrations that apply to your business structure and location, including any city or county business license and tax accounts.

Use CalGOLD to identify possible agencies, then contact each agency directly. A directory entry is not an approval, and one agency’s decision does not replace another agency’s permit. Keep a contact list with the department, assigned reviewer, application number, submission date and outstanding items.
Step 3: Prepare one coordinated plan set
Coordinate the plans before submitting separate applications. Local building and fire departments review construction, occupancy, accessibility, mechanical, electrical, plumbing and fire-safety elements. The food-plan reviewer must be able to understand the same layout and equipment that the building and fire reviewers will see.
Elements that commonly need coordination
- Proposed floor plan, occupancy and circulation.
- Food preparation, storage, warewashing and service equipment.
- Mechanical, electrical and plumbing work associated with the equipment.
- Fire protection and exit arrangements.
- Accessibility features and restroom compliance.
- Grease-interceptor requirements where applicable.
- Outdoor dining, delivery areas, signage and other site features tied to the approved use.
San José states that restaurant plans are reviewed for zoning, building and fire-code compliance before a building permit. Los Angeles County identifies grease interceptors and Americans with Disabilities Act (ADA) compliance as examples of additional local requirements. The exact drawings, calculations and supporting documents depend on the jurisdiction and the work proposed.
Step 4: Obtain food-facility plan approval before construction or major remodeling
California Retail Food Code section 114380(a) requires a person proposing to build or remodel a food facility to submit “complete, easily readable plans drawn to scale, and specifications” to the enforcement agency and receive plan approval before starting new construction or remodeling for use as a retail food facility.
What the statutory sequence requires
- Prepare complete, readable, scaled plans and specifications for the proposed retail food facility.
- Submit them to the responsible local enforcement agency for review.
- Wait for approval before starting new construction or remodeling.
- Provide the approval to the building department. Under section 114380(e), the building department shall not issue a building permit for a food facility until it has received plan approval from the enforcement agency.
The enforcement agency must approve or reject the submitted plans within 20 working days under section 114380. That is a review deadline, not a promise that the entire project will be permitted in 20 days; incomplete submissions, corrections, resubmissions and other agency approvals can extend the overall schedule.
Keep food approval separate from the operating permit
Plan approval authorizes the proposed design to move through construction review. It is not the final permission to operate. You still need the local environmental-health or public-health permit and the required inspection before opening.

Step 5: Apply for the local environmental-health permit and pass inspection
The California Department of Public Health (CDPH) explains that the Retail Food Code covers structural, equipment and operational requirements and is primarily enforced by 62 local environmental-health regulatory agencies. CDPH headquarters is therefore not usually the office that issues your restaurant’s day-to-day retail-food permit.
Contact the county or city environmental-health agency for its application, fees, plan-check procedures and inspection schedule. Los Angeles County directs new or substantially remodeled restaurants through its Plan Check Program and then to a public-health permit. Other jurisdictions use their own forms and workflows.
Prepare for the health inspection
- Build only from the approved plans, including approved equipment and utility connections.
- Resolve construction items identified by the plan checker before requesting the operating inspection.
- Keep plan approval, permit conditions and inspection records available for the inspector.
- Ask the agency before changing equipment, food processes, menu-related layouts or service areas.
The agency’s inspection schedule and local fee structure are jurisdiction-specific. Do not assume that passing a building inspection automatically satisfies environmental-health requirements.

Alcohol adds a separate state license and a local review track. Before applying, California ABC advises applicants to contact county or city officials about a local business license, zoning and whether a CUP is required. Decide which privileges the operation actually needs; beer-and-wine service and broader on-premises privileges do not follow the same licensing path.
What the ABC process can involve
- Application submission for the appropriate license type.
- Notification to the local government.
- A 30-day public-notice posting period and the statutory minimum period before issuance.
- ABC investigation, including review of the application and site circumstances.
ABC publishes approximately 55–65 days as a normal investigation timeframe in its FAQ, while its License Application Requirements materials cite approximately 90 days as an average for an original license. These are planning benchmarks, not guarantees. Objections, incomplete information, local issues or agency workload can make the process longer, so do not schedule a grand opening around the average alone.
Coordinate alcohol and land-use decisions
Do not wait until construction is finished to discover that the planned alcohol service conflicts with local zoning or requires a CUP. Confirm the local position during site selection and keep the alcohol use described consistently in planning, building, health and ABC submissions.

What must be approved before construction starts?
The exact list depends on the address and scope, but a restaurant project that involves construction should normally have the following decisions mapped before work begins:
Recommended Free Tools
- Planning confirmation that the restaurant use is allowed, or an approved zoning clearance, CUP or other required entitlement.
- Food-facility plan approval under Retail Food Code section 114380.
- Building and fire applications coordinated with the approved food plans.
- Any local approvals for occupancy, accessibility, mechanical, electrical, plumbing, grease interception or site work that apply to the design.
- Construction permits issued by the responsible building authority. For a food facility, the building department must first receive the food-plan approval.
Some registrations and the alcohol license may be completed on a different schedule, but they should still be started early enough to avoid blocking opening. Ask each agency whether its approval is a prerequisite to the next submission.

There is no reliable statewide end-to-end timeline for opening a restaurant. Use the component figures below only as benchmarks, then confirm the current queue and dependencies with the responsible agencies.
| Process component | Published figure | Qualification |
|---|---|---|
| Retail Food Code plan decision | 20 working days | California Retail Food Code section 114380; the enforcement agency must approve or reject submitted plans. Corrections or other approvals can extend the project. |
| ABC public notice and statutory minimum | 30 days | ABC’s current FAQ describes the public-notice posting period and minimum period before issuance. |
| ABC investigation | Approximately 55–65 days | ABC FAQ average for normal investigations; longer delays are possible. |
| ABC original license | Approximately 90 days | ABC License Application Requirements average; circumstances can lengthen the process. |
Build a dependency-based schedule
- Obtain the zoning decision before lease deadlines or purchase contingencies expire.
- Submit a coordinated food, building and fire package rather than designing each review in isolation.
- Allow time for corrections and resubmissions; the 20-working-day food review figure does not include every project task.
- Start the ABC application early if alcohol is central to the business model.
- Book inspections only after the relevant construction and health work is complete.
- Set the opening date after required approvals are issued, not when plans are first submitted.
Common problems and how to recover
The site is not clearly permitted for restaurant use
Stop before committing further funds and ask planning whether a zoning clearance, CUP or another entitlement is available. If the use cannot be approved on reasonable terms, compare another site rather than assuming the building permit process will solve a land-use problem.
A CUP or other entitlement appears after the lease is signed
Confirm the application procedure, hearing or notice requirements, operating conditions and schedule with planning. Review lease contingencies and opening obligations with qualified advisers before accepting a site whose entitlement is uncertain.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesThe building department will not issue a permit
For a food facility, verify that the building department has received the enforcement agency’s food-plan approval. Resolve any mismatch between the food, building and fire plan sets, then resubmit the complete package through the agency’s stated process.

Plans are rejected or returned for corrections
Use the reviewer’s comments as the controlling list, revise every affected sheet and resubmit a coordinated set. Do not begin construction while waiting for approval; section 114380 requires approval before new construction or remodeling.
Health inspection identifies work that was not shown on the plans
Ask the environmental-health agency whether the change requires revised plan approval before you install equipment or alter the layout. A field change can affect building, fire and accessibility reviews as well as food-code compliance.
The ABC license is taking longer than expected
Check that public notice, local-government notification and requested investigation information are complete. Treat the 55–65-day and 90-day figures as averages, and keep the opening plan flexible until ABC confirms issuance.

Records to keep in one project file
- Written zoning determination, zoning clearance, CUP or other entitlement and all conditions.
- Approved food-facility plans and specifications.
- Building, fire and related construction permits.
- Environmental-health plan-check correspondence, public-health permit and inspection sign-offs.
- Business-license and tax-registration confirmations.
- ABC application, notice documentation, correspondence and final license.
- Approved revisions and written agency responses to later changes.
Keeping these records together helps contractors, inspectors and operators work from the same approved version and makes it easier to prove that a later change was authorized.
A practical pre-commitment checklist
- Have you given planning the exact address, proposed use, hours, outdoor areas, entertainment, deliveries and alcohol plan?
- Is the restaurant permitted by right, or is a zoning clearance, CUP or other entitlement required?
- Have you compared the cost and schedule of existing restaurant infrastructure with a major remodel or new build?
- Has the local food enforcement agency confirmed its plan-review process and submission requirements?
- Are the food, building and fire plans coordinated and drawn to the required scale?
- Have you identified the environmental-health agency that will issue the operating permit?
- If alcohol is planned, have local officials confirmed zoning and CUP issues before the ABC application?
- Have lease, financing and announcement dates been set with allowance for corrections, inspections and ABC delays?
Once every applicable approval and inspection is complete, open only within the approved use and conditions. A California restaurant permit strategy is successful when the address, plans, construction, food operation and alcohol service all tell the same story to the agencies that regulate them.
