Before ordering equipment or starting site work, identify every authority having jurisdiction (AHJ), confirm the locally adopted code editions and amendments, and obtain written pre-application direction. Submit a coordinated package covering civil, structural, architectural, electrical, mechanical, fire protection, controls, factory-built evidence, and commissioning. A module’s factory construction or portability does not remove building, electrical, fire, zoning, utility, or environmental obligations.
Why a modular data center still needs normal permits
A prefabricated enclosure can arrive largely assembled, but the completed installation still affects a site, its utilities, occupants, emergency responders, and neighboring properties. Foundations or anchorage, egress, fire resistance, electrical distribution, cooling, batteries, generators, fuel, drainage, noise, and utility connections all create code obligations. The local building official may regulate both the module itself and the work needed to place and connect it.

The 2024 International Building Code (IBC) Appendix K states that an owner, authorized agent, or contractor who constructs, enlarges, alters, repairs, moves, demolishes, changes occupancy, or installs regulated electrical systems “shall first make application to the building official and obtain the required permit.” That language is broad enough to include many relocatable or containerized data-center projects.

Permit requirements, fees, review times, occupancy classification, and zoning permissions cannot be stated universally. They depend on the project address, the jurisdiction’s adopted editions and amendments, and the equipment included in the module.

1. Define exactly what you are installing
Prepare a written basis-of-design description before contacting reviewers. The description should distinguish the factory-built module from site work and list every system that will be delivered or connected.
Record the physical arrangement
- Indoor or outdoor installation, including exposure to weather, flooding, corrosion, seismic effects, and vehicle impact.
- Fixed installation or a unit intended to be relocated.
- Module dimensions, weight, lifting method, support points, foundations, anchorage, and any interconnecting modules.
- Access routes for delivery, cranes, maintenance, replacement, and emergency response.
Record the technical systems
- IT racks, servers, and other equipment supplied inside the enclosure.
- Service voltage, available fault current, switchgear, transformers, distribution equipment, busway, branch circuits, and transfer equipment.
- Cooling method, heat rejection equipment, refrigerants, pumps, water treatment, and controls.
- UPS equipment, batteries, battery rooms or cabinets, energy-storage systems, and emergency shutdown functions.
- Generators, fuel storage, fuel piping, exhaust, day tanks, and automatic transfer systems.
- Fire detection, alarm, suppression, clean-agent systems, sprinklers, smoke control, and fire department connections.
- Utility interconnections, communications, grounding electrode systems, lightning protection, and monitoring.
This inventory determines which AHJs must review the project and which calculations, listings, and field inspections will be needed.
2. Map every authority having jurisdiction
Do not assume the building department is the only reviewer. Create an AHJ matrix with a named contact, submittal requirements, adopted code editions, amendments, inspection sequence, and open questions for each agency.
Building and structural officials
The building department typically reviews occupancy, construction type, structural design, foundations, anchorage, fire-resistance ratings, egress, accessibility, energy provisions, and the relationship between the module and the site. Ask whether the module is treated as a building, a manufactured or prefabricated assembly, equipment, or a combination of those categories.
Electrical officials
The electrical authority reviews service equipment, distribution, wiring methods, overcurrent protection, grounding and bonding, working clearances, emergency systems, generators, batteries, and utility interfaces. Confirm the adopted edition of NFPA 70, the National Electrical Code (NEC), and all local amendments.
NFPA describes the NEC as “the benchmark for safe electrical design, installation, and inspection to protect people and property from electrical hazards.” NFPA committee material identifies Article 646 as covering modular data centers, including installed IT and support equipment, electrical supply and distribution, wiring and protection, working space, grounding, and HVAC in an equipment enclosure. Article 646 is therefore a specific starting point when its scope matches the installation; it does not replace other applicable NEC requirements or local amendments.

Zoning, planning, and environmental reviewers
Confirm that data-center use is allowed on the parcel and check setbacks, height, lot coverage, screening, exterior equipment, noise, lighting, generator operation, fuel storage, drainage, stormwater, easements, and hazardous-material rules. Transportation or right-of-way authorities may control oversized delivery, crane setup, or utility crossings. Occupational-safety reviewers can impose requirements for energized work, access, lifting, and maintenance even when they do not issue the construction permit.
Utility and interconnection authorities
Utilities may require service studies, protection settings, metering arrangements, transformer locations, disconnects, power-quality information, and witness testing. Obtain their written requirements early; a building permit does not authorize a utility connection.
3. Get written pre-application guidance
Before final design, request a pre-application meeting or written confirmation from each relevant AHJ. Provide a concise site plan, module description, one-line concept, equipment list, proposed occupancy, fire strategy, and a list of questions. Ask the officials to identify:
- Which permits are required for the module, foundations, utility work, generators, fuel, fire systems, and site improvements.
- Which code editions and local amendments apply on the intended permit date.
- Whether the module requires a separate building permit, electrical permit, fire permit, zoning approval, or equipment permits.
- How the jurisdiction classifies the occupancy and whether a certificate of occupancy or equivalent final approval is required.
- Whether concealed factory wiring requires an evaluation report, special inspection, field labeling, or a third-party inspection.
- What documents must be sealed by licensed design professionals and what inspections must occur at the factory or site.
Keep meeting minutes and written responses in the project record. If officials disagree, ask the lead building official to document the controlling interpretation and the sequence for resolving discipline-specific comments.

Local rules may demand fabrication documentation in addition to ordinary plans. New York City, for example, requires certification and site-specific fabrication paperwork for certain modular units containing electrical or fire-suppression assemblies. Treat that as a location-specific example, not a nationwide rule.
5. Assemble a coordinated permit set
Submit one coordinated package in the format and sequence requested by the AHJs. Every drawing should use the same module identification, dimensions, equipment tags, elevations, and revision dates.

6. Address concealed factory electrical work
The 2024 IBC Appendix K contains a specific safeguard for prefabricated construction assemblies. Before approving an assembly with concealed electrical work and issuing an electrical permit, the building official requires an evaluation report describing the electrical system, components, evaluation basis, test results, and other needed data.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAsk the building and electrical officials exactly what they will accept as that report. A useful submission normally identifies every concealed conductor, raceway, termination, overcurrent device, grounding path, enclosure, and connection; explains the standards and tests used; and states what will be inspected at the factory and again after installation. Include photographs, serialized equipment records, quality-control checklists, and procedures for protecting concealed work from field changes.
Plan the inspection boundary before fabrication. If the AHJ cannot inspect the factory, it may require an approved third-party inspection, additional access panels, witnessed tests, or field verification before concealment. Do not close walls, floors, or raceways until the responsible inspector confirms that required observations are complete.
7. Decide whether a third-party evaluation helps
UL 2755 Ed. 3-2026 covers prefabricated modular data-center systems. Its requirements are intended to demonstrate compliance with the NEC and other national codes. A report or certification under that standard can organize evidence for plan review, especially where the module is produced repeatedly.

UL 2755 is not a blanket approval. The standard states that when state or local codes differ from the national codes anticipated by its requirements, determining compliance is the responsibility of the local AHJ. Ask the AHJ whether UL 2755, another Nationally Recognized Testing Laboratory (NRTL) evaluation, or a jurisdiction-specific evaluation path is required or accepted. Confirm the exact scope: a report may cover the module’s factory assembly but not foundations, site wiring, utility interconnection, zoning, fire access, or field-installed equipment.
8. Follow the permit process in the right order
- Freeze the installation definition. Issue the module description, equipment list, site address, utility assumptions, and fire strategy. Record what is factory-installed and what is field-installed.
- Map AHJs and code editions. Obtain contacts, submittal checklists, adopted editions, amendments, inspection requirements, and written interpretations.
- Screen zoning and site feasibility. Resolve use, setbacks, noise, screening, generators, fuel, drainage, access, easements, and delivery constraints before committing to fabrication.
- Hold a coordinated design review. Have civil, structural, architectural, electrical, mechanical, fire-protection, controls, and commissioning leads check interfaces and loads against one another.
- Obtain factory evidence. Collect drawings, installation instructions, labels, evaluation or listing reports, test results, quality records, and the proposed inspection plan.
- Submit applications. File building, electrical, fire, zoning, utility, environmental, and related applications in the sequence required by the jurisdiction. Include the complete permit set and evaluation report where applicable.
- Respond to comments under document control. Maintain a comment log, revise every affected discipline, cloud changes, and resubmit a consistent set. Do not allow procurement changes to bypass plan review.
- Build only within permit limits. Obtain permits before covered work, preserve inspection access, and document approved substitutions and field changes.
- Complete factory and site inspections. Schedule required third-party, factory, underground, structural, electrical, fire, equipment, and final inspections. Provide test records and correction evidence.
- Commission and close out. Execute functional tests for power, cooling, alarms, suppression, emergency shutdowns, controls, and monitoring. Submit as-builts, certificates, test reports, operating instructions, and any documents required for final approval or a certificate of occupancy.
9. Compare design and approval choices before procurement
The choices below change both engineering effort and review complexity. Select the option that fits the site and the AHJ’s written direction, not merely the fastest factory configuration.
| Decision | Option 1 | Option 2 | Approval implications |
|---|---|---|---|
| Placement | Indoor module | Outdoor module | Outdoor exposure, anchorage, weather protection, drainage, fire separation, noise, and emergency access require explicit review. |
| Mobility | Fixed installation | Relocatable unit | Relocatable construction still requires permits for the current site; lifting, anchorage, utility disconnection, and future moves need defined procedures. |
| Electrical wiring | Accessible field wiring | Concealed factory wiring | Concealed work can trigger the IBC Appendix K evaluation-report requirement and special inspection arrangements. |
| Compliance evidence | Project-specific evaluation | UL 2755 Ed. 3-2026 evaluation or certification | Either path must be accepted by the AHJ; neither replaces local building, zoning, fire, utility, or site approvals. |
| Cooling | Air-cooled equipment | Liquid or water-assisted cooling | Review differs for refrigerants, ventilation, piping, drainage, water use, leak detection, and controls. |
| Power resilience | Utility and UPS only | Utility, UPS, and generator plant | Generators add fuel, exhaust, noise, fire, emissions, transfer, testing, and emergency-access requirements. |
10. Inspections, testing, and final approval
Inspection planning should be part of the permit submission, not an afterthought. Identify which observations occur at the factory, during transport and placement, before concealment, after utility connection, and during commissioning.
- Verify foundations, anchors, module alignment, structural connections, weather seals, and penetrations.
- Inspect service equipment, grounding and bonding, conductor terminations, overcurrent protection, working space, labels, and emergency disconnects.
- Witness insulation, continuity, grounding, protective-device, transfer, UPS, battery, and generator tests required by the AHJ or utility.
- Test fire detection, alarm notification, suppression release or abort functions, interfaces, emergency shutdowns, and monitoring.
- Demonstrate HVAC sequences, loss-of-power operation, alarm response, leak detection, temperature and humidity controls, and restart behavior.
- Deliver corrected punch lists, as-built drawings, test certificates, operation and maintenance manuals, training records, and inspection sign-offs.
Operate the facility only after the jurisdiction’s required final approval, certificate of occupancy, or equivalent authorization has been issued.
Common failure modes and how to prevent them
Ordering the module before code confirmation
A factory design may not match local setbacks, seismic criteria, service voltage, fire separation, or inspection rules. Obtain written AHJ direction and freeze the basis of design before fabrication.
Assuming a listing is a permit
A product listing or UL 2755 evaluation addresses the scope of that evidence. It does not approve the parcel, foundations, site wiring, zoning, utility interconnection, or local amendments. Submit the complete project package.

Leaving concealed wiring undocumented
Without circuit schedules, component identifiers, test records, and an inspection plan, officials may require destructive opening, additional evaluation, or replacement. Establish factory quality records and inspection hold points before walls and floors are closed.
Using the wrong code edition
Model-code language is only a starting point. The jurisdiction’s adopted edition and amendments control. Record the edition for each discipline and update calculations when an amendment changes the design.
Designing the module but not the site
Generators, cooling equipment, fuel, drainage, noise, screening, fire access, and utility easements frequently drive approval. Submit civil and land-use information with the equipment design rather than treating it as a later permit.

What cannot be determined without the project location
No universal answer exists for the exact permit forms, fees, review duration, occupancy label, zoning entitlement, inspection agency, or required professional seals. Those items depend on the address, state and local amendments, utility territory, site conditions, and module scope. The reliable method is to obtain written direction from the local building official, electrical and fire officials, planning department, utilities, and any environmental or transportation authorities involved.
