How to find out whether a regeneration scheme affects your home or building

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Start with the council’s latest project page, then match your full address to the current plans, maps and any compulsory purchase order (CPO) schedule. Being close to regeneration does not prove that your property will be acquired. A property can be near a scheme, inside a broad masterplan area, listed on a proposed CPO, or covered by a confirmed order; each status has different consequences.

You cannot establish an individual property’s status from a project name or a news article alone. You need the responsible authority, the exact scheme documents, the map and (where relevant) the plot schedule. The procedure described below is principally for England and Wales. Purchase notices have a narrower England-only application, so identify your nation and authority before relying on a remedy.

What “affected” can mean

“Affected” is not a single legal category. Regeneration projects usually publish a large project boundary, while compulsory acquisition documents identify particular plots and interests. Treat these as separate questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is the address near the project?
  • Is it inside the broad regeneration or masterplan geography?
  • Is the land or an interest in it identified on a proposed CPO map and schedule?
  • Has the CPO been confirmed?
  • Could works on acquired land affect the value or use of nearby land even if that land is not acquired?

Only the scheme’s current documents can answer those questions for a particular building. A project boundary can change during consultation and preparation, and an early announcement may not show the final land requirements.

Confirm the jurisdiction and the responsible authority

Find the authority that controls the project

Use the property’s full address to identify the local planning authority and, if different, the acquiring authority named in the project material. Search that authority’s website for the neighbourhood or project name together with “regeneration”, “masterplan”, “consultation”, “planning application” and “compulsory purchase order”. Start at the authority’s current project page rather than an archived press release.

Local websites are organised differently. For example, the Royal Borough of Kingston upon Thames routes users through its Planning and Building Control page to planning applications, regeneration plans and related information. That is an example of navigation, not evidence that any other council will use the same labels or records.

Check which nation’s rules apply

The main government procedure guide cited here covers England and Wales. The purchase-notices guidance, published 3 October 2024, applies to England. Northern Ireland and Scotland have different statutory systems and should be checked through the relevant authority’s current guidance. Do not assume that an England-only purchase-notice route is available elsewhere in the UK.

In England, Part 9 of the Levelling-up and Regeneration Act 2023 amended the relevant Town and Country Planning Act 1990 provision so that “improvement” includes regeneration for the specified compulsory-purchase power. The cited provision is recorded as in force from 31 January 2024. That background does not mean a particular scheme has a CPO.

Check the latest scheme documents in the right order

1. Record the project page and its update date

Save the URL, page title, update date and contact details shown on the authority’s project page. Download or retain the current consultation booklet, masterplan, phasing plan and any property or land schedule. Keep the date on every file: a map without a date is difficult to compare with a later version.

2. Locate planning and consultation records

Search the authority’s planning portal using the project name, application number and address. Read consultation notices, adopted or draft plans, planning statements, environmental material and phasing information. These documents may show roads, public-realm works, new buildings, temporary access or land assembly that are not obvious from a headline map.

3. Compare the exact address with every relevant map

Use the complete address, postcode and, where available, the building or land boundary. A site can contain several flats, commercial units, leasehold interests or access rights. Check whether the line on the plan crosses the building footprint, garden, yard, access strip, parking area or only an adjoining parcel.

Do not rely on colour shading at screen resolution. Download the original plan, read its legend, scale, north arrow, revision date and drawing number, and compare identifiable features such as roads, rivers, walls and neighbouring plots. If the plan is unclear, ask the authority to confirm the relevant plot reference in writing.

4. Search for a CPO map and schedule

If compulsory acquisition is proposed, look for an order map, plot schedule, statement of reasons, notices and a draft or made order. The map and schedule must be read together. The schedule’s plot references correspond to numbered plots on the map and describe the land and interests involved. This is explained in the government’s Guidance on the compulsory purchase process.

Search the schedule for the property address, title or plot number, and then read the description of interests. It may identify owners, leaseholders, tenants, occupiers and people with rights over the land. A building can therefore be relevant even when the person checking is not the freeholder.

5. Check whether the order is only proposed or has been confirmed

Look for the order document, confirmation decision, modification notice and the authority’s current status page. Under the procedure described in the government guide, a CPO has no effect until it is confirmed by the confirming authority. A proposed order, consultation notice or draft map does not have the same legal effect as a confirmed order.

Read the actual decision record rather than relying on a newspaper report or an early project map. A confirmation can include modifications, and the documents may identify the final plots and interests differently from consultation material.

6. Contact the authority when the boundary is ambiguous

Send a concise written enquiry containing the full address, project name, map title and revision, and any plot reference. Ask:

  • Is the building, curtilage or access land inside the current regeneration boundary?
  • Is any part identified on a proposed or confirmed CPO map?
  • Which interest is listed: freehold, leasehold, tenancy, occupancy or a right over land?
  • What is the current procedural stage and where is the latest decision or notice?
  • Who should receive correspondence for this address?

Keep the reply and attachments with your saved plans. An answer given by telephone is useful for orientation, but a dated written confirmation is easier to rely on when documents change.

How to read the map and schedule together

Map evidence

The map shows the geographic extent of numbered plots. Check the drawing’s title, scale, revision, legend and any inset plans. A line can follow a road edge, property boundary or centreline; the written description and schedule determine what the authority says is included.

Schedule evidence

The schedule links each plot number to a description of land and the interests affected. Read every column, including notes about owners, lessees, tenants, occupiers, mortgages or rights. If a title contains several interests, the schedule may not name every person in the way the building’s everyday address does.

Interests outside the acquisition line

The guidance recognises that a person may be relevant even where their land is not being acquired. If works on acquired land reduce the value of other land, the owner or another qualifying interest holder may have a compensation issue. Whether a claim exists is fact-specific; the schedule, the proposed works and the applicable statutory rules must be considered together.

Use this status table to classify what you find

Status Documents to check What it establishes Practical response
Near a regeneration scheme Current project page and boundary plan Proximity only; it does not establish acquisition. Check the broader plan and planning records before drawing conclusions.
Inside a broad regeneration or masterplan area Current plan, consultation material and planning documents The address lies within the project geography shown; this alone does not prove a CPO. Look for plot-level land assembly or a separate order.
On a proposed CPO map or schedule Order map, plot reference, schedule, statement of reasons and notices The land or a relevant interest is included in proposed order documents. Identify the listed interest, procedural stage and any objection deadline.
CPO confirmed Confirmation decision and final order documents The order has reached confirmation; the guide says it has no effect before confirmation. Read the final order, notices and compensation information and obtain advice where necessary.
Potentially affected without acquisition Schedule, works information and evidence of impact Works may affect another property or its value even though that land is not acquired. Record the impact and seek advice on whether a fact-specific claim is available.

What to do if a formal notice arrives

Read the document before the covering email

A notice should identify the authority, project, legal power, land or interest concerned, response method and deadline. Compare its plot number and plan with the latest documents you saved. Do not assume that a general consultation letter is the same as a CPO notice.

Information requests

The procedure guide describes statutory information notices and advises recipients who are unsure of their meaning to contact the acquiring authority or the organisation that sent them. An information request of the type described must allow at least 14 days for a response. The particular notice controls: check its wording, delivery date and response instructions.

Objections to a CPO

A separate CPO objection notice must state how to object and the deadline. The cited guidance says that period must be at least 21 days from the notice date. Send an objection exactly as instructed and retain proof of delivery. A missed date can affect the available procedure, so ask the sender promptly if the notice is incomplete or hard to understand.

Keep a document and contact log

Use a simple record containing the date received, sender, document title, plot number, deadline, action taken and proof of submission. Store the original envelope or electronic header where possible. This is especially important for a building with several owners, tenants or managing agents, because each person may receive a different notice.

If your home or building appears on the order

Identify exactly which interest is listed

Check whether the schedule concerns the freehold, a lease, a tenancy, occupation, a right of way, drainage, access or another interest. The person who occupies a unit may not be the person named as owner, and a commercial building may have several leases. Notify co-owners, lenders, tenants or other affected interest holders where appropriate.

Separate acquisition from construction impacts

A regeneration project can involve both land acquisition and works on neighbouring land. Review phasing, access, temporary works, service diversions, demolition areas and construction routes shown in the planning material. If your land is outside the order but the works may affect access, use or value, keep dated evidence of the existing condition and the effect described in the documents.

Obtain specialist advice at the right trigger

Consider a solicitor experienced in compulsory purchase or a chartered surveyor with relevant valuation experience when your property or interest appears on an order map or schedule, when a formal notice arrives, or when the proposed works may affect land outside the acquisition line. The government procedure material covers objections, acquisition and compensation issues, but it cannot assess your title, lease or valuation.

Purchase notices: a limited England remedy

The Purchase notices guidance describes a process by which owners may require a local authority to acquire land in defined circumstances connected with specified planning decisions or an order. It applies to England and does not create a general right for every owner near regeneration to force a sale.

The guidance says a purchase notice does not automatically require the council to buy the land unless an acceptance or confirmation condition is met. Eligibility, statutory circumstances and deadlines must therefore be checked against the actual decision and the current guidance. Do not file one merely because a project is nearby or because a consultation map is inconvenient.

Common mistakes that produce the wrong answer

  • Using proximity as proof: a nearby site may share a project name without including your plot.
  • Reading only the shaded boundary: the schedule and plot references can identify interests that are not obvious on the map.
  • Relying on an old announcement: consultation, phasing and land requirements can develop.
  • Treating a proposed CPO as confirmed: the guide states that a CPO has no effect before confirmation.
  • Checking only the freehold: leases, tenancies, occupation and rights over land may also be listed.
  • Ignoring a notice deadline: information and objection periods are procedural and must be checked on the particular notice.
  • Assuming a purchase notice is automatic: the England guidance limits the process to defined statutory circumstances.
  • Keeping no copies: online maps and pages can be replaced; save dated documents and correspondence.

A practical evidence checklist

Before asking the authority or an adviser to confirm your position, assemble:

  • Full address, postcode and a marked site plan.
  • Property title, lease, tenancy or other documents showing your interest.
  • Project-page URL, update date and contact details.
  • Latest masterplan, consultation plan, planning application and phasing documents.
  • CPO map, plot schedule, statement of reasons and every notice received.
  • Photographs or records of access, boundaries and existing conditions where works may affect nearby land.
  • A chronology of searches, calls, emails, deadlines and submissions.

With that pack, ask a precise question: whether the address or a named interest is inside the current boundary, proposed order or confirmed order, and which document establishes the answer.

When the public record is inconclusive

Escalate in stages. First, ask the project contact to identify the current map and plot reference. Next, ask the planning or legal contact named in the notice to confirm the procedural stage. If ownership, valuation, objection rights or compensation are at stake, obtain independent specialist advice before signing an agreement or allowing a deadline to pass.

There is no reliable address-only shortcut. The answer depends on the nation, authority, scheme version, map, schedule, legal stage and the interest held in the property. Treat each as a separate item to verify.
