Start by getting the capacity problem defined in writing, then have a licensed construction-insurance broker test other admitted carriers, a licensed surplus-lines (E&S) route, or a state-specific residual market for the affected line. The right solution depends on your state, trade, project, limits, term, loss history and underwriting details; no public appetite page guarantees that an insurer will quote your risk.
What “limited capacity” can mean
Capacity is not one universal refusal. Your incumbent may be unable to provide the requested limit, unwilling to insure a particular project value, outside its appetite for a construction type or location, restricted on a peril, or unable to offer the requested policy term or endorsement. It may still be willing to retain part of the risk. Ask your agent or broker to identify the precise constraint before shopping.

- Policy line: The problem may affect general liability, builders risk, workers’ compensation, commercial auto, umbrella, pollution, professional liability, property, equipment, installation, surety, cyber or management liability rather than every policy you buy.
- Limit or attachment: A carrier might offer a primary layer but not the full limit, or might require another insurer above a particular attachment point.
- Project or geography: Construction type, location, flood or wind exposure, wildfire, coastal conditions, vacancy, renovation scope and public-protection factors can change eligibility.
- Term or endorsement: A carrier may not extend a project through completion, provide delay-in-opening coverage, or add a contract-required endorsement.
- Underwriting information: Incomplete values, loss runs, schedules, subcontractor controls or risk-management details can look like a capacity issue when the market actually needs a better submission.
Request a written explanation of what the incumbent can still cover, what it cannot, the renewal or cancellation dates, and any continuity-sensitive coverage. Ask whether it can participate for a portion of the limit or whether another insurer could sit beside it. Any proposed structure remains subject to underwriting and policy wording.
Where to look first
Use your licensed retail broker as the coordinator
Your retail broker is normally the practical starting point. Give the broker the exact line, limit, project, location, construction type, term and contract requirements. Ask the broker to approach additional admitted carriers with a genuine appetite for that class of work. If the admitted market cannot accommodate the risk, ask whether a licensed surplus-lines broker, wholesale broker or managing general agent (MGA) should be involved.

Surplus-lines brokers must be licensed. State law controls who may place the coverage, which searches or disclosures are required, and what taxes or fees apply. A useful question is: Are you authorized to place surplus-lines coverage in my state, and will you explain the state-specific search, disclosure, tax and fee requirements?
Do not assume that a rule from one state applies nationally. For example, North Carolina says a broker may place a risk with a surplus-lines carrier only after a “diligent effort” to find an admitted carrier. That is North Carolina guidance, not a nationwide three-declinations rule.
Ask about another admitted carrier
An admitted insurer may have room for your trade, state, project value or limit even when the incumbent does not. Compare eligibility, forms, exclusions, deductibles, schedule, term and continuity—not merely the premium. A new insurer may impose different completed-operations terms, aggregates, subcontractor conditions or endorsements. Have the broker identify every material wording change before you cancel or non-renew existing coverage.
Consider surplus-lines or E&S placement when the admitted market cannot fit
Excess-and-surplus-lines insurance can be more flexible for unusual, high-value or hard-to-place construction risks. The flexibility comes with responsibilities: review the actual form, exclusions, sublimits, conditions, insurer eligibility, total cost and state disclosures. Surplus-lines policies do not receive state guaranty-fund protection if the insurer becomes insolvent. The National Association of Insurance Commissioners (NAIC) states: “However, due to the unique and higher risk exposures written in the surplus lines industry, guaranty fund coverage is not available.”
Recommended Free Tools
E&S is a market route, not a guarantee of broader coverage. A non-admitted insurer can still decline the submission, limit a peril, exclude a project phase or require a higher retention. Ask who the insurer is, whether it is eligible in your state, who is licensed to place the policy, and what taxes, stamping fees or administrative charges will be added.
Ask whether a shared or layered project placement is feasible
If one carrier cannot supply the full project limit, the broker can ask about a shared or layered structure. Builders-risk placements may be available in primary, full-limit, quota-share, buffer or excess positions, depending on underwriting. In a layered program, read each layer’s attachment point, limit, aggregate, exclusions, follow-form language, notice requirements and claims-coordination provisions. A gap between layers or a narrower excess form can leave less protection than the headline limit suggests.

Check for a state residual or assigned-risk market only for the needed line
Residual markets are jurisdiction- and line-specific. The District of Columbia regulator describes residual arrangements for certain workers’ compensation, commercial auto and commercial property risks. That does not establish a nationwide pool for construction liability or builders risk. Ask your broker or state insurance department whether a program exists for your exact line, what voluntary-market effort is required, how to apply, what limits are available and how the price is determined.
Match the search to the insurance line
Construction insurance is a collection of lines, not one interchangeable policy. A capacity problem in one line should be described precisely so the broker does not replace coverage you still need or overlook a contract requirement.

| General liability | What operations, completed-operations period, per-occurrence and aggregate limits, additional-insured wording and subcontractor requirements apply? |
| Commercial auto | Which vehicles, drivers, territories, hired/non-owned exposures and contractual limits must be scheduled? |
| Workers’ compensation | Which states, classifications, payroll estimates and experience information are involved, and is an assigned-risk option available locally? |
| Umbrella or excess liability | What underlying policies and attachment points are required, and does the excess follow form or add exclusions? |
| Pollution or professional liability | Are design, environmental, mold, asbestos, remediation or consulting duties included, and are claims-made dates preserved? |
| Builders risk | What is the completed value, construction type, location, schedule, covered property, deductible and delay-in-opening requirement? |
| Installation or contractor equipment | Which materials, tools, mobile equipment and transit or installation exposures need scheduled limits? |
| Project wrap-up | Who is enrolled, which parties are excluded, how are completed operations handled and when does the wrap-up end? |
| Surety bonds | What contract, financial statements, work-in-progress schedule and indemnity requirements apply? |
| Cyber or management liability | What data, payment, fiduciary, employment and corporate-management exposures are present? |
These categories are examples of how construction programs are commonly separated; availability and suitability must be established for your own facts.
Builders risk: options when the project limit is the problem
For a large or unusual property value, ask whether the risk can be written as an individual project or under a master program, and whether a shared or layered placement is available. Chubb describes builders-risk capacity in primary, full-limit, quota-share, buffer and excess positions, subject to underwriting. Those positions are structures to discuss—not promises that a particular project will qualify.
One published E&S builders-risk offering describes course-of-construction risks valued above $10 million, with eligibility tied to construction type and value. Its access instructions identify Illinois, Kentucky, Montana and South Dakota as states where access is limited to wholesale brokers. Verify the current eligibility, access route and state rules rather than treating a published product page as a bindable offer.

For a project-specific submission, prepare the information under the next heading before markets are approached. Large projects often lose time when values or the completion date change after quoting.

Core project information
- Project description, owner, general contractor, major subcontractors and contract structure.
- Construction type, occupancy, renovation or ground-up scope, and percentage completed.
- Every location, including temporary storage, off-site fabrication and transit exposures where relevant.
- Statement of values separating existing structures, new work, soft costs, materials and other insured property.
- Requested limits, deductibles, sublimits, endorsements, lender requirements and certificate wording.
- Start date, estimated completion date, testing or commissioning period and requested policy extensions.
Delay-in-opening information
If you need delay-in-opening coverage, provide a detailed soft-cost breakdown, the project pro forma and the indemnity period for rental income or business income. A headline project value does not tell an underwriter how much financial loss a delayed opening could create.
Risk controls and operating data
- Recent loss runs and a short explanation of significant claims, reserves and corrective actions.
- Fire protection, security, hot-work controls, water-leak detection, site inspections and emergency plans.
- Flood, wind, wildfire and other natural-peril mitigation, including elevation, drainage, pumps, backup power and storm procedures where applicable.
- Payroll, revenue, subcontractor costs, vehicle schedules, driver information and project lists for the relevant liability lines.
- Contract excerpts showing required limits, additional-insured status, waiver language, primary/noncontributory wording and completed-operations obligations.
Underwriting requirements vary by carrier and line. Ask the broker for the current application and a list of outstanding items instead of assuming that one universal checklist applies.
Compare quotes by total protection, not the headline limit
Put every proposal in a side-by-side schedule. Record the insurer’s admitted or non-admitted status and eligibility in the project state; the broker and state regulator should explain the applicable compliance steps.
| Comparison item | What to verify |
|---|---|
| Structure | Primary, full limit, quota share, buffer or excess position; attachment points and whether another policy must respond first. |
| Limits and retention | Per occurrence, aggregate, project aggregate, sublimits, deductibles and self-insured retentions. |
| Covered causes of loss | Named or broad causes of loss, flood, wind, earth movement, theft, water damage, testing and commissioning treatment. |
| Exclusions and conditions | Defective work, faulty workmanship, pollution, professional services, vacancy, protective safeguards, security and subcontractor warranties. |
| Term and extensions | Expiration, completion or occupancy triggers, reporting periods, maintenance extensions and options if the schedule slips. |
| Business-income or delay cover | Covered soft costs, waiting period, indemnity period, sublimits, documentation and calculation method. |
| Continuity | Completed-operations treatment, retroactive dates for claims-made lines, prior-acts protection and any gap created by replacement. |
| Total cost | Premium plus applicable surplus-lines taxes, stamping charges, broker fees and administrative costs. |
| Claims and coordination | Notice obligations, choice of defense counsel, claims reporting contacts and coordination among layers or wrap-up participants. |
For E&S, obtain the written disclosures and confirm that the absence of guaranty-fund protection is understood. A lower premium can reflect a narrower form, larger retention, excluded peril or shorter term rather than a better deal.

Market conditions are useful context, not a promise of capacity
The NAIC reported $131 billion in U.S. surplus-lines direct premiums written in 2024, up 12.2% from the prior year and equal to 12% of the U.S. property-and-casualty market’s direct premiums. Those figures show the scale of the market; they do not indicate that an insurer will accept your trade or project.
Gallagher’s midyear 2026 market update reported a downward rating trend and, for some project placements it observed, pricing around 10% lower than the same period in 2025. That is broker commentary about the markets in its survey, not a quote or forecast for every contractor. Your loss history, location, construction type, controls and requested terms can produce a very different result.
A practical sequence for replacing or supplementing capacity
- Document the constraint. Ask the incumbent agent or insurer what line, limit, location, project, term or endorsement is restricted and what portion, if any, remains available.
- Protect the timeline. Note renewal, cancellation, lender, contract and mobilization dates. Do not allow an existing policy to lapse while an alternative is still only being discussed.
- Give one complete submission to the retail broker. Include values, schedules, loss information, contracts and risk controls, then respond quickly to underwriting questions.
- Test admitted markets first where appropriate. Ask which carriers were approached, what appetite each has and why a specialist market may be necessary.
- Escalate through licensed E&S channels if needed. Confirm the broker’s authority, insurer eligibility, state diligence, disclosures, taxes and fees.
- Evaluate shared or layered capacity. Map each attachment, limit, exclusion and follow-form term before assuming layers create seamless protection.
- Check a residual program only for the relevant line. Confirm that your state operates one and that your risk meets its eligibility rules.
- Review the final forms. Compare endorsements and continuity provisions with the expiring policy; bind only after contract parties, lenders and internal decision-makers approve the actual wording.
Common failure points and how to correct them
Shopping only the incumbent’s limit
Problem: The broker hears “no capacity” and immediately seeks a replacement without discovering that the incumbent can retain a layer or that only one endorsement is restricted.
Correction: Separate the unavailable portion from the coverage that can remain, then model the total program.
Assuming E&S means “anything is covered”
Problem: A customized form is accepted without checking exclusions, sublimits, insolvency protection, taxes or eligibility.
Correction: Read the specimen wording and disclosures, identify every excluded peril and obtain state-specific advice from the licensed placing broker.
Using a national residual-market assumption
Problem: The buyer expects an assigned-risk builders-risk or liability pool in every state.
Correction: Ask the state insurance department about the exact line. Residual arrangements vary by jurisdiction and may cover workers’ compensation, auto or property but not the construction need that triggered the search.

Submitting incomplete values
Problem: The project is quoted on an outdated budget, missing soft costs or an unclear completion date.
Correction: Reconcile the statement of values with the contract, schedule and pro forma before the broker markets the risk.
Comparing premium while ignoring continuity
Problem: A cheaper quote creates a gap in completed operations, prior acts, reporting periods or project extensions.
Correction: Have the broker provide a written difference-in-conditions and continuity explanation before replacing the incumbent.
Waiting until the renewal deadline
Problem: E&S submissions, layered programs and lender approvals take longer than a routine renewal.
Correction: Start as soon as a capacity warning appears, preserve the incumbent’s dates and tell every market the actual deadline.

- Can the incumbent retain a portion, and what would the resulting attachment and aggregate be?
- Which admitted carriers have been considered for this class, state and project?
- If E&S is proposed, who is the licensed surplus-lines broker, which insurer is eligible, and what diligence, disclosure, tax and fee rules apply here?
- Does the proposal preserve completed operations, prior acts, reporting periods and required additional-insured wording?

What you can reasonably expect
A broker can identify routes and negotiate terms, but cannot guarantee that a carrier will quote, bind or renew a particular risk. Public product descriptions are not bindable offers. Final availability depends on state law, insurer eligibility, trade, project details, limits, term, loss experience, risk controls and underwriting approval. Keep those variables explicit in every conversation so a capacity problem becomes a defined placement decision rather than a last-minute search for an unspecified policy.
