Secure the site, preserve a dated record, assemble the contract file, and obtain local legal and regulatory advice before ending the first contract. Then define the unfinished scope and compare licensed contractors on the same written brief, including permits, schedule, payment milestones, change orders, and responsibility for existing work.
A contractor who stops showing up creates two problems at once: the building may be exposed to damage or safety risks, and the contract may still control what you can do next. The safest route is a documented handoff, not an informal replacement. Local law and your contract determine whether you must give notice, allow a cure period, use mediation, preserve warranty rights, or wait before hiring someone else.

Stabilize the site before discussing replacement
Make people and the property safe
Restrict access to unfinished, unstable, wet, energized, or otherwise hazardous areas. Arrange only the emergency work needed to prevent injury or further property damage, and keep invoices and photographs for every intervention. The Queensland Building and Construction Commission (QBCC) says the site should be secured and places responsibility for site safety on the owner. That practical duty exists even while a contract dispute is unresolved.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteDo not remove work, materials, temporary supports, or construction records merely to make the site look finished. If an emergency repair must alter evidence, photograph and describe the condition first, note who performed the work, and retain the related invoices.

Create a dated condition record
Photograph every room, elevation, roof area, service location, stored material, exposed opening, and incomplete installation. Capture wider views and close-ups, and preserve the original files with their dates. Add a written log recording the last day anyone worked, who was present, what was completed, weather or water events, safety concerns, and every contact attempt. A short video walkthrough can show sequencing and access conditions that still images miss.
- Record unfinished work and visible defects without declaring a hidden structural or technical cause.
- Note materials delivered, materials paid for but absent, and equipment or keys left on site.
- Save texts, emails, voicemail files, site diaries, photographs, and delivery records in their original form.
Build a complete project file
Make one electronic folder and one backed-up copy of the entire project. The QBCC identifies the following documents as important in a non-completion matter:
| Project record | What it establishes |
|---|---|
| Signed contract and standard terms | Scope, price, payment obligations, default, notice, termination, dispute, and warranty provisions |
| Specifications and approved plans | The work and materials the original contractor agreed to provide |
| Variations or change orders | Later approvals, revised prices, substitutions, and schedule changes |
| Building, council, and other approvals | Permits and conditions that may affect completion or inspection |
| Payment evidence | Deposits, progress payments, invoices, credits, refunds, and the amount still disputed |
| Communications | Promises, delay explanations, requests to correct work, notices, and attempted resolutions |
Reconcile payments against work actually completed. Separate money paid for completed work, unfinished work, stored materials, disputed extras, and amounts that may be owed under the contract. Keep a dated ledger rather than relying on a bank statement alone. Do not discard original messages or invoices; export them and preserve the originals.
Review the contract before ending it
Identify the exact breach and required process
Read the default, notice, cure, suspension, termination, payment, and dispute-resolution clauses together. A missed deadline may be a breach, but a delay can also be excused by an approved variation, an unavailable inspection, a change in scope, severe conditions, or another contract provision. Identify the specific obligation that was not performed and the evidence supporting it.
Check how notice must be delivered, who must receive it, what facts it must contain, and whether the contractor has a contractual opportunity to cure. Do not assume that silence, a disagreement, or a particular number of idle days automatically permits cancellation everywhere.
Understand cure periods and termination wording
Utah’s Division of Professional Licensing model contract, for example, calls for written notice and a 14-day cure period for specified breaches. It also says that a termination notice or agreement should state the effective date, account for payments and work, and identify payments due. That is an example of one state’s model guidance, not a nationwide rule.

The QBCC says valid termination is required for its Queensland non-completion claim in relevant circumstances and warns that improper termination can create major legal and financial problems. It strongly recommends formal legal advice before taking steps to terminate. Have a construction lawyer or other qualified local adviser review the contract, notices, payment position, potential claims, and the effect on warranty or completion rights.

Sometimes an owner can arrange emergency protection or limited investigative work before termination; sometimes doing so could be treated as interference with the original contractor’s rights or an owner breach. The answer depends on the contract, the nature of the work, the location, and whether the first contractor remains entitled to return. Obtain written local advice before allowing a replacement to demolish, cover, alter, or complete disputed work. If immediate safety work cannot wait, limit it to what is reasonably necessary and document why.
Florida law illustrates why jurisdiction matters: its statute says a project may be presumed abandoned after 90 days in specified circumstances, including specified contractor termination or failure to perform without just cause. That presumption is Florida statutory language, not a national 90-day termination standard.
Define what remains before requesting prices
Classify the work
Prepare a plain-language schedule divided into:
- Completed and accepted work.
- Completed work requiring inspection, testing, or correction.
- Clearly incomplete work.
- Visible defects and damage.
- Materials delivered, stored, or missing.
- Outstanding permits, inspections, certificates, and close-out documents.
- Temporary measures needed to make the site safe and weather-tight.
Do not label hidden conditions, code violations, or structural causes without qualified support. A replacement contractor may need to open up assemblies or obtain an independent inspection before giving a reliable price.
Obtain an independent completion or correction estimate
Ask a qualified professional or prospective replacement contractor to inspect the existing work and identify assumptions. Request separate figures for finishing agreed scope, correcting defective work, repairing damage caused by delay, and investigating uncertain conditions. Oregon’s Construction Contractors Board says estimates can provide a starting point for settlement discussions when the original contractor has been replaced or work still needs correction.
Ask each estimator to state what was inaccessible, what testing was not performed, and what could change the price. Keep the reports and photographs; they may be needed in mediation, a licensing complaint, an insurance claim, or court.

Find and screen replacement contractors
Verify licensing or registration
Use the licensing or registration registry for the state, province, territory, or municipality where the work is located. Confirm that the credential is active, belongs to the contracting business named in the proposal, and covers the relevant trade and project type. Record the lookup date and any restrictions, bond information, disciplinary history, or required responsible individual shown by the regulator.
A license check is a threshold check, not proof that a contractor is the best fit. Also verify insurance with the issuing broker or carrier where appropriate, and ask who will supervise subcontractors and arrange inspections.
Check comparable experience
Ask for examples of completed projects similar in type, age, complexity, and condition. A contractor experienced in new construction may not be equipped to diagnose partially completed or defective work. Connecticut Department of Consumer Protection Commissioner Bryan T. Cafferelli put the point plainly in a May 7, 2025 release: “Before you hire, ask for trusted recommendations from people you know for contractors who have completed similar work to the project you are hiring for. In other words, don’t hire someone to remodel your bathroom who specializes in fence repairs.”
Recommended Free Tools
Contact references with specific questions: Did the contractor inherit unfinished work? Were changes priced in writing? Did the contractor meet inspection and payment milestones? How were defects and concealed conditions handled?
Compare at least three proposals on one scope
Connecticut consumer guidance recommends trusted recommendations, examples of similar work, and at least three quotes. Those are useful screening practices, not a legal requirement in every location. Give every bidder the same drawings, specifications, photographs, inspection findings, and remaining-work schedule. Compare the proposals on the following axes:
| Comparison point | Questions to ask |
|---|---|
| Credential and relevant scope | Is the license or registration active, and does it cover this work? |
| Comparable experience | Has the contractor completed similar projects or inherited stalled work? |
| Existing-work inspection | What will be inspected, tested, opened up, protected, or assumed? |
| Included work and exclusions | Which rooms, trades, materials, disposal, testing, and repairs are included? |
| Schedule and dependencies | What is the start date, sequence, duration, and dependency on permits, design, or suppliers? |
| Permits and inspections | Who applies, pays, schedules, attends, and obtains final approvals? |
| Payment milestones | Are payments tied to verifiable progress rather than calendar dates alone? |
| Change-order process | How are unknown conditions, price changes, and owner decisions approved? |
| Warranty and protection | What warranty is offered, and who protects completed work and existing materials? |
The lowest total is not necessarily the lowest completion cost. A proposal that omits testing, permit work, disposal, correction of existing defects, or protection of completed areas can become more expensive after work starts.

Put the new agreement in writing
Describe the handoff scope precisely
Attach the remaining-work schedule, plans, specifications, inspection reports, photographs, and a list of known exclusions. State whether the new contractor is responsible for correcting prior work, only completing unfinished work, or both. Identify assumptions about concealed conditions and set a process for pricing work that proves different after opening up.

Set payment and change controls
Use progress-linked payments that correspond to observable work. Require written approval before a change begins, stating the added or deducted price, schedule effect, materials, and any effect on permits or warranty. Keep a running payment ledger and obtain invoices, lien releases, or equivalent protections where local law and professional advice call for them.
Make clear who owns or safeguards materials already paid for, who removes defective work, and who pays for reinspection. Name the person authorized to approve changes so site conversations do not become disputed commitments.

Confirm permit status with the building department
Ask the local building official whether the existing permit is active, whether the original contractor is still listed, and whether an amendment, closure, or reissue is required. Connecticut Department of Consumer Protection guidance tells homeowners to verify required permits with their local building official. The reviewed agencies do not establish a universal rule for transferring permits, so obtain the answer for this property before work resumes.

Check for unpaid subcontractors and suppliers
Ask the original contractor for a current subcontractor and supplier list, invoices, and payment status. Check the local lien-notice and filing rules with a construction lawyer or title professional; deadlines and protections differ by jurisdiction. Do not release disputed funds or sign a broad settlement without understanding whether it affects lien, bond, warranty, or completion claims.
Make the handoff operational
Hold a documented site meeting
Before mobilization, walk the site with the replacement contractor and record existing conditions, access routes, utilities, stored materials, temporary protection, and areas the contractor will not disturb. Give the contractor an indexed project file rather than an unorganized message archive. Confirm who holds keys, who controls alarms, and how workers and subcontractors sign in.
Run the project by a short weekly cycle
- Update the remaining-work schedule and identify the next inspection or decision.
- Photograph progress and record deliveries, labor, weather interruptions, and discovered conditions.
- Approve or reject change orders in writing before affected work proceeds.
- Match each payment request to completed milestones, invoices, and required releases.
- Escalate missed milestones promptly under the new contract’s notice procedure.
This creates a second, cleaner record and makes it easier to distinguish inherited defects from new workmanship issues.
Use the right complaint or dispute route
What a regulator may do
A licensing or consumer agency may investigate, facilitate mediation, record a complaint, or explain available bond and court routes. It may not decide every private contract dispute or guarantee repayment. California’s Contractors State License Board lists abandonment, poor workmanship, unpaid subcontractors or suppliers, and code violations among matters within its complaint jurisdiction. It says it may attempt mediation, cannot guarantee restitution, and describes possible court and bond routes subject to eligibility criteria and deadlines.
Oregon’s Construction Contractors Board describes mediation as a process that helps parties negotiate a resolution, not a mechanism that forces payment. It also notes that completion estimates can help frame settlement discussions.
Check deadlines immediately
Ask the relevant licensing authority, consumer agency, building department, warranty provider, insurer, and legal adviser about complaint, mediation, bond, warranty, lien, and court deadlines. Filing windows and remedies vary. Keep proof of filing and every response, and continue meeting your own notice and mitigation duties while a complaint is pending.
What complaint figures do—and do not—show
Connecticut Department of Consumer Protection said in 2025 that it receives about 1,000 home-improvement complaints annually on average, including failure to complete work and poor workmanship. Its May 7, 2025 release referred to 265 complaints about unregistered contractors in the prior year and 60 complaints in 2024 involving consumers who paid funds but had no work performed. These are Connecticut agency figures, not a national prevalence rate.

A practical decision checklist
- The site is secured and immediate hazards are addressed.
- Dated photographs, videos, logs, messages, invoices, and delivery records are preserved.
- The signed contract, changes, plans, approvals, payments, and communications are organized.
- Completed, incomplete, defective, stored, and safety-critical work is listed separately.
- The contract’s notice, cure, termination, payment, and dispute clauses have been reviewed.
- Local legal advice has addressed termination, warranties, liens, permits, and potential claims.
- The local licensing and building authorities have supplied current process and deadline information.
- Replacement bids use the same scope and disclose assumptions, exclusions, schedule, permits, payments, changes, and warranty.
- The new contract assigns responsibility for existing work, materials, inspections, records, and site protection.
The project can move again when the next contractor receives a safe site, reliable records, a defined scope, and a contract that makes responsibility visible. Rushing past those steps can turn a stalled project into two overlapping disputes; documenting them gives you a defensible path to completion.
