Evaluate a new condo tower as three purchases at once: a private unit, a share of a common building, and a contract that controls future costs and remedies. Sales brochures and model suites show the intended result, but the enforceable deal is in the purchase agreement, disclosure or offering documents, specifications, budget, governing documents and warranty materials. Compare those documents with the construction stage and the unit’s actual condition before you commit.
Rules are jurisdiction-specific. Disclosure requirements, deposit protection, warranty coverage, cancellation periods, occupancy extensions and delay remedies differ between countries, states and provinces. The Ontario, Canadian, New York and Victorian guidance mentioned below illustrates the questions to ask; it is not one universal rulebook. Have a lawyer who practises where the tower is located explain the documents before you sign.

Start with the decision: pre-construction or completed?
Your due-diligence path depends on whether you are buying an idea that will be built or a building you can inspect. A nearly completed tower still needs document and financial review, but physical evidence can replace some assumptions.

| Issue | Pre-construction purchase | Completed or nearly completed purchase |
|---|---|---|
| What you can verify | Contractual promises, approved plans, specifications, budget assumptions and construction progress | Those documents plus accessible measurements, finishes, equipment operation and visible defects |
| Main uncertainty | Changes to design, materials, amenities, schedule, financing and eventual operating costs | Hidden conditions, incomplete common elements, unresolved defects and whether the first budget reflects steady-state costs |
| Timing question | What is the firm completion or occupancy date, what extensions are allowed, and what happens if the project is delayed or cancelled? | What work remains, when legal closing can occur, and whether outstanding work will be completed under a written commitment? |
| Inspection opportunity | Usually limited to plans, model information and any permitted site visit | Walkthrough and independent inspection are practical, subject to the developer’s access rules |
Do not make a moving, lease-expiry or financing commitment as though an estimated date were guaranteed. Identify the legal date, extension conditions and local remedies first.

Collect the documents that define the deal
Request the complete, current package for the project and keep an indexed copy. Ask the selling agent or developer to identify every addendum incorporated into the agreement; an important promise that exists only in a conversation or brochure is difficult to enforce.
Core documents
- Purchase agreement and all addenda: Check the parties, unit and parking or storage identifiers, deposit schedule, closing and occupancy dates, extension rights, default provisions, cancellation rights and adjustment clauses.
- Disclosure statement, offering plan or equivalent: This describes the project, ownership structure, restrictions, common elements and sponsor or developer obligations. In New York, the Attorney General explains that the offering plan—not a rendering or verbal sales promise—governs the sponsor’s obligations.
- Plans, specifications and finish schedules: Compare room dimensions, unit boundaries, floor area, windows, doors, appliances, cabinetry, plumbing fixtures, heating and cooling equipment, finishes, ceiling heights and included features.
- Declaration, bylaws, rules and easements: Look for pet, rental, short-term-let, renovation, smoking, parking, storage, alteration and use restrictions. Confirm voting rights and how common expenses are allocated.
- Budget and financial disclosures: Review projected monthly fees, utilities, staffing, insurance, management, security, cleaning, landscaping, snow or waste services, amenity operations and reserve contributions. Identify costs temporarily paid by the developer.
- Warranty information: Obtain the administrator’s name, covered components, exclusions, claim deadlines, inspection requirements, deposit protections and the procedure for escalating a rejected claim.
- Construction and occupancy information: Ask for the current construction stage, remaining work, approvals or inspections still required, anticipated occupancy sequence and conditions that permit an extension.
Ontario-specific examples
Ontario buyers may encounter the Agreement of Purchase and Sale, Information for Buyers of Pre-Construction Condominium Homes, Condominium Home Addendum, Tarion Warranty Information Sheet, disclosure statement and Ontario’s Residential Condominium Buyers’ Guide. The Condominium Authority of Ontario recommends reviewing these with a lawyer and points buyers to the builder registry maintained by the Home Construction Regulatory Authority. That package should not be assumed to apply in another province, state or country.
Make a promise traceable
Mark every material sales representation in the contract or an attached specification. If a salesperson promises a particular appliance, view, amenity, ceiling height, parking right or completion feature, request a written revision that identifies the document and section where it appears. Compare the final version against earlier versions so that deleted or qualified language is visible.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteRead the contract for change, delay and cancellation risk
A new tower can change or run late even when the original marketing looked definite. Read the clauses that allow substitutions, redesign, changes to unit area or common elements, and amendments to the budget or rules. Determine whether you have notice, consent, a price adjustment, a termination right or no remedy when a change occurs.

Questions about timing
- What date is described as completion, occupancy, possession and closing, and which of those dates controls your obligations?
- What events allow an extension—permit delays, labour shortages, utility connections, weather, financing, force majeure or other causes?
- How much notice must the developer give, and can the extension be repeated?
- What local cancellation, deposit-return, compensation or delay remedies apply?
- Can you terminate if a disclosure statement is materially amended, an approval fails or the project is cancelled?
Have counsel explain the practical effect of each answer. A target date in an advertisement is not a substitute for the operative clause in your agreement.
Test the first-year budget against long-term ownership
Condo fees are an operating plan, not a permanent price. Ask who pays initial operating costs and whether the developer is subsidizing staffing, utilities, amenity operation, insurance, management or repairs. The Canada Mortgage and Housing Corporation notes that fees often rise after the first year when temporary developer-paid costs end, and may also change after the first reserve fund study. These are risks to investigate, not a prediction that every new tower will increase fees.
Reserve fund questions
A reserve fund pays for major repair and replacement of common elements. CMHC describes its purpose this way: “A reserve fund ensures that the condominium has enough money to pay for the major repair and replacement of the common elements over the life of the building.” Request the reserve-fund study, technical audit, capital plan or equivalent record available for the project’s stage. For a new tower, a large balance alone does not prove financial health; examine projected capital needs, useful-life assumptions, contributions and the governing jurisdiction’s disclosure rules.
Look beyond the monthly fee
| Cost category | What to verify | Why it matters |
|---|---|---|
| Parking and storage | Whether each space is owned, assigned, licensed or rented; its price and ongoing fee | A “space” in marketing may not be a deeded or transferable interest |
| Utilities and connections | Which water, heating, cooling, electricity, internet or metering charges are separate | Low quoted fees may exclude substantial unit or common-area consumption |
| Closing adjustments | Taxes, utility setup, development charges, registration, reserve contributions and other adjustments permitted by the agreement | These can materially change the cash required at closing |
| Building equipment leases | Whether boilers, hot-water equipment, meters or other fixtures are leased and how charges are allocated | Long-term lease obligations can pass directly to owners |
| Amenities and move-in | One-time amenity, elevator-booking, move-in or membership fees | These are easy to miss when comparing advertised prices |
| Future assessments | How special assessments are authorized, allocated and disclosed | An underfunded reserve can require a lump-sum payment as well as higher fees |
Check the unit factor
Confirm the unit factor or proportionate share used to allocate common expenses and voting rights. It should match the governing documents and the unit’s intended size and use. CMHC warns that an inaccurate factor can be difficult to correct because changing it may require amendments to those documents.

Inspect the unit when access is possible
For a completed or nearly completed unit, arrange a walkthrough and consider an independent building inspection. Confirm the inspector’s credentials, insurance, reporting format, access rules and exclusions before booking. Ask whether the inspection covers only the suite or also common elements and building systems; a private inspection cannot automatically assess concealed conditions or areas the inspector cannot enter.
Use a written punch list
- Bring the approved plan, finish schedule, appliance list and any change orders.
- Compare accessible room dimensions, window and door locations, finishes, cabinetry, appliances, fixtures and ventilation outlets with those documents.
- Operate doors, windows, locks, faucets, toilets, appliances, heating and cooling controls, exhaust fans, lights and electrical outlets where utilities are live.
- Look for visible water intrusion, staining, cracks, damaged finishes, uneven floors, missing sealant, poor drainage, incomplete trim and safety hazards.
- Photograph each issue, label its location and record the date, room and relevant document reference.
- Give the developer a dated written list and obtain a written repair commitment. If work will occur after closing, ask that the commitment be included in the closing papers or otherwise made enforceable under local law.
New York’s consumer guide calls this written defects list a “punch list” and advises documenting the builder’s commitment when repairs will happen later. Do not treat a verbal assurance at the walkthrough as completion evidence.
Optional measuring tool
A laser distance measurer can help record rough interior dimensions during an accessible walkthrough. It cannot establish legal boundaries, replace a survey or official plan, or reveal concealed building conditions. Use the contract documents and official plans for the legal floor area and boundaries.
Assess the tower’s common elements and systems
Your unit is only one component of the asset. Ask what has been completed, tested, commissioned and accepted for the shared parts of the building, and whether owners can review reports.

| Area | Checks and questions |
|---|---|
| Envelope and façade | Visible cracks, failed sealants, water marks, balcony drainage, cladding completion, inspection reports and maintenance responsibility |
| Roof and drainage | Completion status, ponding or leaks, access controls, warranty documents and planned maintenance |
| Elevators | Number, service status, backup arrangements, move-in booking rules, maintenance contract and expected wait-time constraints |
| Heating, cooling and ventilation | System type, metering, balancing or commissioning records, filtration, fresh-air supply, exhaust routing and who pays for common equipment |
| Plumbing and electrical | Pressure, drainage, shutoffs, metering, generator or backup power, panel capacity and any planned equipment leases |
| Fire and life safety | Required approvals, alarms, sprinklers, fire doors, emergency lighting, evacuation information and outstanding deficiencies |
| Amenities and parking | Whether promised rooms, terraces, gyms, lounges, garages and storage areas are complete, accessible and delivered as specified |
Access to these areas may be restricted before turnover. Ask what an independent inspector can review and which reports the condominium corporation, sponsor or developer will deliver. Consumer Affairs Victoria advises buyers to consider an independent building inspection and examine visible structural issues, damage, repairs, defect claims, warranties, maintenance plans and insurance.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Investigate the site and the neighborhood
Visit at different times if practical. Listen for traffic, deliveries, construction, mechanical equipment and amenity noise; check odors, wind exposure, sunlight, privacy, pedestrian access and the route to parking or transit. Ask how loading, waste collection, visitor parking and emergency access will operate.
Planned changes nearby
Ask the developer and the municipality about approved or proposed construction near the tower, road changes, new transit, utility work, rezoning, vacant parcels and temporary access restrictions. Planning information must be checked with the municipality where the project is located; no general online description can replace the local planning record.
Accessibility and daily practicality
- Confirm step-free routes from the street and parking to the unit, elevator dimensions, door clearances and accessible washroom features if required.
- Ask whether ventilation, heating and cooling controls can meet your needs and whether windows can be opened.
- Check mobile reception, package delivery, bicycle storage, visitor access and the rules for installing adaptations.
- Determine whether views, light or privacy depend on undeveloped neighboring land.
Understand warranty protection and defect claims
Warranty is not a blanket promise that every problem will be repaired. Confirm the administrator, covered work, exclusions, claim deadlines, inspection or notice requirements, deposit protection and dispute process for the jurisdiction where the tower is built. Read the warranty documents rather than assuming a familiar duration or scope; coverage differs by location and by the component involved.

Prepare a claim file
- Keep the agreement, specifications, closing statement, inspection report, photographs and correspondence together.
- Record the defect, date discovered, location, effect on use and any temporary safety measure.
- Notify the responsible party and warranty administrator through the required channel before the stated deadline.
- Request a written response, proposed repair date and explanation if coverage is denied.
- Escalate through the warranty administrator, condominium corporation process, regulator or legal route available locally.
Do not authorize major work or waive a claim without understanding how it affects warranty rights. A lawyer can explain whether a repair commitment, release or closing document limits later recovery.
Use a repeatable decision process
Before signing
- Identify the governing jurisdiction and obtain its buyer, disclosure and warranty guidance.
- Give the complete contract package to local real-estate counsel.
- Verify the developer’s registration or licensing record where one exists.
- Build a total-cost worksheet including deposits, financing, taxes, closing adjustments, parking, storage, utilities, fees and a contingency for fee increases or assessments.
- Write down every material representation you intend to rely on and attach it to the agreement if accepted.
After signing but before closing
- Track construction progress and every formal notice about amendments, delays or occupancy.
- Update the budget using the latest disclosure, reserve information and financing terms.
- Arrange the permitted inspection early enough to obtain repairs or legal advice before closing.
- Compare the delivered unit and common areas with the contract and record a punch list.
- Confirm insurance, utility accounts, parking or storage registration and move-in procedures.
Walk away or renegotiate when the evidence does not support the promise
Pause and obtain legal advice if the developer will not provide governing documents, the contract permits unbounded changes, the budget depends on unexplained subsidies, deposits lack clear protection, the occupancy clause offers no workable remedy, or significant defects have no written repair commitment. A low price does not compensate for a cost or obligation you cannot quantify.
Final checklist for comparing two towers
| Decision factor | Evidence to place beside each project |
|---|---|
| Unit | Final floor area, boundaries, orientation, finishes, appliances, parking and storage rights |
| Contract | Deposit protection, changes, extensions, cancellation, adjustments, closing and occupancy language |
| Building | Construction stage, approvals, common-element completion, system commissioning and maintenance responsibilities |
| Budget | First-year assumptions, developer subsidies, reserve contributions, equipment leases, fee allocation and assessment risk |
| Warranty | Administrator, covered components, exclusions, deadlines, claim procedure and dispute path |
| Location | Noise, odors, access, transit, services, nearby development and municipal planning information |
| Inspection | Inspector credentials, permitted scope, report, photographs and written repair commitments |
The safest decision is the one supported by matching evidence: binding documents for promises, a current budget for costs, local law for rights, and an inspection for observable condition. Treat uncertainty as a term to resolve—not as an assumption that the marketing material will eventually become true.
