Compare the offer’s guaranteed pay with the highest applicable minimum wage for the place and date where you will work. Then make a separate market comparison using the closest occupational wage estimate for that area. The first test answers “Is this legal?”; the second helps answer “Is this competitive?” A market estimate is not automatically a legal minimum for your individual job.
The two comparisons you need to make
A job offer can pass one comparison and fail the other. Start with the legal floor, because an employer generally cannot use a low market rate to justify paying below an applicable minimum wage. After that, compare the offer with wages for similar work in the same labor market.

| Question | Benchmark | What the result tells you |
|---|---|---|
| Is the offer lawful? | The highest applicable federal, state and local minimum wage for the work location and date, after coverage and special rules are considered. | Whether the guaranteed compensation appears to meet the statutory floor. |
| Is the offer competitive? | A recent occupational wage estimate for similar duties in the relevant state or metropolitan area. | How the offer compares with the local labor market. A low result may support negotiation but is not, by itself, proof of a violation. |
Keep the calculations separate. Calling an occupational average a “minimum wage for the occupation” can lead you to the wrong legal conclusion.
What “minimum wage for my occupation” really means
Statutory minimum wage is usually tied to coverage and location
For covered, nonexempt employees under the Fair Labor Standards Act (FLSA), the federal minimum wage is $7.25 per hour. When both federal and state minimum-wage laws cover an employee, the U.S. Department of Labor’s Wage and Hour Division states that the employee is entitled to the higher minimum wage. A city or county rule can add another applicable floor.

There is usually not a separate nationwide legal minimum for every occupation. The applicable rate depends on where the work is performed, whether the worker and employer are covered, and whether an exception or special category applies. A construction laborer, electrician, estimator or office coordinator may therefore be subject to the same general jurisdictional floor, even though their market wages differ substantially.
Occupational estimates are market evidence, not automatic entitlements
Occupational wage data describe what workers in a job category earn in a labor market. They can be useful for deciding whether an offer is unusually low, but they do not automatically require an employer to pay every worker the estimate. The Bureau of Labor Statistics (BLS) occupational estimates described by the Department of Labor cover national, state and metropolitan areas and more than 700 occupations; the series excludes self-employed people, so it may not describe an independent contractor’s earnings or a business owner’s draw.
“Prevailing wage” has a narrower legal meaning
In some programs, “prevailing wage” is a legal term rather than a casual synonym for an average salary. The Department of Labor’s Office of Foreign Labor Certification defines the prevailing wage rate as the average wage paid to similarly employed workers in a specific occupation in the area of intended employment. For H-1B, H-1B1 and E-3 jobs, DOL describes a comparison between the prevailing wage and the employer’s actual wage for similar workers; the employer must pay the higher of the two. Other visa, government-contract and public-works regimes can impose their own rules, so do not apply the ordinary private-sector test without checking the program that governs the job.

Use the place where the work is performed
Write down the physical location for each assignment. For a construction job, that may be a project address rather than the company’s headquarters. If you report to a yard but spend the day on a project in another jurisdiction, identify where the compensated work occurs and check the applicable state or local agency’s interpretation.
Remote, traveling and multi-site work can require a more fact-specific analysis. A single offer may cover projects in several cities with different local rules. The reviewed federal materials do not resolve every multi-location scenario, so ask the responsible state or local labor agency which rate applies to each work period.
Record the date that controls the rate
Minimum wages can change on scheduled effective dates. Record the date each hour will be worked, not only the date you receive or sign the offer. The Department of Labor’s consolidated state table was revised July 1, 2026 and shows state-level rates and selected local distinctions; DOL advises consulting the relevant state labor office for official information. Use the current table and agency notice for the date you are analyzing, including any announced future change that will take effect during the job.

Step 2: Confirm coverage, worker status and exceptions
Identify whether you are an employee
The ordinary minimum-wage comparison is designed for an employee, not automatically for a genuinely self-employed business. Read the offer and working arrangement for the parties’ stated classification, then consider who controls the work, schedule, tools and method. A label in a contract is not the only fact that can matter. If the classification is disputed, obtain advice from the relevant labor agency or a qualified employment lawyer before relying on the calculation.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesCheck FLSA coverage and exemptions
Determine whether the FLSA covers the employer and the work, and whether an exemption or special category changes the baseline. DOL materials explain that coverage and exemptions affect applicability. Do not assume that a salaried title, supervisory label or professional-sounding description alone settles the question. Keep a written description of actual duties, hours and pay structure.
Look for special categories
Tipped work, piece-rate pay, youth employment, agricultural work and other categories can have specific rules. Construction offers may also involve a government contract or a visa program with a separate wage requirement. If one of these categories applies, use the rule written for that category instead of simply comparing the advertised number with $7.25.
Step 3: Find the highest applicable legal floor
- Start with the federal baseline. For a covered, nonexempt employee, record the federal rate of $7.25 per hour.
- Check the state rate. Use the Department of Labor’s consolidated table as a starting point, then verify the current figure and effective date with the state labor office.
- Check local law. Search the labor agency for the city or county where the work is performed and note any local rate, coverage condition or scheduled increase.
- Check special rules. Confirm whether tipped, piece-rate, youth, agricultural, public-contract or visa rules replace or modify the ordinary comparison.
- Select the controlling floor. Where federal and state laws both cover the worker, use the higher standard. Include a higher applicable local rate when local law covers the work.
Do not use an old rate simply because it appears in an offer letter, calculator or cached web page. Save the agency page or notice you relied on, with its date, so you can explain the result later.
Step 4: Convert the offer to a comparable hourly amount
Hourly offer
If the offer states an hourly base rate, begin with that number. Then ask whether all hours you must be present are paid and whether the quoted rate is guaranteed. Separate regular wages from overtime premiums, discretionary bonuses and reimbursements.

guaranteed annual pay ÷ expected paid hours in the year = comparable hourly pay
For example, an illustrative $52,000 salary over 2,080 paid hours equals $25.00 per hour. If the schedule actually requires 2,400 paid hours, the same salary equals about $21.67 per hour. If some breaks, travel time or mandatory meetings are unpaid, use the hours that are actually compensated under the applicable rule. Do not divide by a nominal 40-hour week when the job routinely requires more time.
Commission, bonus and draw arrangements
Separate guaranteed base pay from contingent compensation. A promised commission that depends on sales, a discretionary year-end bonus or a draw that must be repaid is not the same as guaranteed hourly wages. Calculate the legal-floor comparison using the guaranteed amount first. You may show a second, clearly labeled projection for variable earnings, but do not present the projection as certain pay.

Tips, piece rates and other structures
For tipped work, piece-rate work and other non-hourly structures, identify the special rule before converting the offer. A piece rate can be tested against hours worked, while a tip credit may have notice and recordkeeping conditions. The exact result depends on the applicable federal, state and local law. If you cannot determine the treatment from official guidance, pause the legal conclusion and ask the labor agency for help.
Benefits and deductions
List health insurance, retirement contributions, paid leave and other benefits separately from cash wages. They may matter to the offer’s overall value, but they should not be silently added to guaranteed hourly pay when testing a statutory wage floor. Likewise, record any required deductions or employee-paid costs that reduce the cash you actually receive, and verify how the governing law treats them.
Step 5: Match the occupation by duties, not title
Build a duty-based description
Write down the work you will actually perform:
- Primary tasks, such as framing, concrete placement, equipment operation, estimating or site supervision.
- Required skills, licenses, certifications and software.
- Responsibility for people, budgets, safety, schedules or quality control.
- Tools, machinery and materials used.
- Whether the work is residential, commercial, industrial or infrastructure-related.
- Your expected level: entry, experienced, lead or supervisory.
Use the closest occupational category for those duties. A title such as “project coordinator” can cover an administrative role or a field-management role; those jobs should not be compared with the same wage category merely because the title matches.

Why title-only matching fails
For prevailing-wage determinations, DOL guidance says to consider the full job description and the work’s tasks, skills and activities rather than relying only on the title. The same discipline improves an ordinary market comparison. If two categories seem plausible, record why you selected one and identify the duties that would move the job into the other category.

Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Step 6: Choose a market estimate for the area
Select the geographic level that fits the job
Use the smallest reliable area that represents the labor market: a metropolitan estimate when the job is in a covered metro area, or a state or national estimate when a local figure is unavailable. A statewide figure can mask major differences between a rural project and a large city. Name the area in your notes so the comparison can be reproduced.
Record the statistic and period
Note whether the source reports a median, mean or another percentile, and record the data period. A median is the midpoint; a mean can be pulled upward by high earners. Neither is a legal floor. Do not compare a current offer with an estimate from an older release without stating the time gap.
Account for what the data omit
BLS occupational estimates described by DOL exclude self-employed people. They may also aggregate employers, industries and experience levels that do not match your offer. Treat the estimate as context, then adjust your interpretation for duties, seniority, credentials, work conditions and the employer’s sector rather than claiming that the estimate is the required wage.
Put the comparison on one worksheet
| Item | Your entry | Why it matters |
|---|---|---|
| Work location | Project address, city, county and state | Determines which jurisdictional rules may apply. |
| Work date | Start date and any rate-change dates | Rates are effective for particular dates. |
| Worker status | Employee, contractor or unresolved | The ordinary employee minimum-wage test may not fit every status. |
| Coverage or exception | FLSA coverage, exemption or special category | Coverage can change the applicable baseline. |
| Federal floor | $7.25 per hour for covered nonexempt employees | Federal starting point. |
| State and local floors | Current rates and effective dates from the relevant agencies | Use the highest applicable legal rate. |

Worked examples
Example 1: Hourly construction offer
Assume, purely for illustration, that a covered employee will work at a site where the applicable combined legal floor is $16.00 per hour on the work date. The offer guarantees $15.25 per hour and promises an occasional performance bonus.
- Use the guaranteed $15.25, not the possible bonus.
- Compare $15.25 with the $16.00 floor.
- Because the guaranteed rate is below the assumed floor, ask the employer to correct the rate and contact the responsible labor agency or worker legal-aid service for guidance.
- Only after the legal test is resolved, compare the corrected offer with the duties-based market estimate for the area.
The example does not establish any real jurisdiction’s rate; it shows why contingent money cannot repair a guaranteed hourly shortfall.

Example 2: Salary with long project hours
Suppose an estimator is offered a guaranteed $60,000 per year. The written schedule says 40 hours per week, but the employer expects 2,500 paid hours during the year because of bid deadlines. The normalized figure is $60,000 ÷ 2,500 = $24.00 per hour, not the $28.85 figure produced by dividing by 2,080 hours. Compare the realistic figure with the applicable legal floor, then compare it with the wage estimate for the estimator duties and area.
Example 3: Market estimate below the offer’s legal floor
Assume the legal floor is $16.00 and the closest occupational estimate has a $15.00 mean. An offer of $17.00 clears the legal floor even though it is above the estimate. The estimate cannot lower the legal requirement, and it is not a reason to reject a compliant offer. Check that the occupation, area and data period truly match before drawing a market conclusion.
Special wage regimes and construction contracts
H-1B, H-1B1 and E-3 employment
DOL describes a prevailing-wage/actual-wage comparison for these visa categories. The employer must pay the higher of the prevailing wage or the actual wage paid to similarly employed workers, subject to the program’s requirements. Gather the occupation, area, wage source and employer’s comparable-worker information rather than relying on a general online salary average.
Government and public-work projects
A government contract or public-work project may carry wage terms that are not captured by the ordinary federal, state and local minimum-wage check. Read the contract or wage determination identified for the project and confirm which workers and classifications it covers. If the offer does not identify the applicable determination, ask the contracting agency or labor office before accepting the stated rate.
Multiple classifications on one project
A worker who performs several kinds of work may need a classification based on the duties actually performed, not the employer’s preferred title. Keep daily records of tasks, hours and locations. Those records can help an agency determine whether the offer was matched to the correct category.
How to interpret the result
If the normalized pay is below the legal floor
- Do not treat a market average, bonus promise or benefit package as a substitute for the missing guaranteed wage.
- Ask the employer in writing which jurisdiction, classification and exception it used.
- Provide the worksite, dates, schedule, pay records and offer language to the relevant state or local labor agency or worker legal-aid organization.
- For a visa or government-contract job, contact the office responsible for that program as well as the ordinary labor agency when appropriate.
A low calculation is a signal to verify facts promptly, not a final legal ruling. Coverage, classification and special compensation rules can change the outcome.
If the pay clears the legal floor but trails the market estimate
That result may support negotiation. Use the duties-based comparison, local area, data period and statistic to ask for a higher base rate, a guaranteed review date, paid training or a clearer overtime and travel policy. Describe the estimate as market evidence, not as a legal entitlement.
If the comparison is inconclusive
Stop and resolve the missing input: worksite, effective date, employee status, actual duties, paid hours or special program. A precise-looking calculation built on the wrong occupation or location is less useful than a qualified answer that identifies what must be checked.
Common mistakes and how to avoid them
- Using the employer’s headquarters. Use the place where the compensated work is performed, especially for field construction.
- Using the federal rate alone. State and local laws can set a higher floor.
- Calling a mean wage the minimum. A market statistic is not automatically a statutory requirement.
- Matching only the title. Compare duties, skills, responsibility and work activities.
- Counting uncertain compensation. Separate guaranteed wages from commissions, discretionary bonuses and conditional draws.
- Dividing salary by 2,080 automatically. Use realistic paid hours and account for required unpaid time under the applicable rules.
- Ignoring the data period. Record when the wage estimate and legal rate were issued.
- Assuming a contractor is covered like an employee. Resolve classification before applying the ordinary employee test.
- Reusing an old table. Verify current rates and scheduled changes with the relevant labor office.
A practical checklist before you accept
- Write the address or addresses where you will work.
- Write the start date and any date when a rate changes.
- Identify employee or contractor status and note anything uncertain.
- Describe actual duties, skill level, supervision and work conditions.
- Check FLSA coverage, exemptions and special categories.
- Record the federal, state and local rates from current official sources.
- Select the highest applicable legal floor.
- Separate guaranteed pay from variable pay and benefits.
- Convert salary or non-hourly pay using realistic paid hours.
- Choose the closest occupation and area by duties, not title.
- Record the market statistic, measure and data period.
- Check for visa, government-contract or other special wage rules.
- Save the offer, schedule, agency pages and your calculations.
Recheck the worksheet if the project location, schedule, duties or pay plan changes. Rates and occupational releases can change, so a comparison made for one work date should not automatically be reused for another.
