How to choose a public sector construction framework for building projects

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose a public sector construction framework only after you have defined the project, tested whether a framework is the right delivery route, confirmed your authority is eligible to use the agreement and checked that its scope, lots, suppliers, terms and dates fit. Then follow the agreement’s permitted award procedure and retain a clear record of the commercial and governance decision.

This is a UK-focused guide for public-sector procurement professionals, project managers and budget holders. The legal position and framework availability can differ by jurisdiction and can change, so verify the current agreement documents, legislation, templates and internal approvals before awarding a contract.

What a construction framework is—and is not

Under the Procurement Act 2023, a framework is an agreement that sets the provisions for future contracts. It is not the building contract itself. The contract for your school, hospital extension, office or civic facility is the call-off awarded under that framework.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That distinction affects every decision that follows. A framework may provide an established supplier market, standard terms and a route to award, but it does not approve your project automatically. You still need a defined requirement, a lawful award, budget authority, proportionate evaluation and a contract-management plan.

“Contracting authorities are unable to delegate their responsibilities to undertake lawful procurement and therefore, using a framework does not outsource the responsibility for good commercial judgement that is required from the buyer.”

Government Commercial Function, The Framework Practice Guide, published 10 September 2026

The framework provider’s work in establishing the agreement does not transfer your accountability. Your authority remains responsible for the call-off decision, its records and the outcomes it can reasonably control.

Is a framework the right route for this project?

Start with the delivery decision, not with a familiar framework name. A framework is one possible route alongside a standalone procurement or another delivery model. The choice should follow the project’s business need, risk profile and governance requirements.

Define the requirement before searching

Write a concise project brief that procurement and delivery colleagues can use consistently. Include:

  • What is being built, refurbished, maintained or demolished, and the required outputs.
  • The site and jurisdiction, including any access, planning, neighbour or operational constraints.
  • The estimated contract value and how the estimate was produced, with allowances for risk and inflation where appropriate.
  • Required completion date, phasing, decant or continuity arrangements and any dependencies on funding or approvals.
  • Design maturity: feasibility, developed design, technical design or another defined stage.
  • Specialist requirements such as civil and structural engineering, heritage work, laboratories, healthcare environments, secure facilities, modular construction or complex services interfaces.
  • Desired contract form, payment approach, performance requirements, insurance and liability expectations.
  • Policy and governance requirements, including social value, small and medium-sized enterprise access, carbon objectives and reporting.

If these facts are unclear, a lot comparison will be unreliable. A framework labelled “construction” may still exclude your building type, value band, region, specialist service or delivery model.

Test the alternatives

Ask whether the authority should deliver the work in-house, procure a standalone contract or use a framework. Compare realistic alternatives on total cost, speed that can actually be achieved, market access, competition, risk allocation, internal capability and governance burden. Do not claim that a framework is inherently faster or cheaper; the available official material does not establish a universal saving or programme advantage.

The Government Commercial Function’s practice guide recommends completing a Delivery Model Assessment (DMA). For a complex requirement, consider a Project Validation Review (PVR) as well. These exercises help test whether the proposed route can deliver the required outcomes and whether the authority has the capability to manage it.

Clear internal governance first

Obtain the approvals required by your organisation before engaging a framework provider or inviting suppliers. Check delegated financial authority, project-board or cabinet requirements, legal review, funding conditions and any local rule about a “provider of choice”. The decision record should explain why the route is appropriate and who approved it.

Confirm that your authority can use the agreement

Eligibility is a threshold question. Identify the contracting authorities named in, or otherwise permitted by, the framework documents. Under Procurement Act guidance, a contracting authority may call off only from a framework established by a contracting authority. A framework established by a centralised procurement authority can be available to wider public-sector bodies, but the individual buyer must still confirm that it falls within the permitted user group.

Keep evidence of the eligibility check with the procurement file. A public webpage or a supplier’s assertion is not a substitute for the framework notice, terms, buyer guide or other agreement document that establishes who may buy.

Compare the agreement’s actual fit

When two or more frameworks appear plausible, compare the facts below. Use the framework specification, lot descriptions, schedules, terms, pricing documents, order forms and buyer guidance—not just the agreement’s title.

Decision axis Checks to perform
Legal regime and framework type Whether it was established under the Public Contracts Regulations 2015 (PCR 2015), as a closed framework under the Procurement Act 2023, or as an open framework under that Act; confirm which rules govern the proposed call-off.
Buyer eligibility Whether your authority is named or otherwise permitted to use the agreement, and whether any conditions apply to the category or geography.
Scope and lot fit Building works, associated services, project value band, location, specialism, delivery model and any exclusions.
Supplier market Relevant supplier capability, number of suppliers, geographic coverage, capacity and the level of competition expected for the lot.
Award route Whether the documents permit direct award or award without competition, or require a further competition or award with competition; check the exact steps and evaluation rules.
Commercial and legal terms Call-off form, pricing mechanism, payment, risk allocation, liability, insurance, change control, performance remedies, termination and exit provisions.
Timing and continuity Framework expiry, final date for awarding call-offs, mobilisation period, project phasing and the availability of a successor agreement.
Governance and value DMA or PVR requirements, internal approvals, provider support, cost evidence, social value, carbon and SME-access objectives.

Read the lot documents, not just the headline

Check the building category, value or size band, region, specialist discipline and associated services line by line. Confirm that your estimated value and the required scope fall within the lot’s boundaries. If the project combines several disciplines, establish whether one lot covers the whole requirement or whether the agreement requires separate call-offs.

The Government Commercial Agency’s RM6088 Construction Works and Associated Services illustrates why this matters: its lots are divided by value, geography and specialism, rather than treating every construction project as interchangeable. The agency also identifies a Guided Match tool to help buyers select a lot. Treat that tool as a navigation aid and verify the result against the binding agreement documents.

Check supplier capacity and financial resilience

A supplier being listed does not prove that it can start your project when required. Ask how many eligible suppliers are genuinely capable of the work, whether they operate in the project region, what current workload they have and whether specialist subcontracting is needed. Record how capacity was assessed and how competition will remain meaningful.

The Framework Practice Guide says buyers should verify that the framework provider has operational capacity to monitor supplier financial health and systemic performance issues. Consider what information will be available to you during the call-off and delivery period, and who will act if a supplier’s position deteriorates.

Review terms and interfaces early

Read the call-off template and every schedule that affects delivery. Pay particular attention to design responsibility, surveys and site information, price adjustment, ground risk, utilities, planning, information management, defects, delay, extensions of time, third-party interfaces and handover obligations. Check whether the framework offers the contract forms and amendments your legal and project teams can administer.

For RM6088, the agency page lists NEC, JCT, PPC2000, TAC-1 and SBCC contract-form options. That list is an illustration of available forms on that agreement; it does not mean every form is available for every lot or that one form is suitable for your project. Confirm the applicable lot schedule and call-off documents.

Which lot covers the building project?

Use a repeatable lot-selection process so the reasoning can be audited.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Classify the work. Decide whether the requirement is major or minor building work, civil engineering, repair and maintenance, demolition, site preparation, modular or prefabricated construction, or an associated professional service.
  2. Set the value band. Use the approved estimate and state whether the figure includes options, extensions, taxes or other elements required by the framework’s definition of value.
  3. Map the location. Check the lot’s geographic coverage, site access expectations and any regional supplier restrictions.
  4. Identify specialisms and interfaces. List structural, civil, architectural, engineering, heritage, healthcare, laboratory, security, digital or other specialist needs, and decide whether they must be procured together.
  5. Confirm supplier capability. Review the suppliers admitted to the relevant lot and their stated capability, then test current capacity and conflicts.
  6. Validate the result. Use any official matching tool, but reconcile it with the lot description, specification, exclusions and call-off rules.

Keep the completed lot assessment with the business case. If the project changes materially in value, scope, location or phasing, repeat the check before award.

Can you award directly, or must you run a competition?

“Direct award” and “competition” are not interchangeable labels. The permitted route depends on the framework’s legal regime and its own terms.

Framework category What the buyer guidance says What to do
PCR 2015 framework The buying guidance describes direct award and further competition routes. Follow the framework’s stated conditions for selecting suppliers, inviting bids, evaluating responses, documenting the decision and notifying suppliers.
Closed framework under the Procurement Act 2023 The guidance describes award without competition and award with competition. Use only the procedure and criteria set out in the agreement and applicable law.
Open framework under the Procurement Act 2023 The framework consists of successive frameworks and allows new suppliers to join at reopening points; the guidance also describes award with or without competition. Check the current iteration, its supplier list, reopening timetable and the exact call-off procedure.

For any route, read the buyer guide, framework terms, schedules, order form, pricing rules and award criteria together. Confirm whether you must invite all eligible suppliers or a defined subset, how conflicts are handled, what evidence is required and what notices or standstill steps apply. The provider’s general webpage cannot replace agreement-specific instructions.

Understand framework duration and expiry

Do not apply a generic four-year assumption without checking the framework and the applicable exception. Procurement Act guidance states a general maximum of four years for a non-open, non-exempt framework, or eight years for defence and security or utilities frameworks. A longer period may be justified where the nature of the works requires it; the guidance gives large construction or infrastructure developments with phased call-offs as an example and says the rationale must be published.

Those are statutory framework-term rules, not permission to extend an individual agreement informally. Record the framework start and end dates, the latest date for awarding a call-off, the call-off term and any transition arrangements. A call-off awarded before expiry may have a different performance period, but the agreement documents and law determine what is permitted.

Current construction examples to illustrate the checks

RM6088 Construction Works and Associated Services

The Government Commercial Agency describes RM6088 as covering major and minor building and civil engineering projects for central government and the wider public sector. Its lots use value, geographic and specialist distinctions, and the page lists the contract-form options noted above. The live agreement page states that RM6088 expires on 31 March 2027 and that all contracts must be awarded by that date.

Those dates and supplier or lot details are time-sensitive. Before using RM6088, check the live agreement page, buyer guide, current lot documents and your authority’s eligibility. Work backwards from the final award date to allow for design development, approvals, competition, evaluation, moderation, governance and mobilisation.

CWAS3 including ProCure 24 (RM6320)

The agency describes RM6320 as a closed framework under the Procurement Act 2023 for construction works and services for the UK public sector. The stated intended scope includes building work; civil and structural engineering; repair and maintenance; architectural and engineering services; prefabricated and modular buildings; and demolition or site preparation. It is intended to replace RM6088, CWAS2/ProCure 23 and RM6184 Offsite Construction Solutions.

On the page reviewed, the lot structure and specialisms were still to be determined following customer and supplier engagement. The page listed anticipated award or mobilisation between December 2026 and March 2027. These are page-state descriptions, not guarantees that the timetable or lot decisions remain unchanged. Because the lot structure was not settled in that version, it cannot support a lot-by-lot recommendation. Recheck the current agreement before relying on it for a live procurement.

Build the value and governance case

Your decision record should show why the chosen route is best for this project, not why a framework is generally attractive. Include:

  • The requirement, estimate, programme, design maturity, risks and required outcomes.
  • The DMA and, where appropriate, the PVR, with actions arising from each.
  • Alternatives considered, including a standalone procurement and other plausible frameworks.
  • Eligibility evidence and the legal regime that applies.
  • Lot-selection analysis covering scope, value, geography, specialism and supplier capability.
  • The permitted award route and the agreement provisions that support it.
  • Evaluation criteria, pricing evidence, moderation and the reasons for the award decision.
  • Commercial risk allocation, contract form, insurance, performance measures, change control and exit arrangements.
  • Supplier financial-health and capacity checks, plus the plan for monitoring systemic issues.
  • Framework and call-off dates, mobilisation assumptions and contingency if the project slips.
  • How social value, carbon, SME access and other applicable policy objectives will be delivered and measured.
  • Named approvals, legal advice, conflicts declarations and the location of the complete audit trail.

This record protects the authority’s ability to explain its judgment later. It also gives the project team a common reference when scope or timing changes.

Common mistakes and how to prevent them

Choosing by brand or familiarity

A well-known agreement may not cover the building type, value, region or specialist work. Prevent this by completing the lot-fit assessment against the binding documents and recording exclusions.

Assuming the framework provider carries the legal risk

The provider establishes and administers the agreement, but your authority awards the call-off. Use the practice guide’s principle as a governance test: identify the person accountable for each procurement judgment and retain the evidence.

Calling a route “direct award” without checking the rules

Different regimes use different terminology and conditions. Quote the exact clause or schedule that permits the proposed route, then follow its supplier-selection, evaluation, notification and record-keeping steps.

Leaving the date check until mobilisation

A project can be operationally ready yet impossible to award if the framework deadline has passed. Put the framework expiry and latest award date on the programme’s critical path and set an escalation point well before it.

Treating an announced successor as available

Planned agreements can change during engagement and approval. Do not rely on an anticipated successor, lot structure or mobilisation date until the current official documents confirm them. Maintain a lawful contingency route.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ignoring internal delivery capacity

A framework does not remove the need for client-side design management, cost control, contract administration, risk management and stakeholder decisions. Confirm that the authority can manage the call-off and the construction contract throughout delivery.

A practical final check before approval

Before seeking final approval, the project lead and procurement lead should be able to answer “yes” to each question:

  • Is the requirement, value, programme, design maturity and specialist scope defined?
  • Has the authority tested in-house, standalone and framework routes through the appropriate DMA or PVR process?
  • Is the authority eligible to use this agreement?
  • Does a named lot cover the work, location, value band and specialisms?
  • Are enough capable suppliers available, with capacity for the required start and delivery period?
  • Are the call-off terms, pricing, risk allocation, contract form and performance provisions acceptable?
  • Is the proposed direct award or competition route expressly permitted by the current agreement and law?
  • Are the framework expiry, final award date, mobilisation and successor risks built into the programme?
  • Have legal, financial, project and policy approvals been obtained?
  • Can the authority show, from its records, why this route delivers the best balance of cost, quality, risk, policy outcomes and manageability for this project?

There is no universal best public-sector construction framework. The defensible choice is the agreement whose legal status, eligibility, lot, suppliers, terms, timing and support match the defined project—and whose selection your authority can evidence and manage.
