How to Check Whether a Property Has Unauthorized Construction

The reliable way to check for unauthorized construction is to combine official permit and enforcement records with a comparison of the records against the building as it exists today. Start with the building department or other authority having jurisdiction for the exact address. Review permit applications, approved plans, inspection history, final approvals, open or expired permits, code-enforcement cases, and any certificate of occupancy, completion, or compliance. Then investigate every mismatch instead of treating a blank search result as proof that the work is legal.

Jurisdiction matters. A city and its surrounding county may keep separate records, and planning or zoning approval can be legally distinct from building-code approval. The steps below show how to perform the check, interpret what you find, and decide when professional help is warranted.

What counts as unauthorized construction?

Construction is potentially unauthorized when work that required a permit, approval, inspection, or change-of-use authorization was performed without it, or when the work went beyond the scope of the approval. Examples can include an addition, enclosed porch, converted garage, new dwelling unit, structural alteration, finished basement, relocated kitchen or bathroom, new electrical or plumbing work, change from commercial to residential use, or a change in the number of occupants.

“Unauthorized” is not determined by appearance alone. A project may look substantial but be exempt in that jurisdiction, while a less visible change may require permits. The controlling questions are which rules applied at the time of the work, which authority administered them, and whether the required approvals and final sign-offs exist.

Find the authority that controls the address

Use the exact street address first. Confirm whether the property lies inside an incorporated municipality or in an unincorporated county area. Municipal and county permit systems can be separate; a county search may exclude properties inside city limits, while a city portal may not contain county-issued records.

Ask the authority which departments hold each type of record. Building, planning or zoning, fire, electrical, plumbing, and code-enforcement files may be maintained separately. A planning approval does not necessarily substitute for a building permit, and a building permit does not necessarily establish that the current use is lawful.

Information to have ready

  • Complete street address, including unit or suite number.
  • Parcel, folio, tax-map, or property-control number, if available.
  • Current owner name and, if known, former owner names.
  • Approximate dates of additions, renovations, or changes in use.
  • Any permit numbers, plans, certificates, seller disclosures, or prior inspection reports.

Why local boundaries change the result

Miami-Dade County and Palm Beach County, for example, warn that their online searches do not cover most properties inside municipalities. Those are local limitations, not a universal rule. Confirm the boundary and the portal’s coverage before concluding that “no record” means no permit.

Search the official records in the right order

1. Search permit applications and history

Search by address and parcel identifier where the system allows both. Review every relevant application, not only permits labeled “addition” or “renovation.” Descriptions may use technical or abbreviated language, and a series of smaller permits can collectively represent a major alteration.

For each record, capture:

  • Application and permit number.
  • Work description and stated valuation or area, if shown.
  • Permit type and the trade disciplines covered.
  • Issue date, expiration date, and current status.
  • Approved plans, revisions, and conditions, when available.
  • Applicant, contractor, and owner information, where public.

Older work may not appear in a modern portal. The department may require a formal records request, an archive appointment, or an in-person review. Ask whether historical permit books, microfilm, scanned plans, or other archives exist.

2. Check inspection and final-approval history

A permit issuance proves that an application or permit exists; it does not prove that the work was completed legally. Open the inspection log and identify required inspections, passed and failed results, re-inspections, and the final building and trade approvals.

Look specifically for:

  • Missing required inspections.
  • Failed inspections without a later pass.
  • Final inspection or completion entries.
  • Stop-work orders or stop-issue flags.
  • Expired permits that were never closed.
  • Required occupancy or completion certificates.

Fairfax County describes potential violations for work requiring permits, minimum inspections, a final inspection, or an occupancy certificate. The exact categories and terminology vary by jurisdiction, so ask the department what each local status means.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Search code-enforcement and zoning cases

Search for open and closed cases involving work without a permit, zoning violations, unsafe structures, notices, citations, stop-work orders, and recorded liens. Include both building and land-use searches when they are separate.

Read the case narrative and resolution, not just the case count. A closed case may indicate that work was legalized, removed, corrected, or simply administratively closed. Determine whether the resolution required a retroactive permit, demolition, a recorded agreement, or other continuing condition.

4. Verify certificates and legal occupancy

Find the certificate of occupancy, certificate of completion, certificate of compliance, or equivalent document if the jurisdiction uses one. Check the approved use, occupant load, number of dwelling units, floor or suite covered, and issue date against the property today.

Certificate requirements depend on location, building type, age, and the work performed. New York City, for example, explains that certain buildings constructed before 1938 may not need a certificate unless later alterations changed use, egress, or occupancy. That is a local rule, not a general exemption.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Washington, D.C.’s Department of Buildings describes its certificate of occupancy as verification that a building meets legal and safety standards for its use. A certificate therefore answers a particular use-and-occupancy question; it does not automatically prove that every later alteration was permitted.

5. Check planning law separately from building compliance

Some jurisdictions issue planning or zoning decisions separately from building permits and inspections. In the United Kingdom, a lawful development certificate confirms lawfulness for planning purposes; it does not replace compliance with building regulations or other requirements. Comparable separations exist elsewhere under different names.

When a file contains a zoning approval, ask whether building, fire, electrical, plumbing, accessibility, and occupancy approvals were also required and whether they were completed.

6. Compare the records with the property

Walk through the property, where you are entitled to do so, and make a room-by-room inventory. Compare the visible configuration and current use with approved plans and certificates.

  • Exterior footprint, additions, decks, porches, and roofed structures.
  • Enclosed areas that may once have been open patios, garages, or carports.
  • Basement or attic rooms, windows, stairs, and emergency exits.
  • Number and arrangement of kitchens, bathrooms, bedrooms, and dwelling units.
  • Structural walls, beams, stairs, and changes in floor openings.
  • Electrical panels, service upgrades, gas appliances, and plumbing fixtures.
  • Current business, rental, or occupancy use compared with the certificate.

A mismatch is a question for the authority, not proof of a violation. Plans can be outdated, work can have been approved under a different description, and some changes may be exempt.

7. Ask the authority to explain gaps in writing

If an online search returns nothing or does not explain the building, ask the department to state:

  • Which address, parcel, and owner-name searches were performed.
  • Which years and record series the search covers.
  • Whether municipal and county systems were both checked.
  • Whether archived plans, permit cards, or scanned files exist.
  • Which agency holds zoning, fire, electrical, plumbing, or occupancy records.
  • Whether a no-record response means “no record found” or “no record exists.”

Request the answer and the search scope in writing. Mecklenburg County Code Enforcement states that its online document research for specified building records covers only the last six years. A missing online entry can therefore reflect retention limits rather than unauthorized work.

8. Get transaction-critical uncertainty resolved

For a purchase, refinance, insurance claim, or major renovation, do not rely on an assumption that a seller, agent, or portal is correct. Ask the seller for permits, approved plans, final approvals, certificates, and disclosures, then verify material claims independently with the authority.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Disclosure duties are location-specific. Miami-Dade County’s cited disclosure guidance applies to residential properties in unincorporated Miami-Dade; it should not be treated as a rule for every county or state.

How to interpret the records

Finding What it establishes What still needs checking
Permit application or issued permit An application or permit exists for the described scope. Whether the work matches the actual building, inspections passed, and final approval was recorded.
Passed final inspection The authority recorded completion of the inspected scope. Whether later work or a different use occurred, and whether other trades or certificates were required.
Open or expired permit The file is not shown as fully closed under the local system. Ask the department what corrective action, inspection, renewal, or closure is required.
Stop-work order, stop-issue status, or violation The authority identified a compliance issue or restricted further work. Read the case history and resolution; determine whether the issue remains active or was cured.
Certificate of occupancy or completion A particular use or completion status was approved for the covered building or area. Compare its use, occupant load, area, and date with the present property.
No violation found No covered violation appeared in the searched records. Search coverage, retention, undetected work, and physical mismatches.
Planning or zoning approval The proposal was lawful under the identified planning or land-use rules. Building permits, inspections, technical codes, and occupancy approvals.

Palm Beach County publishes local status categories such as active, inactive, expired, in-process, and stop-issue. Other systems use different labels, so do not transfer that list to another jurisdiction without confirmation.

Why a clean search is not proof of legality

Authorities can only report records they received, retained, and indexed, and work can remain undetected. Miami-Dade County expressly warns that work may have been completed without permits and not yet detected as a violation. Its buyer-seller guidance states: “Many home inspections do not check for illegal construction or outstanding building or zoning code violations.” That warning is presented in the context of required disclosures for covered unincorporated Miami-Dade residential transactions.

A negative result can also reflect a boundary error, an address-format mismatch, a parcel split, an older paper file, a different owner name, or a record held by another agency. Treat “no records found” as a statement about the search performed, not a legal certification that no unauthorized work exists.

When to involve a qualified professional

Use a local architect, engineer, building official, code consultant, or contractor when plans and conditions conflict, structural or life-safety issues may be involved, or the transaction cannot proceed on uncertainty. Choose someone familiar with the property’s jurisdiction and the relevant discipline.

A professional can help document dimensions, identify likely structural or trade alterations, interpret plans, and prepare questions for the authority. They cannot replace the authority’s determination of permit history or legal status. Ask for a written scope that distinguishes physical observations from legal conclusions.

Routine home inspections should not be assumed to include permit or code research. Confirm the inspector’s actual scope in writing, especially for additions, converted spaces, accessory units, and commercial or mixed-use property.

What to do when unauthorized work is confirmed

Do not conceal or continue disputed work. Ask the authority what remedies are available in that jurisdiction. Depending on the rules and the work, the path may involve a retroactive permit, engineered drawings, opening concealed work for inspection, corrective construction, removal, a new certificate, penalties, or recorded conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before signing a transaction or starting new construction, obtain the authority’s requirements in writing and price the required professional services and corrective work. An open permit, lien, unsafe-structure case, or unresolved violation can affect financing, insurance, resale, and the ability to obtain future approvals.

A practical transaction checklist

  1. Confirm the municipality or unincorporated county that serves the address.
  2. Collect the parcel identifier and all known property names and addresses.
  3. Search building, trade, planning or zoning, occupancy, and code-enforcement records.
  4. Download or request applications, approved plans, inspection logs, certificates, notices, and case resolutions.
  5. List every visible addition, conversion, structural change, and current use.
  6. Match each item to a permit scope, inspection completion, and applicable certificate.
  7. Ask the authority in writing about unexplained gaps, old records, and cross-agency files.
  8. Obtain seller disclosures and supporting documents, then verify material claims independently.
  9. Use a qualified local professional for structural, technical, or transaction-critical uncertainty.
  10. Keep a dated file of searches, responses, documents, photographs, and outstanding questions.

Key jurisdiction differences to keep in mind

Municipal versus county systems

County portals may exclude incorporated cities, and city portals may not include county records. Always search the government that actually serves the parcel and ask whether another agency has related files.

Different certificate names

One locality may issue a certificate of occupancy, another a completion or compliance certificate, and another may use a different document or require one only for certain buildings or changes in use. Ask what document proves lawful occupancy for that address.

Different retention periods

Online history is not necessarily a complete historical archive. The six-year coverage described by Mecklenburg County is an example of a local retention limit, not a general standard.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Different disclosure duties

Seller-disclosure forms and mandatory statements vary by state, county, municipality, property type, and transaction. Apply the law for the property’s location rather than copying a neighboring jurisdiction’s form.

Questions that should be answered before relying on a property

  • Does every visible addition or conversion have a matching approval?
  • Are permits closed with all required final inspections?
  • Does the occupancy or completion document match the current use and number of units?
  • Are there open cases, liens, stop-work orders, or unresolved conditions?
  • Could the missing information be explained by jurisdiction, address, archive, or retention limits?
  • Has a qualified professional reviewed the physical property where the records are incomplete?
