Before you commit to a property, ask the local building or permitting authority for the complete record: permit applications, issued permits, inspection entries, final approvals, certificates of occupancy, and open code or zoning matters. Then compare those records with the seller’s disclosures and an independent inspection. A permit search alone cannot prove that work was completed correctly, and a standard home inspection cannot certify that construction was legal.
Why permit history belongs in your buying decision
An addition, converted garage, finished basement, new dwelling unit, structural alteration, or major remodel can affect safety, insurance, financing, taxes, resale, and your ability to use the space as advertised. The visible result may look complete even when the administrative record is incomplete.

There is no single nationwide permit database. The controlling authority may be a city, town, county, regional district, or another local agency, depending on the property’s exact location and the type of work. Start with the official building or permitting office for that address. Connecticut’s 2026 guidance puts the point plainly: “Prospective buyers should consult with the municipal building official in the municipality in which the property is located to confirm that building permits and certificates of occupancy have been issued for work on the property.”

What to request from the local authority
Record names differ by jurisdiction, and some offices use separate systems for building, electrical, plumbing, mechanical, fire, zoning, and planning matters. Ask the office to identify all relevant records for the property rather than relying on one online search result.
| Record | What it can establish | What it cannot establish by itself |
|---|---|---|
| Permit application | The applicant’s stated scope, plans, project description, and submission date. | That the permit was issued, work was performed, or work passed inspection. |
| Issued permit | That the authority authorized the described work under the conditions shown on the permit. | That construction matched the approved plans or reached final approval. |
| Inspection history | Inspection dates, inspection types, results, corrections, and reinspection entries where retained. | That every concealed condition is safe or that no later alteration occurred. |
| Final approval or sign-off | Whether the authority recorded completion of the permitted work. | That the property has no unrelated violations or defects. |
| Certificate of occupancy or equivalent | Whether the authority authorized occupancy or a particular use, where that document is required. | That the current layout or use still matches the authorized conditions. |
| Code, zoning, or enforcement file | Open violations, notices, stop-work orders, enforcement actions, variances, or unresolved use issues. | That no issue exists outside the searched agency or parcel identifier. |
Step 1: Identify the correct authority and identifiers
Confirm the municipality or county that controls permits for the property, not merely the mailing address shown in a listing. A property near a city boundary may have a postal address in one place and permitting jurisdiction in another. In some areas, a county handles building permits while a municipality handles zoning or occupancy records.
Have the street address ready, including unit or suite information. Also obtain the parcel, tax-lot, block-and-lot, assessor, or legal-description number if available. Older files may be indexed under a former address, subdivision lot, or parcel number rather than the current street format.

Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Use the authority’s official website or telephone number to ask:
- Which office controls building permits for this parcel?
- Are building, electrical, plumbing, mechanical, fire, zoning, and occupancy records held separately?
- What date range is searchable online, and what older material is archived?
- Which identifiers and documents are required for a records request?
- Are viewing, copying, staff-research, or certification fees charged?
- Are requests handled online, by email, in person, or through a public-records process?
Step 2: Request the complete construction record
Ask for both the record index and the underlying documents. A portal may show only a permit number and status while the plans, correction notices, inspection entries, and final sign-off are stored elsewhere.

- Inspection dates, inspection types, results, correction notices, and reinspection records.
- Final inspection approval, completion certificates, or equivalent sign-offs.
- Certificates of occupancy, completion, or permitted-use documentation.
- Open code, zoning, building, fire, or property-maintenance violations.
- Stop-work orders, enforcement actions, liens, or unresolved conditions tied to the work.
- Records for separate systems or trades when the project involved more than one permit.
A concise written request creates a useful paper trail:
Please provide the available building, trade, zoning, occupancy, inspection, and enforcement records for the property at [street address], including parcel or lot number if listed. I am seeking applications, issued permits, approved scopes and plans, inspection history, final approvals, certificates of occupancy or equivalent records, and open violations or enforcement matters. Please advise if older files, alternate parcel numbers, or separate agency systems must be searched.
The bracketed address and parcel terms are variables to replace before sending; they are not official wording required by every jurisdiction.

Make a list of every material change disclosed by the seller or visible at the property. Typical entries include an extension, enclosed porch, attic or basement conversion, garage conversion, second kitchen, added bathroom, deck, retaining wall, structural opening, roof alteration, solar installation, or change from single-family to multi-unit use.
For each project, record the claimed date, the permit application date, issuance date, approved scope, inspection entries, final approval, occupancy documentation, and current physical evidence. A permit application or issuance is not proof that the work was completed or passed final inspection.
| Comparison | Question to answer | Warning sign |
|---|---|---|
| Seller’s description versus permit scope | Does the authorized work match the addition, room count, floor area, plumbing, electrical, or structural changes you can see? | The visible project is larger or materially different than the permit description. |
| Application versus issued permit | Was the application approved and a permit actually issued? | Only an application appears, or the status is withdrawn, expired, denied, or unclear. |
| Inspection entries versus final approval | Do the listed inspections show completion and approval? | Inspections are missing, failed without a recorded pass, or remain open. |
| Occupancy or use record | Is the current use, unit count, or converted space authorized where required? | The property is marketed as a separate unit or habitable area without corresponding use documentation. |
| Enforcement status | Are violations, stop-work orders, or zoning cases closed? | An open matter remains attached to the parcel or project. |
| Physical condition | Does an independent inspection find conditions consistent with the permitted work? | Construction quality, moisture, structure, fire separation, or systems raise questions not answered by the file. |
Step 4: Compare the file with the seller’s information
Request the seller’s completed disclosure forms and ask for permits, approved plans, invoices, warranties, contractor information, and final sign-offs for material work. Disclosure duties and forms vary by jurisdiction, so do not assume a seller’s form covers every possible defect or permit issue.

Compare the seller’s answers with the official record, but do not treat either source as infallible. A seller may not know about an old alteration, while an agency file may be incomplete or summarized. Ask targeted follow-up questions when dates, room counts, unit numbers, or project descriptions conflict.

Washington’s displayed disclosure statute text, for example, asks about additions or remodeling and whether permits and final inspections were obtained, but identifies January 1, 2027 as its effective date. As of October 17, 2026, that future-effective text should not be described as the current rule. Verify the law and form in force where the property is located.
Step 5: Treat a blank online search as inconclusive
No result may mean no permit, but it may also reflect an address-format difference, a parcel-number change, a separate trade-permit system, an older paper archive, a retention limit, or an index that shows only summary information. New Jersey’s Historic Preservation Office notes that permits may not exist in the records for some older properties and that municipal files may contain only summaries; detailed work can require locating original archived permits.
If the portal is blank, ask the authority to search:
- Former street names, renumbered addresses, and alternate abbreviations.
- Parcel, block-and-lot, assessor, subdivision, or legal-description identifiers.
- Separate building, electrical, plumbing, mechanical, fire, planning, or zoning databases.
- Paper files, microfilm, scanned archives, and predecessor municipalities.
- Records under a prior owner, developer, or contractor name when that search is allowed.
Ask the official to explain what a blank result means in that system and to state whether the search covered archived material. Keep the response with your transaction file.

Step 6: Arrange an independent physical inspection
Records research and a property inspection answer different questions. The file addresses authorization and administrative history; the inspection addresses observable condition within the inspector’s agreed scope. Commission the inspection before your contractual inspection deadline and tell the inspector about additions, conversions, unusual wiring, structural changes, or discrepancies in the permit file.
Many standard inspections do not investigate illegal construction or outstanding building or zoning violations. Miami-Dade County warns: “Many home inspections do not check for illegal construction or outstanding building or zoning code violations.” Ask in writing what the inspection includes and excludes.
A standard inspection is not a legal-compliance certificate. NSW Government guidance states: “A building inspection report should not be used as a certificate of compliance for any law, warranty or insurance policy against future problems.” The same practical limitation applies broadly: an inspector may not see concealed work, may not research permit records, and cannot guarantee future performance.
Use a specialist when the evidence warrants it:
- A structural engineer for removed walls, foundation movement, large openings, additions, or settlement concerns.
- A code-compliance consultant for an unpermitted conversion, unresolved violation, or complicated history.
- A licensed electrical, plumbing, mechanical, or fire professional for trade-specific concerns.
- An architect or designer when current plans, legal use, egress, or an intended remodel must be evaluated.
How to handle discrepancies before you are committed
Do not silently accept a mismatch between the house and its records. Ask the seller, authority, and relevant professionals separate questions so each answer is documented.
Recommended Free Tools
- Describe the discrepancy precisely: for example, a finished lower level appears to contain a bedroom and kitchen, while the file lists only storage improvements.
- Ask the authority whether the record is complete, whether the use is permitted, and what corrective process applies locally.
- Ask the seller for plans, permits, final approvals, contractor records, and an explanation of when the work occurred.
- Ask a qualified professional to assess safety, code implications, likely scope of correction, and whether concealed work must be opened.
- Give your lawyer, lender, insurer, and other transaction professionals the documented facts before deadlines expire.
- Use the contract’s inspection, disclosure, financing, or title provisions according to local law and your adviser’s guidance.
Possible outcomes include obtaining missing documentation, having the seller complete a local legalization or correction process, adjusting the transaction terms, limiting the accepted use, or declining to proceed. The legal and financial consequences depend on the jurisdiction, the type of work, and whether an order, violation, or safety issue exists.

Jurisdiction-specific cautions
Connecticut
Connecticut General Assembly Chapter 392 (2026) specifically directs prospective buyers to consult the municipal building official about permits and certificates of occupancy. That is state-specific guidance, not a universal national procedure; follow the municipality’s own records and terminology.
Miami-Dade County
Miami-Dade’s residential buying guidance separates permit records from inspections and cautions that many home inspections do not check illegal construction or outstanding building or zoning violations. A county record search and a physical inspection should therefore be commissioned as separate tasks.
New Jersey
For older properties, New Jersey Historic Preservation Office guidance explains that permits may be absent from surviving records and that municipal files may contain only summaries. Ask whether original archived permits or predecessor records can be reviewed before concluding that no permit existed.

NSW guidance on pre-purchase inspection reports emphasizes that an inspection report is not a certificate of legal compliance or a guarantee against future problems. If the property is in NSW, use the state and local terminology for approvals and engage the appropriate certifier or specialist for legality questions.
Questions to ask before removing contingencies
- Have all visible additions, conversions, and major remodels been matched to a permit or documented approval?
- Does each permit show issuance, required inspections, and final approval rather than only an application?
- Is the current number of dwelling units and the advertised use authorized?
- Are any violations, stop-work orders, zoning cases, or occupancy issues open?
- Could a missing record be explained by an archive, alternate identifier, or separate agency system?
- Has an independent inspector evaluated the physical condition, with specialists added where needed?
- Have your lawyer, lender, insurer, and contract deadlines been informed of unresolved uncertainty?
- Do you have written answers and copies of the records, not just an informal verbal assurance?
Practical record-keeping
Save the portal results, downloaded permits, correspondence, plans, inspection reports, seller disclosures, and notes of telephone calls. Record the date of each search, the identifier used, the office contacted, and the employee’s explanation of any limitation. If an authority says that a file is unavailable or incomplete, preserve that response and ask what additional search or request is possible.
Permit history is one part of due diligence. The most reliable decision combines the local authority’s complete available record, the seller’s documented disclosures, an independent inspection, and specialist advice where the work or uncertainty requires it.
