Yes, your project could be affected if it is in England and you submit a qualifying building-control application on or after 1 October 2026. The levy targets certain new homes, purpose-built student accommodation (PBSA) bedspaces and works that create residential floorspace. Liability depends on the application date, proposed use, client, local-authority area, chargeable floorspace, land status and any exemption or exclusion that can be evidenced.
The collecting local authority decides the amount, issues a liability or no-charge notice and must receive the full levy before it can issue the relevant completion certificate. This guide gives a practical screening method for developers, contractors, housing providers and professional teams.

Start with these six screening questions
Before preparing a detailed estimate, answer the following questions from the project records. A “yes” to the first four usually means you need a formal levy assessment; the final two determine whether the charge is reduced or removed.
| Question | What to check | Why it matters |
|---|---|---|
| Is the site in England? | Confirm the building’s geographic position and whether it crosses an international UK border. | The levy described here is an England-only charge. |
| When will the building-control application be submitted? | Record the date the application or initial notice is validly submitted. | Qualifying applications from 1 October 2026 may be liable; qualifying applications submitted earlier remain outside the levy, subject to the rules. |
| Will the works create chargeable residential space? | Identify new dwellings, PBSA bedspaces and residential floorspace created by a change of use or other works. | The levy is not a charge on every project described as “residential”. |
| Who is named as the client? | Read the building-control application or initial notice and identify the legal client. | The named client is responsible for payment when a levy is due. |
| Does the applicant or use qualify for an exemption or exclusion? | Check social-housing status, supported-housing status and the accommodation type against the statutory definitions. | Exemptions and exclusions are narrow and require evidence. |
| Is the site qualifying previously developed land? | Gather evidence of the site’s lawful previous development and test it against the statutory definition. | The applicable rate is half the standard rate for qualifying previously developed land. |
Keep a written decision log. If a project changes use, applicant, footprint, application route or submission date, repeat the assessment rather than relying on an earlier conclusion.

What the Building Safety Levy is
The Building Safety Levy is a charge on specified new residential development in England. Its revenue is intended to fund building-safety work. The local authority in whose area the building sits collects the charge, even where another building-control route is used.
The Ministry of Housing, Communities and Local Government (MHCLG) guidance states: “The levy will come into operation on 1 October 2026.” The guidance was published on 10 July 2025 and updated on 2 July 2026 following draft 2026 amendment regulations laid before Parliament. The Building Safety Levy (England) Regulations 2025 were made on 19 November 2025. For a live project, confirm the operative regulations and the current rate schedule before committing to a budget.
The levy is assessed through the building-control process. It is separate from planning permission, building-regulation fees and any other local-authority charge. A planning consent does not establish that a levy is payable, and a building-control application does not automatically make every residential scheme chargeable.

England is the relevant jurisdiction
The rules covered by this guide apply to qualifying development in England. A building wholly in England can fall within the English levy when the other conditions are met.
If a building itself spans the England–Wales or England–Scotland boundary, the English levy does not apply to that cross-border building under the guidance. A project located wholly in Wales or Scotland is outside this English charge. Scotland has announced a separate levy planned from 1 April 2027; that is a different regime and should not be substituted for the English assessment.
New dwellings and PBSA bedspaces
The principal in-scope uses are new dwellings and new bedspaces in purpose-built student accommodation. The relevant application must relate to works creating at least one dwelling or PBSA bedspace, and all other charging conditions must also be satisfied.
“Residential” is not a sufficient description by itself. Establish exactly what the works create, which rooms and areas are included, and whether the accommodation is a listed excluded category. Use the drawings, accommodation schedule, specification and building-control description consistently so that the floorspace calculation matches the approved works.

Some changes of use to residential purposes and other works that create residential floorspace can be captured. For example, a conversion may need assessment even where there is no new-build shell. The treatment depends on the statutory conditions, the resulting use and the areas treated as chargeable floorspace.
Do not assume that a conversion is automatically exempt because the existing structure is old, or automatically liable because the finished building will contain homes. Ask the collecting authority or building-control professional to confirm how the specific works are classified.

Accommodation categories listed as excluded
The official guidance identifies exclusions that include:
- school accommodation for students;
- accommodation for victims of domestic abuse;
- hospitals;
- children’s homes;
- hotels and hostels;
- care homes and hospices;
- secure residential accommodation;
- almshouses;
- temporary accommodation for homeless people; and
- armed-forces accommodation.
These labels are not enough on their own. Each category has conditions in the legislation or guidance. Retain the operating model, provider status, tenancy or placement arrangements and design information that demonstrate why an exclusion applies.
Does the levy apply to a project submitted before October 2026?
Applications submitted before 1 October 2026
A qualifying application submitted before 1 October 2026 remains outside the levy. The same treatment generally continues for later variation applications relating to those works. Preserve the original submission evidence, validation correspondence and application reference; a later argument about the date is much harder without an auditable record.
Applications submitted on or after 1 October 2026
A qualifying application submitted on or after 1 October 2026 may be liable when the other charging conditions are met and no exemption or exclusion applies. The date to record is the building-control application or initial-notice submission date, not the date a planning permission was granted, a contract was signed or construction started.
Rejected applications that are resubmitted
If an application submitted before the start date is rejected for failing required standards and is resubmitted on or after 1 October 2026, the resubmission can be liable. Treat it as a new date risk: document the rejection, identify whether the resubmission covers the same works, and obtain a fresh levy view before proceeding.
How to protect the date evidence
- Save the electronic submission receipt or stamped initial notice.
- Record the application reference and the date accepted as valid.
- Keep correspondence showing whether an application was rejected, withdrawn or replaced.
- Distinguish a variation to an existing qualifying application from a new application for different works.
Who pays the Building Safety Levy?
The person identified as the client in the building-control application or initial notice is responsible for payment where a charge is due. This is a legal identification issue, not simply the party funding the works under a construction contract.
Check the client name against the development agreement, land ownership, funding arrangements and corporate structure. If a special-purpose company is named in the application, that company may be the liable client even where a parent, investor or contractor supplies the money. Correct an inaccurate client entry through the appropriate building-control process rather than assuming the authority will infer the intended payer.
The rules also cover applications handled by the Building Safety Regulator, as well as initial notices submitted by Registered Building Control Approvers. Changing the building-control route does not move the collecting authority: the local authority remains responsible for levy administration for buildings in its area.
How to calculate the levy for your development
Use the local authority’s current rate
Each local authority has a rate per square metre. Rates vary by area and are set out in the current Schedule 3 rate information. Do not use a figure copied from an old article, an early feasibility spreadsheet or another authority’s schedule.

For a building spanning two local-authority areas, the applicable authority and rate are determined by where the greater part of the building sits. Confirm the boundary position with the site plan and measured building footprint, not merely the registered address or the location of the main entrance.
Establish chargeable floorspace
The calculation uses chargeable floorspace under the regulations. Start with the areas created by the works and then apply the statutory rules on use, exclusions and other deductions. The description “gross internal area” or “net internal area” is not, by itself, the levy answer.
Prepare a measured schedule that identifies each floor, unit type, common area, circulation space and non-residential area. Mark the areas you believe are chargeable and explain every exclusion. Give the same schedule to the design team, cost consultant, building-control body and client so that drawings and levy information do not diverge.
Apply land-status and development-rights adjustments
Qualifying previously developed land attracts half the standard rate. Development proceeding under permitted development rights also uses the previously-developed-land rate under the guidance. The discount is not available merely because a site is in an urban area, contains a derelict building or has previously been used; the statutory definition and evidence must be satisfied.
Collect historic plans, planning records, photographs, demolition information and land-use evidence where relevant. Ask the authority to confirm what it will accept before relying on the discount in the funding model.

Illustrative calculation method
The arithmetic can be expressed as:
Levy due = chargeable floorspace (m²) × applicable local-authority rate (£/m²)
For qualifying previously developed land, the applicable rate is half the standard rate. This formula is only a framework: the authority must apply the statutory definitions, exclusions, rounding and notice procedure to the project facts.
| Input | Evidence to assemble | Common error |
|---|---|---|
| Local authority | Site plan, address, boundary and building footprint. | Using the authority named in a postal address when most of the building lies elsewhere. |
| Rate | Current Schedule 3 entry and its effective date. | Reusing a historical or neighbouring authority rate. |
| Chargeable floorspace | Measured area schedule tied to the submitted drawings. | Multiplying total gross area without testing exclusions. |
| Land status | Records demonstrating the statutory previously-developed-land condition. | Assuming any redevelopment site qualifies. |
| Use | Accommodation schedule, management model and use classification. | Counting excluded accommodation as ordinary dwellings or PBSA. |
Is my social housing or supported housing project exempt?
Exempt persons
An exempt person includes a non-profit registered provider of social housing and a wholly owned subsidiary of such a provider. Verify the provider’s legal status and ownership at the relevant time. A joint venture does not qualify as an exempt person merely because one participant is a registered provider; each party must itself be an exempt person for the stated exemption to apply.
Qualifying social and supported housing
The guidance also describes exemptions for qualifying social housing and supported housing. These are category-based exemptions with statutory conditions. Check both the applicant and the accommodation: a project can have a social purpose without meeting the legal definition, while a qualifying scheme may need particular tenure, allocation, support or management evidence.

Evidence file
Prepare an exemption file before the building-control application or commencement information is submitted. It should normally include:
- provider registration and corporate-ownership documents;
- tenure and rent or allocation information;
- the supported-housing description and support arrangements, where relevant;
- the accommodation schedule and plans;
- operator, commissioning or funding documents; and
- a short legal rationale identifying the exact exemption or exclusion relied on.
Submit the evidence in the format requested by the building-control body or collecting authority. Keep the source documents available in case the authority checks the claim.
What happens after commencement?
Levy information and authority notice
The client provides levy information through the building-control process, including at commencement. The collecting authority then issues either a levy liability notice stating the amount due or a notice of no charge.
Under the developer guidance, the local authority normally issues the notice within five weeks after receiving the commencement notice with levy information. The period can be eight weeks when a spot check is being conducted. A request for further information or an agreed extension can affect the timing.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsPayment before completion
If a charge is due, the full levy must be paid before the relevant completion certificate can be issued. Build this dependency into the programme: a completed building may still lack its certificate if the levy notice, evidence review or payment is unresolved.
Do not leave payment to the final day. Confirm the authority’s payment instructions, allow time for bank processing and obtain written confirmation that the account is settled before requesting the certificate.
Reviewing a disputed decision
If the client believes the authority has wrongly decided that the levy applies, or has calculated the amount incorrectly, the client can ask the collecting authority to review its decision. Send the application date, use analysis, floorspace schedule, rate source, land-status evidence and exemption documents with the review request. Identify the exact line or assumption disputed rather than making a general objection.

| Submit before or after 1 October 2026 | Is the earlier application valid and does the later work remain a variation? | A new qualifying application after the start date may become liable. |
| New build or conversion | What residential floorspace is created and how is the resulting use classified? | Some conversions are in scope; classification must be tested against the rules. |
| Standard site or qualifying previously developed land | Can the statutory land-status evidence be produced? | The qualifying brownfield rate is half the standard rate. |
| Ordinary homes or excluded accommodation | Does the operating and legal model meet an exclusion? | Some listed accommodation categories are excluded, but labels alone are insufficient. |
| Single-authority or boundary site | Where is the greater part of the building? | The responsible authority and rate follow the greater part of the building. |
| Private applicant or exempt provider | Who is the named client and does the entity meet the exemption? | The liable party and possible exemption change with verified status. |
Do not redesign solely to avoid a charge without checking planning, building-regulation, fire-safety, funding and operational consequences. The levy is one input to the project decision, not a substitute for a compliant design.

A practical assessment workflow
- Freeze the project facts. Record the site, proposed use, number of dwellings or PBSA bedspaces, works description, building-control route and intended client.
- Confirm the jurisdiction. Map the building footprint and identify any England–Wales or England–Scotland boundary issue.
- Record the application date. Preserve submission and validation evidence, and identify whether the proposal is an existing application, variation, rejection or resubmission.
- Classify the accommodation. Test dwellings, PBSA and any change of use against the detailed exclusions.
- Measure the floorspace. Produce a room-by-room or floor-by-floor schedule tied to the drawings and flag proposed deductions.
- Identify the collecting authority and rate. Use the authority where the greater part of the building lies and check the current Schedule 3 rate.
- Test land status. Gather evidence for previously developed land and apply the half-rate only if the statutory test is met.
- Test exemptions. Verify provider status, ownership, tenure, support and accommodation evidence; do not rely on a project description alone.
- Submit consistent information. Ensure the client, use, floorspace and exemption position match across the building-control application, commencement information and supporting documents.
- Track the notice. Diary the expected five-week period, the possible eight-week spot-check period and any information deadline.
- Resolve disputes early. Request a review with a documented calculation or exemption case if the liability notice is wrong.
- Clear payment before certification. Pay the full amount due, obtain confirmation and allow for processing before applying for the relevant completion certificate.
Common mistakes and how to avoid them
Using the planning date
Planning submission or approval does not determine levy liability. The critical date is the building-control application or initial notice, so keep both timelines visible in the project programme.
Assuming a variation resets the date
A later variation to an existing qualifying application submitted before 1 October 2026 remains outside the levy under the guidance. A substantially new or replacement application may not. Ask the building-control body to classify the submission before filing it.
Calling every conversion “brownfield”
Previously developed land is a statutory category. A former industrial, commercial or residential use may provide evidence, but the discount still needs to be tested and documented.

Relying on an organisation’s social mission
An organisation’s objectives or charitable status do not by themselves establish an exempt person. Confirm registered-provider status, wholly owned subsidiary status or the precise qualifying housing category.
Leaving the notice until practical completion
The levy notice and payment are part of the completion pathway. A late submission, unresolved spot check or unpaid amount can prevent the relevant completion certificate even when the physical works are finished.
Using an obsolete rate
Rates vary by local authority and can be updated. Attach the current Schedule 3 entry and date to the estimate and recheck it when the application, commencement or notice is issued.

A contractor or consultant carrying out an early assessment should ask for the following before giving a cost or programme opinion:
- the site plan showing the local-authority boundary;
- the current building-control application or initial notice and submission evidence;
- the client’s exact legal name and corporate structure;
- planning and design information describing the resulting use;
- the dwelling and PBSA-bedspace schedule;
- measured chargeable-floorspace calculations;
- evidence supporting previously developed land;
- social-housing, supported-housing or other exemption evidence;
- the intended commencement date and building-control route; and
- the programme allowance for the authority notice, payment and completion certificate.
Where any item is missing, label the estimate as provisional and state the fact that could change the result. A transparent “not yet confirmed” assumption is safer than presenting a precise figure unsupported by the project records.
Bottom-line decision rule
Treat the project as potentially liable when it is in England, involves qualifying residential or PBSA development, and the relevant building-control application is submitted on or after 1 October 2026. Then determine the client, local rate, chargeable floorspace, land discount and any evidenced exemption or exclusion. Obtain the collecting authority’s notice and settle any charge before seeking the relevant completion certificate.
