Chicago calls a zoning “variance” a variation. A variation asks the Zoning Board of Appeals (ZBA) to relieve a specific rule because of a property-specific practical difficulty or hardship. A zoning map amendment (rezoning) asks the City to change the property’s zoning district through the Zoning Administrator and City Council. Choose the route that matches the problem before preparing plans, notices, and fees.
The 2026 code lists a $500 application fee for a variation and $1,000 for a zoning map amendment. Neither process has a guaranteed total timeline in the current official materials; completeness, notice, hearing calendars, revisions, and (for a rezoning) City Council scheduling determine how long the case takes.

Variation or map amendment: which Chicago process fits?
The decision is whether your project needs relief from one or more requirements on the existing zoning district, or whether the district itself must change.

A rezoning is not a hardship waiver. If the requested result can be achieved by changing one measurable standard—such as a setback, lot-coverage limit, or dimensional requirement—test the variation route first. If the proposed use or intensity is not allowed in the current district, or the project needs a different district’s overall package of permissions, evaluate a map amendment instead.

Chicago’s code and forms use the word variation. You may hear “variance” in ordinary conversation, but use “variation” on the City’s forms and in correspondence.
Before you file: define the relief and verify the property
Confirm the existing zoning and the exact request
Start with the property’s current zoning district and a written description of the rule or district change you seek. A vague request creates avoidable completeness questions and weakens the findings or district analysis. Identify the affected lot lines, existing structures, lawful nonconformities, proposed construction, and every dimensional or use consequence.
- For a variation, state the precise code requirement, the amount of relief, and the plan element that cannot comply.
- For a map amendment, name the requested district and explain why that district—not merely a single exception—matches the proposed development.
- Record the parcel address, PIN or other City identifying information used on the application, and the legal owner or authorized agent.
Use a current survey and dimensioned plans
Obtain a current survey and prepare plans that show the dimensions relevant to the request. Include existing and proposed building footprints, lot lines, setbacks, height, floor area, parking, access, and other information needed to test the applicable standards. The searched official materials do not establish one universal plan checklist for every variation, so confirm the current, case-specific checklist with the ZBA before filing.

Check ownership and possible notice recipients
Notice depends on owners within the applicable distance from the property lines. Assemble current ownership and tax-record information early so mailing lists can be checked before the filing date. Keep a record of the addresses used, the date notices are sent, and any returned mail.
Check for City debt before a rezoning filing
Certain map-amendment applications are incomplete while the applicant, owner, or a qualifying holder of at least a 7.5% interest has unresolved City debt. Resolve or document the status of any such debt before submission; otherwise the application may not move into substantive review.
How to apply for a Chicago zoning variation
1. Frame the practical difficulty or hardship
The ZBA variation application and findings-of-fact materials ask why strict compliance would create a practical difficulty or particular hardship. Tie the answer to conditions unique to the property, not to a preference for a larger building or a more profitable project.
Useful evidence can include an irregular lot shape, unusual dimensions, an existing nonconformity, site constraints, or another condition outside the applicant’s control. Explain the measurable rule, the consequence of compliance, and the minimum relief needed. Address whether the condition was created by a person who presently has an interest in the property.

The official ZBA Variation Proposed Findings of Fact (Variation 8/2024 Rev.) warns: “Please note that failure to submit clear and comprehensive answers may result in a delay of your hearing and/or dismissal or denial of your case.” Treat every finding as a question that needs a specific, document-supported answer.
2. Assemble the application package
Use the current ZBA variation application and findings-of-fact materials. A practical package normally includes the completed form, findings narrative, survey, dimensioned plans, photographs, ownership information, and any supporting exhibits that make the hardship understandable. Because the official materials do not publish one universal checklist for every variation, ask the ZBA for the checklist applicable to your case before you finalize drawings.
- Describe existing conditions separately from proposed conditions.
- Mark the exact code standard and requested relief on plans.
- Use consistent dimensions and labels across the survey, plans, narrative, and photographs.
- Explain why the relief is limited to what the property requires.
- Answer whether the hardship was created by a current property-interest holder rather than leaving the question implicit.
3. File with the Zoning Board of Appeals
Chicago Municipal Code §17-13-1102 states: “An application for a variation must be filed with the Zoning Board of Appeals.” Submit the required form, supporting materials, and fee in the format and number currently required by the ZBA. Keep a complete, date-stamped copy of everything submitted.
4. Pay the fee and budget for possible additional review
The 2026 City fee table lists $500 for a variation. The fee is nonrefundable. Additional review fees may apply depending on the review method and the area of work, so confirm the amount due for your specific filing before payment.

Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →5. Complete notice and hearing requirements
A variation requires a ZBA hearing. General written notice for a variation goes to owners within 100 feet of the property lines. For applications other than administrative adjustments, the code limits when required written notices may be sent: they are provided no more than 30 days before filing. The code also requires published and posted notice for the hearing.
Do not mail notices on an assumed schedule. Confirm the current notice form, delivery method, publication instructions, posting location, and proof-of-service requirements with the ZBA. Calendar the filing date, notice deadline, hearing date, and any correction period so a missed notice does not force a continuance.
6. Prove every applicable approval standard
The applicant carries the burden. Section 17-13-0106 of the current Chicago Municipal Code states: “The burden of demonstrating that an application complies with applicable review and approval criteria is on the applicant.” Your narrative should therefore connect each fact to a criterion:

- Identify the zoning requirement from which relief is requested.
- Describe the property-specific condition producing the practical difficulty or particular hardship.
- Show why strict compliance, rather than the proposed use itself, creates the problem.
- Explain why the proposed variation is reasonable and no broader than necessary.
- Address whether the condition was created by a person presently holding an interest in the property.
- Describe any relevant effects shown by the plans, including access, parking, setbacks, height, or neighboring conditions.
7. Attend the ZBA hearing
Bring the filed plans and findings, be prepared to identify the requested dimensions, and answer questions from staff or the Board. If the Board or staff asks for clarification or revisions, obtain the submission deadline and required format in writing. The official form does not promise a decision date, so a hearing date is not the same as a guaranteed approval date.

1. Define the proposed district and development
A map amendment changes the zoning district rather than waiving a single standard. Compare the existing and requested districts before preparing the narrative. At minimum, analyze permitted uses, floor-area ratio (FAR), density, off-street parking, setbacks, building height, and other dimensional effects relevant to the project.
Explain the development that the requested district is intended to accommodate. The City needs to understand both the district change and the physical result it would enable; a district name without a development analysis is unlikely to answer the review questions.
2. Determine whether the filing is Type 1 or Type 2
Under Chicago Municipal Code §§17-13-0302–0303, a Type 1 map amendment is required in either of these situations:
- The proposed district permits a FAR at least twice the FAR allowed by the existing classification.
- The rezoning moves from a district without maximum height limits to a district with maximum height limits.
Any other map amendment is Type 2, although an applicant may elect Type 1. Type 1 requires a zoning and development analysis covering FAR, density, off-street parking, setbacks, and building height, together with drawings, photographs, or plans. Confirm the classification against the current code and the proposed districts before filing; choosing the wrong type can create a completeness problem.
3. Identify who may propose the amendment and where to file
The owner, an authorized agent, the Mayor, the City Council, or the Zoning Administrator may propose a map amendment. File the application with the Zoning Administrator. Chicago Municipal Code §17-13-0303-B states: “Zoning Map Amendment applications must be filed with the Zoning Administrator.” Once the application is complete, it is transmitted to the City Clerk, who files it with the City Council at its next regular meeting.
4. Prepare the required form, analysis, and plans
Use the required map-amendment form and include the information and number of copies or electronic files currently required. For a Type 1 filing, make the district comparison explicit and support it with drawings, photographs, or plans. For a Type 2 filing, provide enough information for the City to verify the proposed district, the development concept, and the effects of the change.

- Explain how the requested district relates to surrounding development and the subject property’s conditions without relying on unsupported conclusions.
- Reconcile the application narrative with the survey, plans, and photographs.
5. Pay the fee and clear completeness issues
The 2026 fee table lists $1,000 for a zoning map amendment. The fee is nonrefundable. Check for unresolved City debt involving the applicant, owner, or qualifying 7.5%-plus interest holder before submission, because the code can treat the application as incomplete while that debt remains unresolved.
6. Provide map-amendment notice
Written notice generally goes to owners of the subject property and all owners within 250 feet of the property lines. For applications other than administrative adjustments, required written notice may be provided no more than 30 days before filing. The code also requires posted notice and published notice for the City Council committee hearing.
Required posted signs must be installed within five days after filing and remain until the hearing. Confirm the current sign specifications, placement, publication, mailing method, affidavit or proof requirements, and hearing notice language with the City. Photograph the installed sign and retain delivery and publication records with the application file.
7. Move through City review and the legislative hearing
The Zoning Administrator reviews the proposal and forwards a recommendation to the City Council Committee on Zoning, Landmarks and Building Standards before its public hearing. The City Council then acts on the amendment. Build time into the schedule for staff comments, revised plans, notice corrections, committee calendars, and the Council’s meeting schedule. The current official materials do not provide a reliable universal timeline.

Pre-filing checklist
- Confirm the current zoning district and decide whether you need a variation or a new district.
- Write the exact requirement to be relieved, or identify the requested map-amendment district.
- Obtain a current survey and dimensioned plans that match the written request.
- For a variation, answer every applicable ZBA finding, including the practical-difficulty and hardship questions.
- For a rezoning, compare existing and proposed districts for use, FAR, density, parking, setbacks, height, and other material effects.
- Determine whether the map amendment is Type 1 or Type 2 under §§17-13-0302–0303.
- Check ownership and tax-record information for the 100-foot or 250-foot notice area.
- Check for unresolved City debt affecting a map-amendment application.
- Verify the current form, filing format, copy or electronic-file requirements, fee, and payment method with the City.
- Calendar written notice, publication, posting, filing, hearing, and—in a rezoning—the City Council steps.
- Keep a complete copy of the application, proof of delivery, photographs of posted signs, and all staff correspondence.
Common failure points and how to prevent them
Calling a district change a hardship
A variation does not substitute for a district change. If the project depends on uses or intensity allowed only in another district, prepare a map-amendment analysis rather than trying to describe the entire project as a dimensional hardship.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsUsing a general business reason instead of a property condition
“The project would be more profitable” does not identify a practical difficulty created by the property. Tie the requested relief to measurable site conditions and explain why the condition is outside the applicant’s control.

Leaving findings unanswered
The ZBA form expressly warns that unclear or incomplete answers can delay a hearing or lead to dismissal or denial. Use a numbered response that follows the form, then cross-reference the plan sheet or exhibit supporting each answer.
Underestimating notice work
Notice is a procedural requirement, not a courtesy mailing. Incorrect ownership records, late delivery, missing publication, an improperly posted sign, or inadequate proof can affect the hearing schedule. Confirm the current instructions with the filing authority and retain evidence of compliance.
Assuming the fee buys a decision date
The listed fee is an application charge, not a service-level guarantee. Completeness reviews, corrections, notice periods, hearing calendars, revisions, and City Council scheduling control the actual schedule.

Filing an incomplete rezoning application
Use the required form and number, include the fee, resolve debt-related completeness issues, and provide the district comparison and development materials required for the selected type. A complete package can move to City Clerk and Council steps; an incomplete one may not.
When professional zoning help is worthwhile
Consider Chicago zoning counsel or another qualified zoning professional when the hardship analysis is uncertain, ownership or notice records are complicated, the requested relief combines several standards, or a rezoning requires a Type 1 development analysis and legislative strategy. The City’s variation form itself recommends consulting a zoning attorney when the hardship criteria or filing strategy is uncertain. Professional assistance does not shift the burden of proof: the applicant remains responsible for demonstrating compliance with the applicable criteria.
Currentness and verification before filing
The fee amounts, forms, code provisions, notice instructions, and hearing calendars can change. The figures and procedures above reflect the City of Chicago materials current on October 17, 2026 UTC, including the 2026 fee table and the Variation Proposed Findings of Fact marked “Variation 8/2024 Rev.” Before filing, verify the live Chicago Municipal Code, current forms, fee schedule, notice instructions, and the hearing date with the responsible City office.
