How Highway Right-of-Way Acquisition and Relocation Assistance Work in Texas

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a Texas highway project needs private land, the acquiring agency normally follows an appraisal-and-offer process before seeking possession. The owner is paid for the property interest acquired, while eligible people who must move may receive separate relocation counseling and financial assistance.

The exact administrator can vary by project, funding and whether TxDOT or a local public agency is acquiring the parcel. The steps below describe TxDOT’s general process and the timing that most affects landowners, tenants and businesses.

What “right of way” acquisition means

Highway right of way is the land or property interest needed to build, widen, operate or maintain a transportation facility. A project may require an entire parcel, a strip along the frontage, a temporary construction easement, access rights or another defined interest. The agency does not simply pay a single generic amount for “the project.” The written offer identifies the parcel and the specific interest being acquired.

TxDOT describes the governing framework in its Right-of-Way and Other Land Acquisition manual. Applicable federally funded projects must follow the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (the Uniform Act), which requires formal appraisal, noncoercive negotiations and consistent treatment. Texas eminent-domain authority is primarily found in Property Code Chapter 21. A local public agency may handle the acquisition under its own agreement with TxDOT, so notices and contacts can differ even when the general protections are similar.

The acquisition process, step by step

1. The agency identifies the needed property interest

During design and right-of-way planning, the agency determines which parcels and interests are needed. Owners should receive information about the project’s interest in the property and the acquisition procedures. A partial taking can affect driveways, parking, drainage, fencing, utilities, landscaping or the usefulness of the remaining land, so the plan and legal description matter before value is discussed.

2. A certified appraiser evaluates the property

TxDOT’s process uses a written appraisal prepared by a certified appraiser. The appraisal supports the offer and should analyze the property interest being acquired. For a partial taking, the analysis must address not only the value of the part acquired but also any compensable damage to the remainder. Owners can provide relevant information about the property, such as leases, improvements, access conditions, comparable transactions or business impacts, and should keep copies of everything submitted.

3. TxDOT sends a written initial offer

The initial offer is sent by certified mail, return receipt requested. Under TxDOT’s bona fide offer guidance, it identifies the amount offered, the parcel and interest involved, and other required information. For a partial acquisition, look for separate treatment of the property taken and damages to the remainder.

Delivery of the initial offer normally starts negotiations and is generally the date used to determine relocation-assistance eligibility. That date is important even when the owner does not agree with the appraisal. Read the offer promptly, verify the legal description and ask the named right-of-way representative to explain anything missing or unclear.

4. The parties exchange information and negotiate

Negotiation is intended to be noncoercive. You may present information that could affect value and ask the agency to review it. The agency may clarify the appraisal, correct factual errors or make a revised offer. A disagreement does not automatically end negotiations, and accepting or rejecting an offer is not the same as deciding whether relocation benefits are available.

5. A final offer is made before an eminent-domain filing

TxDOT’s manual describes a bona fide offer as including a final written offer delivered at least 30 days after the initial offer. The owner must receive at least 14 days to respond to the final offer before an eminent-domain petition is filed. These are process minimums; a project’s correspondence may provide more time. Save the mailing envelope, return receipt and every revision because the delivery dates can affect both negotiations and later procedural questions.

6. If necessary, the agency files an eminent-domain case

Rejecting an offer does not by itself prevent a public entity from acquiring the needed interest. If negotiations do not resolve the matter, the agency may use eminent domain under the applicable Texas procedure. The court process determines compensation; it does not turn the initial offer into an automatic payment.

Initial offer, final offer and court award compared

Stage What it covers Evidence and timing What it is not
Initial written offer The identified parcel and property interest; a partial taking should address the acquired part and potential remainder damages. Based on the agency’s appraisal; certified-mail delivery normally initiates negotiations and is usually the relocation-eligibility date. Not a relocation payment and not necessarily the final amount.
Final written offer The agency’s final purchase proposal for the same defined interest. TxDOT describes delivery at least 30 days after the initial offer, with at least 14 days for the owner to respond before filing a petition. Not proof that the owner has waived the right to contest value.
Special Commissioners’ award Compensation determined after an eminent-domain hearing, including remainder damages where applicable. Three disinterested landowners hear evidence and file an award with the court; deadlines apply for objections. Not necessarily final: either side may object and the case can proceed to trial.

The distinctions in this table come from TxDOT’s written-offer manual and the agency’s July 2023 State Purchase of Right of Way booklet.

How property compensation is separated from relocation help

Payment for the real property interest

The purchase price compensates the owner for the interest acquired. In a whole taking, that may be the parcel. In a partial taking, it may include the value of the strip or easement plus measurable damage to the property left behind. Access changes, loss of parking, altered circulation or reduced utility can be relevant to the remainder, but whether an item is compensable depends on the facts and applicable law. Do not assume that every construction inconvenience is a separate payment.

Incidental ownership and title matters

Closing and title-related items may be handled separately from the land’s appraised value. Ask the acquiring representative which costs the project will pay and what documentation is required. Keep this discussion separate from relocation benefits: a title expense does not become a moving payment merely because both appear in the same acquisition file.

Relocation assistance

Relocation assistance is a separate program for eligible displaced occupants. TxDOT says it may include counseling, help locating a replacement home or business, and financial help for moving and related expenses. There is no universal payment amount in the general materials. Eligibility and the amount or type of benefit depend on the occupant, the occupancy, the move and the project’s applicable rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Who may qualify for relocation assistance and when

TxDOT’s eligibility guidance explains that the determination is individual. Potentially affected groups include lawful residential occupants, businesses, farms, nonprofit organizations and people whose personal property must be moved. A tenant, owner-occupant and business operator can have different documentation requirements and benefits, so request the booklet that matches your situation.

The eligibility trigger

Eligibility normally begins when negotiations are initiated, usually delivery of the initial written offer. TxDOT’s relocation manual also recognizes that an earlier qualifying event can control, such as a notice of intent, a binding voluntary-acquisition agreement or actual acquisition. Tell the relocation counselor about any earlier notice or agreement rather than assuming the offer date is the only possible date.

Notice before a move

Lawful occupants generally must receive at least 90 days’ written notice before they can be required to move. For a residential occupant, comparable replacement housing must be available, and TxDOT describes a separate 30-day notice that specifies the move date. An unusual urgent safety circumstance can involve an exception process. A notice is not the same as a relocation-benefit approval; keep both documents and ask the counselor how they interact.

The warning about moving early

TxDOT’s July 2023 booklet states: “DO NOT MOVE UNTIL YOU HAVE BEEN CONTACTED BY A RELOCATION ASSISTANCE COUNSELOR AND HAVE ESTABLISHED ELIGIBILITY FOR POSSIBLE RELOCATION BENEFITS. MOVING PREMATURELY MAY RESULT IN FORFEITURE OF THESE BENEFITS.” The warning concerns possible eligibility, not a guarantee that every expense will be reimbursed. Contact the counselor before signing a new lease, vacating, discarding property or hiring movers.

What to do when the offer arrives

  1. Check the identity of the acquisition. Compare the parcel number, legal description, map, easement language and ownership information with your deed and survey.
  2. Separate the money categories. Note the amount for the acquired interest, any stated remainder damages, title or closing items and any relocation information. Do not treat the purchase price as a moving allowance.
  3. Review the appraisal basis. Look for the property description, interest valued, effective date, comparable information and assumptions about access or improvements. Mark factual errors rather than arguing only from a desired price.
  4. Gather relevant evidence. Provide leases, recent sales information, improvement records, access documentation, photographs and other material that bears on value. Ask the agency representative to confirm receipt.
  5. Contact the relocation counselor. Request the residential, business/farm/nonprofit or personal-property booklet that fits your circumstances and ask what records are needed to establish eligibility.
  6. Calendar every deadline. Record certified-mail delivery, the final-offer response period, inspection appointments, notice-to-move dates and any court deadlines. Keep originals and a communication log.
  7. Get case-specific advice when the stakes warrant it. A qualified Texas eminent-domain attorney can review valuation, remainder damages, title issues and procedural notices. General information cannot determine the value of your parcel or your eligibility.

What happens in eminent-domain proceedings

TxDOT’s 2023 booklet describes an initial hearing process in which the court appoints three disinterested landowners as Special Commissioners. They hear evidence about the value of the property interest and, for a partial acquisition, damage to the remainder. The commissioners file an award with the court.

After the State deposits the award, it may become entitled to possession under the procedure described in the booklet. Possession and payment are procedural issues, so follow the court’s orders rather than relying on an informal move date. Either the owner or the State may object within the applicable deadline. An objection can move the case to a trial in which compensation is decided under the governing rules; the commissioners’ award is not automatically the final result.

The central valuation question remains what the acquired interest is worth and what compensable harm the taking causes to the remainder. A court case does not convert relocation assistance into part of the land’s value. Relocation eligibility must still be evaluated separately with the counselor.

Special situations that need early attention

Partial taking with an operating business

A frontage strip can remove parking, change customer access or force relocation of equipment. Document the current layout, access points, signs, utilities and lease responsibilities before construction changes conditions. Ask whether the proposed acquisition is permanent or temporary and which party controls restoration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Farm or ranch property

Record gates, fencing, water lines, irrigation, livestock routes and field access. A narrow strip can divide operations even when the acreage appears small. Request the business/farm/nonprofit relocation materials and identify the person authorized to negotiate for the operation.

Tenant-occupied property

The owner’s purchase payment and a tenant’s possible relocation benefits are different matters. Provide copies of leases and notices, and do not assume that an owner’s settlement establishes a tenant’s eligibility or move date.

Personal property without a full real-estate move

Some situations involve moving personal property or equipment rather than relocating an entire residence or business. Ask for the personal-property-only booklet and obtain written eligibility guidance before incurring costs.

Common mistakes and how to avoid them

  • Moving before eligibility is established: premature moving may jeopardize possible benefits. Speak with the counselor first.
  • Ignoring the remainder: on a partial taking, review access, parking, drainage, setbacks and usability of what remains, not only the square footage acquired.
  • Missing certified-mail dates: the initial offer and final-offer periods can control negotiations and filing timing.
  • Assuming a refusal stops the project: an agency may pursue eminent domain after making the required offers.
  • Expecting a fixed relocation check: assistance is individualized and may involve services, documentation and eligible moving-related costs rather than a universal amount.
  • Using project figures as statewide rules: TxDOT’s project pages can contain package-specific details. Confirm the rules for your parcel and funding arrangement.

Where to obtain current information

Start with the contact named in the written offer and request the current relocation booklet for your occupancy type. TxDOT’s relocation-assistance presentation manual explains how information is provided, while the State Purchase of Right of Way booklet summarizes the owner-facing process and warnings about moving. For project-specific acquisition descriptions, consult TxDOT’s right-of-way acquisition page, recognizing that its details may describe one project package rather than a statewide rule.
