Design-bid-build uses separate, sequential design and construction contracts. Design-build combines both services in one contract. The right choice depends on the agency’s legal authority, how well the requirements can be defined, schedule pressure, market capability, proposal expense, required owner control, and the agency’s ability to manage the selected process.
Federal Acquisition Regulation (FAR) Part 36 recognizes both approaches. A contracting officer may use two-phase design-build when the statutory and FAR criteria support it, but the FAR does not make design-build a universal federal default. The comparison below explains the legal framework, selection sequence, risk allocation, and practical decision tests federal project teams should apply.

What the two delivery methods mean under the FAR
Design-bid-build
FAR 36.102 defines design-bid-build as the traditional delivery method where design and construction are sequential and contracted for separately with two contracts and two contractors. The government first acquires architect-engineer services, develops or approves the design, and then procures construction under a separate contract. The builder is generally responsible for constructing the work described in the completed contract documents; the designer is responsible for the design services stated in the professional-services contract.

Design-build
FAR 36.102 defines design-build as combining design and construction in a single contract with one contractor. The design-builder, often through a team of construction and design firms, carries responsibility for developing the design and delivering the constructed result under one contractual relationship with the government.
The agency still has to define the required outcome. Its solicitation may use prescriptive specifications, performance requirements, or a combination of both, along with budget parameters, schedule milestones, site constraints, codes, and other measurable acceptance criteria. The design-builder generally chooses the design path used to meet those requirements. That can improve coordination and leave room for innovation, but it also means the owner gives up some control over how the design evolves.
Federal legal framework: delivery method is not the same as award method
FAR Part 36 recognizes traditional design-bid-build and other procedures authorized by law. For covered public buildings, facilities, and works, FAR 36.104 points to two-phase design-build selection under 41 U.S.C. § 3309 or 10 U.S.C. § 3241 when the contracting officer determines that procedure is appropriate. Defense acquisitions also have an additional design-build authority referenced in FAR 36.104. The governing statute, agency regulations, funding source, and project type must therefore be identified before a team treats any procedure as available.
Two separate choices are often confused:
- Delivery method: whether design and construction are procured separately or combined in one contract.
- Award procedure: whether the construction contract is awarded through sealed bidding, competitive negotiation, or another legally authorized process.
FAR 36.103 directs contracting officers to use sealed bidding for a construction contract when the conditions in FAR 6.401(a) apply, subject to the stated exception for performance outside the United States and its outlying areas. Selecting design-build does not by itself answer whether sealed bidding or negotiation is lawful. Architect-engineer services are acquired by negotiation under FAR Part 36, so a design-bid-build project commonly involves one negotiated professional-services procurement followed by a separately conducted construction procurement.
Before issuing a solicitation, the contracting officer should confirm the agency’s authority, any program-specific rules, applicable domestic or overseas provisions, and the current text of the FAR and governing statutes. A federal building project and a federal-aid highway project may use similar terminology while operating under different authorities and guidance.
How two-phase design-build selection works
FAR 36.301 requires the contracting officer to assess whether two-phase design-build is appropriate. The assessment is not a slogan about speed; it is a documented judgment about competition, requirements, project timing, market capability, suitability, proposal expense, and agency capacity.

1. Test whether the procedure is appropriate
The FAR criteria include whether at least three offers are anticipated; whether design work must precede price development and would impose substantial proposal expense; how well the requirements are defined; time constraints; the capability and experience of potential contractors; the suitability of design-build for the project; and the agency’s ability to manage a two-phase process. A project that cannot attract enough capable teams, or an agency that cannot evaluate complex technical submissions, may not be a good candidate even if the schedule is aggressive.
2. Build a performance-oriented scope
The agency develops a scope of work that states what must be delivered and how compliance will be measured. Depending on the project, the solicitation may include performance criteria, preliminary design, site information, budget parameters, phasing requirements, security or operational constraints, and schedule or delivery requirements. Requirements must be specific enough for offerors to understand the mission and risks, while leaving appropriate room for competing technical solutions.
3. Issue the phase-one solicitation
Phase one is a qualifications and technical-approach competition. The solicitation identifies the evaluation factors and the maximum number of offerors that may advance. Phase one evaluates matters such as specialized experience, technical competence, ability to perform, and the team’s past performance. Detailed design is excluded, as are price-related factors. This prevents the government from demanding expensive preliminary designs before it has narrowed the field to teams with a realistic prospect of award.
4. Shortlist the most capable teams
The maximum number advancing is generally no more than five unless the contracting officer documents a determination supporting a larger number. The shortlist should be large enough to preserve meaningful competition but small enough to avoid imposing unnecessary design expense on teams that have little chance of award. The agency should document how the evaluation factors relate to project risks and how the ratings support the number selected.
5. Conduct phase two
Selected offerors submit detailed technical and price proposals in phase two. The agency evaluates those proposals under the stated factors and awards one design-build contract using competitive negotiation. Phase-two instructions should explain design submittal requirements, pricing structure, assumptions, allowances, schedule, past-performance treatment, discussions, and the basis for selecting the best-value offeror or other permitted award basis.

6. Address proposal costs fairly
Detailed design effort can be expensive. GSA’s November 17, 2022 design-excellence guidance describes stipends for unsuccessful offerors that advance to a later stage, along with shortlisting practices and single-point responsibility. Those are GSA practices, not automatic requirements for every federal agency. A solicitation should state clearly whether a stipend is offered, what work it covers, ownership or licensing terms for proposal concepts, and whether any payment affects the government’s rights.

Where design-build can help—and where it can constrain the owner
Single-point coordination
GSA’s 2022 guidance states that design-build relies on a single point of responsibility that can minimize risks, foster innovative design and construction solutions, manage cost, and reduce project-related delays. Those are potential benefits of the contractual arrangement, not measured results for every project. The contract must still allocate differing-site-condition risk, utility information, permitting duties, design reviews, quality assurance, security requirements, and changes. A single point of contact does not eliminate the need for clear government requirements or disciplined administration.
Overlapping design and construction
FHWA describes a potential schedule benefit because construction can begin while plans are still being developed. That approach may be useful when early site, utility, foundation, or long-lead work can proceed on a sound basis. It is not a license to build before regulatory approvals, safety-critical design, or required technical information is available. The agency should identify which design packages must be approved before work starts, what information is provisional, and how changes will be priced and controlled.
Reduced control over the design path
In design-build, the owner states the required performance and reviews submissions, but the design-builder generally selects the means of achieving the result. GSA specifically notes that the owner leaves much of the design path to the design-build firm. If the agency requires a particular historic appearance, maintainability standard, interoperability profile, or material system, it should express that requirement in the solicitation rather than assume the design-builder will choose it.

Choose design-bid-build when the project needs a defined design solution
- The agency needs close control over the design before construction pricing.
- Operational, historic, security, or user requirements can be translated into a complete design more effectively than into performance criteria.
- The construction market is broad, but the design-build market is thin or lacks relevant team experience.
- The schedule permits sequential design, review, procurement, and construction.
- The agency has the capacity to coordinate the designer, builder, inspectors, and claims arising at their interfaces.
Consider design-build when integration has a real project value
- Requirements and acceptance criteria can be defined without prescribing every design decision.
- There is a genuine schedule constraint that could benefit from responsibly overlapping design and construction.
- At least three capable offers are reasonably anticipated, and the market has relevant design-build experience.
- The agency can evaluate technical approaches, manage a two-phase selection, and administer a performance-oriented contract.
- A single contractual point of responsibility would reduce coordination exposure that the agency would otherwise have to manage directly.
Use the proposal-cost test
Ask how much design work an offeror must perform before it can submit a credible price. If that effort is substantial, two-phase selection can protect competition by limiting detailed proposals to shortlisted teams. If the work is simple enough for bidders to price from completed documents, a separate design and construction sequence may be more transparent and economical for both the government and the market.
Use the requirements-definition test
A design-build solicitation cannot cure an undefined mission. Before choosing it, the agency should be able to state the required capacity, performance, interfaces, site conditions known to the government, commissioning obligations, reliability targets, life-cycle objectives, and acceptance tests. If those matters are unresolved, the government may face extensive amendments, proposals based on incompatible assumptions, or disputes over whether the design meets the intended outcome.
Planning and administration checklist
For either method
- Confirm the statutory and agency authority for the planned delivery and award procedures.
- Define the mission, funding limits, schedule milestones, site constraints, and stakeholder approvals.
- Identify design standards, environmental and permitting obligations, security rules, domestic preference requirements, and inspection responsibilities.
- Decide how the contract will handle unknown conditions, changes, allowances, options, and escalation.
- Set measurable acceptance, testing, commissioning, warranty, and closeout requirements.
Additional design-bid-build controls
- Procure architect-engineer services under the applicable FAR Part 36 procedures.
- Establish a design-review and approval schedule that leaves adequate time for corrections.
- Coordinate drawings, specifications, geotechnical information, utilities, and existing-condition surveys before construction solicitation.
- State how design errors, omissions, requests for information, and construction changes will be evaluated and priced.
- Preserve a clear record of the design basis and government-furnished information.
Additional design-build controls
- Document the FAR 36.301 suitability analysis, including anticipated competition, proposal expense, schedule, market capability, and agency capacity.
- Write performance and prescriptive requirements so offerors can propose comparable solutions.
- Separate phase-one qualifications and technical-approach factors from price and detailed design.
- Set the shortlist maximum, evaluation methodology, discussions policy, stipend terms if any, and proposal-data rights.
- Define design submittal stages, government review periods, delegated design responsibilities, and the point at which each package is released for construction.
- Provide a disciplined change process for owner-directed changes, design development, differing conditions, and regulatory revisions.
Common mistakes and how to correct them
Calling design-build the federal default
FAR Part 36 recognizes multiple legally authorized approaches. Correct the mistake by identifying the statute, agency authority, and project facts supporting the selected method.

Promising guaranteed savings or speed
FHWA and GSA describe potential benefits, not a government-wide result. Correct the claim by tying any expected benefit to a specific schedule, packaging strategy, market condition, or risk allocation and by stating the assumptions behind it.
Using phase one to obtain free design
Phase one evaluates qualifications and technical approach; detailed design and price-related factors are excluded. Correct the solicitation by reserving detailed proposal development for phase two and limiting phase-one submissions to information needed to distinguish capable teams.
Leaving performance requirements vague
Broad language such as “high quality” or “innovative” is difficult to evaluate and enforce. Correct it with measurable capacities, tolerances, testing protocols, maintainability criteria, documentation requirements, and acceptance dates.
Assuming one contractor eliminates all disputes
Single-point responsibility can simplify coordination, but disputes still arise over scope, differing conditions, design reviews, and changes. Correct the risk by assigning each duty expressly and maintaining timely government decisions.
Transplanting an agency practice nationwide
GSA’s stipends and shortlisting examples illustrate one agency’s approach as described in its November 17, 2022 document. They are not automatic requirements or benefits for every federal project. Correct the assumption by checking the current agency policy and solicitation instructions.

Complex facility with measurable performance goals and a hard occupancy date
Design-build may be suitable when the agency can state capacity, reliability, commissioning, and operational requirements while allowing competing technical solutions. The team should identify which early packages can proceed safely and how incomplete design information will be controlled.
Thin or uncertain specialist market
If fewer than three capable design-build teams are likely, or if the agency cannot confidently evaluate integrated technical proposals, the two-phase procedure may not produce robust competition. The agency should reassess market research, project packaging, and whether separate design and construction procurements would attract more qualified firms.
What the evidence does—and does not—show
The official material does not establish a federal-wide percentage showing that one method is cheaper, faster, or higher quality. No defensible universal figure should be inserted into a solicitation justification or public article. The strongest supportable statement is conditional: design-build can create schedule and coordination advantages in suitable circumstances, while design-bid-build can provide greater owner control and a more complete design before construction pricing.

Bottom line for federal contracting officers
Use design-bid-build when separate design and construction contracts best serve the agency’s need for design control, sequential reviews, and a defined basis for construction pricing. Use design-build when the agency has authority, can define outcomes clearly, expects a capable and competitive market, can manage a two-phase process, and has a project-specific reason to integrate design and construction. In both cases, make the decision traceable to FAR requirements and documented project conditions. The method is a risk-allocation choice, not a guarantee of lower cost, shorter duration, or better quality.
Frequently Asked Questions
Does selecting design-build remove the need for an architect-engineer procurement?
No. Design-build combines design and construction in one contract, but the agency must still establish the design services, qualifications, performance requirements, reviews, and professional responsibilities required by the solicitation and applicable law. Architect-engineer services acquired separately are negotiated under FAR Part 36; the agency should confirm the procedure applicable to its chosen acquisition structure.
Are stipends for unsuccessful design-build offerors required on every federal project?
No. GSA’s November 17, 2022 guidance describes stipends as an agency practice for certain competitions. Whether a stipend is offered, how it is calculated, and what proposal rights accompany it must be established by the specific agency and solicitation.
Can a design-build contractor start construction before the entire design is finished?
Sometimes, if the contract permits phased design release and the necessary technical, safety, permitting, and quality information is approved. The agency should identify the packages eligible for early release and define how later design development, changes, and pricing will be controlled.
