Drive-By ADA Lawsuits: How Offices Can Fix Accessible-Parking Risks Before They Escalate

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Accessible parking is one of the first things a claimant can inspect without entering your office. A missing van designation, a narrow access aisle, an excessive slope, or a blocked route can expose a public-facing business to an ADA demand or lawsuit. The practical defense is not a sign purchased at the last minute; it is a documented, property-specific review followed by timely correction of barriers that can be removed readily.

Older buildings are not automatically “grandfathered.” The requirements that apply depend on whether you are building or altering a facility, operating an existing public accommodation, restriping its lot, and what state and local rules add. Use the federal dimensions below as a starting point, then have the complete route and local requirements checked before treating a lot as compliant.

Why accessible parking creates “drive-by” exposure

A person can observe a parking lot from a public road, pull in, photograph conditions, and decide whether the path to an entrance appears usable. That visibility makes parking a frequent starting point for ADA-related complaints, even though compliance extends through the entire route into the business. A painted symbol or a single sign does not cure a space that is too small, steep, obstructed, or disconnected from an accessible entrance.

Rider Levett Bucknall’s November 28, 2018 republication of John Jozwick’s February 2017 Building Design + Construction article reported more than 4,430 federal cases in 2014 and more than 1,700 Phoenix businesses sued in 2015. Those figures are historical numbers presented in that article; they were not independently verified for this guide and should not be read as current lawsuit totals, rates, or a prediction for any particular state.

The useful lesson is risk management: inspect conditions before someone else documents them, correct barriers where the law requires, and retain evidence of what you found and did. Whether a claimant can recover damages, must provide notice, or faces a cure period varies by federal and state law and by the facts. Do not rely on a generalized internet summary for those procedural questions.

What duties apply to an older office or business?

The 2010 ADA Standards are mandatory design requirements for new construction and alterations. For an existing Title III public accommodation, the standards also serve as the reference for removing barriers when doing so is readily achievable—that is, when it can be accomplished without much difficulty or expense in light of the circumstances. There is no blanket exemption simply because a building or its parking lot predates the 2010 Standards.

Situation What to evaluate Practical implication
New construction Applicable 2010 ADA Standards provisions, including accessible parking and the route to an entrance. Design and build to the required specifications before opening.
Alteration to a facility or parking area Requirements triggered by the scope of the alteration, plus any obligations affecting the path of travel. Have the design reviewed before work begins; do not assume an old layout can remain unchanged.
Existing public accommodation with no current construction Whether parking and other barriers can be removed readily, considering the site and available resources. Prioritize feasible corrections, document why a proposed correction is or is not readily achievable, and address serious route barriers.
Any property State and local building, zoning, and parking-sign requirements. Federal compliance is a baseline; local rules may add details or stricter requirements.

The word “readily achievable” is not a blanket permission to leave a problem in place. It calls for a fact-specific assessment. A modest restriping project is often a practical, relatively inexpensive correction, while a major reconstruction may require a different analysis and a phased plan.

Parking dimensions that must be checked

Measure the space and its aisle at the surface, not from a drawing that may no longer match field conditions. The federal minimums below come from the 2010 Standards.

Element Federal requirement Field check
Accessible car space At least 96 inches wide. Measure usable width between striping, curbs, posts, and other intrusions.
Accessible van space At least 132 inches wide, or at least 96 inches wide when paired with an access aisle at least 96 inches wide. Confirm the space-and-aisle combination, not just the painted stall.
Access aisle At least 60 inches wide for the standard configuration; full length of the spaces served; marked to discourage parking; level with the space; and adjoining an accessible route. Check every inch of the aisle, including where a vehicle, curb ramp, signpost, or wheel stop could intrude.
Slope No steeper than 1:48 for spaces and aisles. Use a suitable level or slope-measuring instrument in more than one location.
Signs International Symbol of Accessibility; a van space also says “van accessible.” The sign’s bottom is at least 60 inches above the ground. Check wording, symbol, mounting height, visibility, and whether a post or wall is obstructed.

Built-up curb ramps may not project into a parking space or access aisle. Wheel stops are one method the Department of Justice identifies for controlling vehicle overhang so a parked vehicle does not reduce the clear width of an adjacent accessible route. A wheel stop is not a substitute for measuring the route or maintaining it.

How many accessible spaces are needed?

The requirement is calculated for each parking facility, not by combining every lot on a campus into one convenient total. The opening rows of the federal table are:

Total spaces in the parking facility Minimum accessible spaces
1–25 1
26–50 2
51–75 3

At least one out of every six accessible spaces must be van accessible. Apply the complete federal table when a facility exceeds 75 spaces, and verify whether local rules require more. Count spaces as they exist in the facility, including changes made by restriping or expansion, rather than relying on an old plan.

Location and the accessible route

Accessible spaces should be on the shortest accessible route to an accessible entrance. The route must remain usable from the space and aisle to the entrance, with no parked vehicle, bollard, landscape feature, signpost, curb transition, or ramp edge narrowing the required clear width. A space at the far end of a lot is not justified merely because it is convenient to paint there if another location provides a shorter, safer route.

Check the surface, cross slopes, transitions, curb ramps, door approach, and any changes in level along the complete path. A correctly sized stall can still fail its purpose if the route ends at a step, a blocked doorway, or an aisle where vehicles overhang.

Why restriping changes the analysis

The Department of Justice’s ADA Compliance Brief on restriping states: “When a business or State or local government restripes parking spaces in a parking lot or parking structure (parking facilities), it must provide accessible parking spaces as required by the 2010 ADA Standards for Accessible Design (2010 Standards).” In other words, repainting ordinary spaces is not a neutral maintenance act when the lot is being restriped. Use the project as an opportunity to establish the required number, dimensions, aisles, signs, slopes, and route.

DOJ also describes a continuing obligation for public accommodations that provide goods or services to the public to remove existing parking barriers when readily achievable. It identifies restriping as relatively inexpensive and readily achievable in most cases. If a lot was painted years ago without enough accessible spaces, a new striping project is a poor time to repeat the old layout.

A property-specific inspection you can actually use

  1. Define the facility. Draw the boundaries of each parking facility serving the business. Record the total number of spaces, including accessible spaces, reserved spaces, loading areas, and any spaces added or removed since the last plan.
  2. Map the route. Mark every accessible space, aisle, curb ramp, sidewalk segment, entrance, and alternate entrance. Photograph the route in both directions and note where a vehicle could overhang into it.
  3. Measure spaces and aisles. Measure usable widths, full aisle lengths, and the relationship between a van space and its aisle. Record whether markings remain visible and whether a post, curb, ramp, or sign reduces the measured area.
  4. Measure slopes and transitions. Check the running slope and cross slope of each space and aisle against the 1:48 limit. Inspect transitions at curbs, ramps, sidewalks, and door thresholds; do not infer levelness from appearance.
  5. Verify signs. Confirm the International Symbol of Accessibility, the words “van accessible” where required, mounting height, visibility, and placement at each designated space. Check whether a local sign rule adds a fine, color, or pavement-marking requirement.
  6. Check obstructions and clearance. Look for snow storage, carts, dumpsters, landscaping, utility covers, light poles, low branches, and temporary cones. Verify that vehicles cannot block the route and that any applicable vertical-clearance requirement is met.
  7. Compare the count. Use the facility’s total-space count and the complete federal table, then compare with state and local requirements. Confirm that at least one of every six accessible spaces is van accessible.
  8. Create a correction log. For each issue, record the location, measurement, photograph, responsible party, proposed correction, target date, and whether the work is complete. Preserve invoices, striping plans, permits, and post-correction photographs.

Common visible failures and appropriate fixes

  • Van space without a van designation: install a compliant sign that includes “van accessible,” while verifying the space-and-aisle dimensions.
  • Aisle used as a regular parking space: refresh diagonal or other markings that discourage parking and enforce the restriction; repainting alone will not help if the aisle is too narrow.
  • Ramp or curb flare intruding into the stall: redesign or relocate the built-up ramp so it does not project into the space or aisle.
  • Excessive slope or ponding: obtain a measured condition assessment and correct drainage, grading, or paving as appropriate; do not simply repaint a sloped surface.
  • Route narrowed by vehicle overhang: add a properly located wheel stop or another physical control after confirming it does not create a new trip hazard or reduce maneuvering space.
  • Accessible space far from the entrance: evaluate whether a shorter accessible route exists and relocate or add spaces when required and feasible.
  • Faded or missing markings: restripe the complete layout, including aisles, symbols, and any required local markings, rather than painting only the stall outline.
  • Blocked entrance route: remove stored materials, carts, snow, or landscaping encroachments and establish a procedure for keeping the route clear.

Signs, consultants, and the limits of a quick fix

A compliant van-accessible parking sign is a useful correction when signage is the problem, but buying a sign does not make a parking facility compliant. The sign must correspond to a properly sized, level space and aisle connected to an accessible route. A property manager should treat a sign purchase as one line item in a correction plan, not as a legal shield.

A qualified accessibility consultant or architect can measure the site, identify route and dimensional conflicts, prepare a scoped remediation plan, and help document completed work. The value is a defensible process and better field information—not a guarantee that nobody can sue and not proof that hiring a consultant is always cheaper than litigation. Select someone who understands commercial accessibility, can coordinate with the design and construction team, and will state assumptions and unresolved local-code questions in writing.

How to manage legal and operational risk

Federal standards do not answer every litigation question. State statutes may regulate demand letters, notice, cure periods, statutory damages, attorney fees, or pleading requirements, and those rules change. The historical article’s examples of grouped lawsuits, fee requests, and state responses should not be treated as representative of current procedure. Have counsel licensed in the property’s jurisdiction evaluate an actual demand, deadline, or threatened filing.

Operationally, assign one owner for accessibility issues, set inspection intervals, and require a review whenever a lot is restriped, repaved, regraded, expanded, or its entrance changes. Train staff not to place equipment in aisles or routes. When a problem is found, make the immediate safe correction, schedule construction for the permanent fix, and keep dated records showing the response.

If a correction is not readily achievable at once, document the site constraints, alternatives considered, cost and resources, interim measures, and a timetable for further review. That record does not decide a legal claim by itself, but it is more useful than an unsupported assertion that the building is “grandfathered.”

A practical decision sequence for owners and managers

  1. Before work: pause any restriping or paving plan until the parking count, accessible layout, route, slopes, signs, and local requirements are reviewed.
  2. During design: show spaces, aisles, curb ramps, entrances, wheel stops, and sign locations on a dimensioned plan. Resolve conflicts before mobilization.
  3. At completion: measure the installed work, photograph the route and signs, and correct deviations before opening the lot.
  4. During operations: inspect routinely, respond to obstructions promptly, and repeat the review after changes in tenants, entrances, traffic patterns, or pavement markings.
  5. When contacted by a claimant: preserve the letter and photographs, avoid promises about legal outcomes, begin a factual site review, and obtain jurisdiction-specific legal advice promptly.
