Contractor Investigation vs. License Suspension: What Homeowners Need to Know

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

An investigation is not a suspension. A licensing agency investigates allegations or possible violations to decide what the evidence shows. A suspension is a separate license status or disciplinary sanction that may occur only after a formal process—or under a specific statutory trigger. A complaint, an open investigation, a formal accusation and an actual suspension are different facts. Check the current official record for the state where the project is located before deciding whether a contractor can work, and treat allegations as allegations unless a final finding or current status says otherwise.

Investigation and suspension are different stages

Homeowners often see a complaint or “under investigation” notation and assume the contractor has lost the right to work. That conclusion is unsafe. The regulator may still be collecting documents, interviewing people, checking permits or trying to resolve the dispute. The matter can close with no violation, a settlement, a warning, a citation or a referral for formal discipline.

What “under investigation” means

An investigation is the regulator’s fact-finding process. It normally begins with a complaint or other information suggesting a possible violation. Investigators evaluate jurisdiction, gather records and statements, and decide whether the evidence supports action. An open investigation is not a final finding that the contractor did anything wrong.

California’s Contractors State License Board (CSLB), for example, says it reviews complaints for jurisdiction and prioritizes them partly by health and safety, seriousness, order received and available resources. It may request more information, attempt mediation or send a matter to an investigative center. California complaints can close because the parties settle, evidence is insufficient or no violation is found.

What “suspended” means

Suspension is a restriction on the license under the applicable state’s law. It can be imposed as discipline after formal proceedings, or it can arise from a separate statutory condition. The precise effect—whether the contractor may perform new work, finish an existing project, pull permits or work under another classification—depends on the jurisdiction and the wording of the current order or statute.

A database entry alone may not explain whether a suspension is temporary, stayed, effective on a future date, limited to a license classification or already lifted. Ask the licensing agency what the entry means and when it took effect.

The four facts you should keep separate

  • Complaint: someone reported an issue or the agency received information. A complaint is an allegation, not proof.
  • Investigation: the agency is evaluating evidence and may seek information from the contractor, homeowner or others.
  • Formal accusation or disciplinary case: the agency has initiated a process seeking a sanction. The licensee generally receives notice and an opportunity to respond.
  • Suspension: the official license status or order restricts the license. Verify that it is current and identify its scope.

California CSLB guidance says formal action provides due-process and appeal rights. Do not describe an accusation as a final violation, and do not describe an investigation as a suspension.

Can a contractor keep working while under investigation?

Often, an investigation by itself does not change the license status. Whether work may continue is controlled by the official status, any emergency order, a court order and other state or local rules—not by the existence of a complaint. The sources reviewed do not establish one nationwide rule, so do not rely on a general answer.

Before allowing additional work or payments, check the regulator’s official license lookup and ask the agency about the specific project and license classification. Confirm with the local building department whether a disciplinary action affects permits or inspections. A contractor could appear as licensed while a separate order limits particular activities, or a database could lag behind a recent action.

Questions to ask the licensing agency

  • Is the license active, suspended, revoked, expired, cancelled or otherwise restricted today?
  • What is the effective date and end date, if any, of the status?
  • Does the action apply to this license number, classification and business entity?
  • May the contractor perform work already under contract, and may they start new work?
  • Are permits, inspections, bonding or a responsible managing officer affected?
  • Is there a written order or docket entry you can obtain?

How a complaint can progress: California as a worked example

California’s process illustrates a possible sequence, not a guaranteed timeline for every state.

  1. Intake and jurisdiction review. CSLB determines whether the complaint concerns a matter within its authority and considers factors such as health and safety and seriousness.
  2. Requests for information or mediation. The agency may ask the parties for documents or attempt to resolve the dispute without formal discipline.
  3. Investigation. A matter requiring investigation can be assigned to an investigative center. Interviews and record review may follow.
  4. Closure or corrective action. The complaint may close after settlement, for lack of evidence or because no violation is found. Depending on the evidence, CSLB may issue a warning or citation.
  5. Formal accusation. For a serious matter, CSLB can file an accusation seeking suspension or revocation. The licensee receives procedural protections and can contest the case.

California citations can carry civil penalties of up to $30,000 for certain violations, depending on the violation. That figure is a maximum for specified citations, not a prediction that a complaint will result in suspension or any particular fine.

How other states show why the details matter

State example What the published materials show Homeowner verification point
California CSLB reviews and prioritizes complaints, may seek information or mediate, and can close a matter, issue a warning or citation, or file an accusation seeking suspension or revocation. Complaint disclosure is available through the contractor lookup. Review both complaint information and current license status; ask CSLB and the local building department about the effect on your project.
Nevada The Contractors Board describes investigation, possible notice to correct and formal disciplinary proceedings. A Notice of Hearing and Complaint starts the hearing process. A written answer is required within 20 days after mailing of that notice. That deadline is Nevada-specific.
Florida The cited statute lists probation, reprimand, revocation, suspension, denial, restitution, administrative fines, continuing education and costs among possible board actions. The lookup distinguishes complaint status from license status. Do not treat a complaint label as a suspension. Florida’s lookup advises checking with the local building department about discipline affecting work.

These examples cannot be combined into a national procedure. Notice requirements, hearing rights, deadlines, sanctions and the events that trigger an automatic restriction are set by each state’s law and agency rules.

Nevada’s answer deadline

Nevada’s current complaint guidance says a Notice of Hearing and Complaint requires a written answer within 20 days of mailing. If the licensee does not answer, the allegations may be treated as admitted and the license may be suspended or revoked without a hearing. A homeowner dealing with a Nevada contractor should treat the mailing date and response deadline as urgent and should not assume that California or Florida procedures apply.

Florida’s range of sanctions

The Florida statute cited for this topic authorizes more than suspension. Depending on the violation and statutory conditions, the board may impose probation, a reprimand, revocation, suspension, denial, restitution, administrative fines, continuing education and costs. The cited statute allows administrative fines of up to $10,000 per violation. The available remedy in a particular case depends on the statute and facts in the official record.

How to check whether a contractor’s license is active

  1. Identify the project jurisdiction. Use the state where the work is located, not merely the contractor’s mailing address. Check whether a city or county requires an additional registration or trade license.
  2. Identify the exact license. Match the legal business name, license number, classification and qualifying individual. Similar names can belong to different entities.
  3. Open the official regulator lookup. Read the current status, expiration date, classifications, disciplinary entries and any complaint disclosure. Do not rely on an advertisement, an old certificate or a third-party directory.
  4. Read labels literally. “Complaint received,” “investigation,” “accusation,” “probation,” “suspended” and “revoked” describe different procedural facts. Note whether a status is current, effective later or already ended.
  5. Confirm an unclear or high-impact entry. Call or email the licensing board and request the order, docket or explanation. Record the date, representative’s name and any reference number.
  6. Check locally. Ask the building department whether the license action affects permits, inspections, the permit holder or work already underway.

California’s official service directs consumers to a contractor lookup with complaint disclosure. Florida’s lookup expressly cautions that complaint status is not license status and recommends checking with the local building department. Those distinctions are useful wherever you live, but the labels and records in your state may differ.

What to do if the lookup says “suspended”

Pause new commitments while you verify

Do not sign a new change order, release a large progress payment or allow work to expand until you know what the status means. A pause protects your options; it is not a legal conclusion that every existing contract is void. Ask the regulator whether the suspension covers this classification, this business and this type of work, and whether any stay or reinstatement is in effect.

Secure the project and records

Preserve the signed contract, scope and specifications, change orders, invoices, payment confirmations, lien releases, permits, inspection reports, dated photographs, text messages, emails and regulator notices. Keep originals and make a chronological copy. Do not alter photographs or delete messages. These records help the regulator, building department, mediator, insurer or court understand what happened.

Protect the site and critical work

If work is incomplete or unsafe, ask the building department and your insurer what immediate steps are appropriate. Arrange access, weather protection and emergency repairs through properly authorized professionals where necessary. Confirm who may pull permits and schedule inspections before another contractor begins.

Separate licensing relief from money recovery

A licensing complaint is primarily a public-protection process. CSLB states: “The purpose of a CSLB investigation is not to obtain restitution, and a CSLB investigation does not guarantee complainants will receive restitution.” If your main objective is recovering money or paying for defective work, you may need a civil claim, contract remedies, a bond claim or another remedy available in your jurisdiction. California CSLB recommends courts for consumers whose primary goal is financial recovery and suggests consulting an attorney when damages are substantial. Those recommendations are California-specific; obtain advice about the law where your project is located.

Does a complaint mean the contractor’s license is suspended?

No. A complaint means an allegation or report has been received. It may be screened out, settled, investigated without discipline, resolved by warning or citation, or advanced to a formal accusation. Only the official license status or an operative order establishes a suspension. Because agencies use different labels and update schedules, verify both the complaint record and the current license record.

When allegations become findings

Use careful language in communications with the contractor, neighbors, lenders and insurers. Say that “a complaint was filed” or “the agency lists an investigation” unless an official final decision supports a stronger statement. A formal accusation is a claim by the agency, not automatically a final violation. A final order, current suspension entry or court judgment can support more definite wording, but read its scope and effective date.

Common mistakes and safer alternatives

  • Mistake: treating an open investigation as a suspension. Safer approach: check the status field and ask the agency whether work authority changed.
  • Mistake: assuming “licensed” means unrestricted. Safer approach: read classifications, probation terms, disciplinary orders and expiration dates.
  • Mistake: relying on a screenshot. Safer approach: save the official record’s date and obtain confirmation for a consequential decision.
  • Mistake: expecting the licensing agency to award damages. Safer approach: preserve evidence and evaluate civil, bond, insurance or payment remedies separately.
  • Mistake: applying another state’s deadline. Safer approach: follow the notice and statute for the project’s jurisdiction; Nevada’s 20-day answer period is not a nationwide rule.
  • Mistake: publicly repeating unproven accusations. Safer approach: attribute statements to the official record and distinguish allegations from findings.

A practical decision framework for homeowners

What the official record says What it establishes Next action
Complaint received or under investigation The agency is evaluating information; no suspension is established by that label alone. Confirm current license status, keep records and cooperate with lawful information requests.
Warning, notice to correct or citation The agency has identified a compliance issue or alleged violation, but the license may still be active. Read the order, deadline and payment or correction terms; verify authority to continue the specific work.
Formal accusation or hearing notice Discipline is being pursued through a formal process; it is not necessarily a final result. Note response and hearing deadlines and obtain the complete filing.
Suspended The license is restricted under the stated law or order, subject to its effective date and scope. Verify whether work may continue, notify the building department and protect the project before hiring a replacement.
Revoked, expired or cancelled The listed license does not currently authorize work under that record. Do not authorize new regulated work until the regulator confirms lawful authorization.

Questions that require a state-specific answer

  • Can the contractor finish an existing contract?
  • Can another company work under the same permit?
  • Does a suspension automatically void the contract?
  • Is a homeowner responsible for hiring an unlicensed replacement?
  • Can a bond or restitution order cover your loss?

The reviewed California, Nevada and Florida materials do not establish one answer to these questions nationwide. Ask the licensing agency and local building department, then obtain advice from a qualified attorney for a dispute involving significant money, safety concerns, liens or an impending deadline.

Frequently Asked Questions

How long does a contractor investigation take?

There is no reliable nationwide duration. California describes prioritization by factors such as health and safety, seriousness, order received and resources, while the matter may close through settlement, lack of evidence, no violation or formal action. Ask the responsible agency for the current status rather than relying on a general timeline.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Will filing a complaint get my deposit back?

Not necessarily. California CSLB says its investigation is for public protection and does not guarantee restitution. Financial recovery may require civil, bond, insurance or other remedies available in the project’s jurisdiction.

What if the contractor says the suspension is a mistake?

Ask the contractor for the written order or reinstatement proof, then verify it directly with the licensing agency. Check the effective date, scope, license number and any stay before permitting work or payments.

Should I terminate the contract immediately?

Do not assume that a complaint or investigation automatically permits termination. Review the contract, verify the official status, ask the regulator and building department about project-specific effects, and obtain legal advice when the financial or safety consequences are substantial.
