Construction-worker welfare boards and the four Labour Codes do different jobs. A State or Union Territory (UT) Building and Other Construction Workers (BOCW) Welfare Board registers eligible construction workers and pays or arranges welfare schemes. The Labour Codes set the wider rules for wages, employment records, social security, health and safety, and working conditions. A registered worker may need both: board registration for targeted assistance and employment under the Codes for workplace rights.
The four Codes took effect on 21 November 2025, according to the Ministry of Labour and Employment’s 30 December 2025 review. The 1996 BOCW employment-and-conditions law was absorbed into the Occupational Safety, Health and Working Conditions Code, 2020, while the BOCW cess framework moved into the Code on Social Security, 2020. Board schemes still vary by State/UT, so no national list guarantees the same payment to every worker.

Board benefits and Labour-Code rights are not the same thing
Think of the two systems as overlapping layers rather than competing programmes:

- The Labour Codes are the statutory framework for employment and social security. They govern employers, establishments, workers and scheme structures across India, subject to the detailed rules and implementation arrangements.
This distinction answers the most common question. A worker who has not registered with a BOCW board may still have wage, safety and employment-document rights under the Codes. Conversely, registration alone does not create a uniform national cash payment: the worker must satisfy the particular board scheme’s conditions and claim procedure.

The Ministry’s 25 July 2022 description of BOCW welfare lists life and disability protection, health and maternity support, children’s education, transit housing, skill development, awareness programmes and pensions. Those are scheme categories. The amount, qualifying event, waiting period, renewal requirement and documents depend on the relevant State/UT board.
What changed on 21 November 2025
The government’s 30 December 2025 Year End Review says the four Labour Codes were implemented from 21 November 2025, rationalising 29 earlier labour laws. The four Codes are:
- Code on Wages, 2019
- Industrial Relations Code, 2020
- Code on Social Security, 2020
- Occupational Safety, Health and Working Conditions Code, 2020
For construction workers, two changes are especially important:
The 1996 BOCW conditions law is now within the OSHWC Code
The BOCW Act of 1996, which dealt with employment and working conditions for building and other construction workers, was subsumed in the Occupational Safety, Health and Working Conditions Code, 2020. Current explanations should therefore describe workplace protections through the Code rather than treating the 1996 Act as an independent, unsubsummed framework.
The cess and welfare-fund structure is within the Social Security Code
The BOCW cess framework was subsumed in the Code on Social Security, 2020. That Code establishes a building-workers’ welfare fund, financed in part by cess, and provides the legal structure for welfare schemes and beneficiary registration.
Older articles may still use the former Act names because those laws shaped the system. The operative national framework, however, is the four-Code structure effective from 21 November 2025, with State/UT boards continuing to handle much of the practical delivery.
Who administers the benefit, and what triggers access?
| Question | Welfare-board route | Labour-Code route |
|---|---|---|
| Who administers it? | The applicable State or UT BOCW Welfare Board, using its rules and schemes | Employers, establishments, labour authorities and the statutory social-security institutions created or recognised under the Codes |
| What normally triggers access? | Registration as an eligible beneficiary plus the conditions of a particular board scheme | Being covered by an employment, establishment or statutory social-security rule; some protections apply through the employment relationship itself |
| Typical support | Targeted welfare assistance such as education, health, maternity, housing, skills, pension or life/disability support | Minimum wages, timely payment, employment documentation, health and safety duties, migrant-worker portability and the wider social-security framework |
| Geographic consistency | Scheme names, amounts, renewals and claim processes can differ by State/UT | The Codes provide a national framework, while detailed rules and local implementation affect how a right is delivered |
The table is a decision aid, not a promise that every worker receives every item in either column. A board’s scheme notification and the worker’s employment facts determine the actual entitlement.

What a State or UT welfare board may provide
Government descriptions identify several recurring categories. Each category below should be read as “may be available under the applicable board scheme,” not as an automatic payment.

Life and disability assistance
A board may provide a payment or insurance-linked support after a registered worker’s death or qualifying disability. The event covered, proof required, beneficiary or nominee rules, and claim deadline are set locally. A worker should check whether the scheme distinguishes accidental death, natural death, permanent disability and temporary incapacity.
Health and maternity support
Health-related schemes can include medical assistance, hospital support or maternity benefits. Eligibility may depend on registration status, the worker’s own treatment, a spouse or dependent, a pregnancy or delivery event, and whether another public programme is used. Do not assume that a board card itself guarantees free treatment at every hospital.
Education for workers’ children
Education assistance may cover children’s school, college, technical or professional study, subject to the board’s age, course, attendance, examination and application rules. Some schemes pay once per academic year; others reimburse specified expenses. The board’s current notification controls the amount and the definition of an eligible child.
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Transit housing and housing assistance
Board programmes can include transit accommodation for workers or support connected with housing. “Housing” may mean a defined facility, a grant, a loan-related benefit or assistance for a particular construction purpose. The label alone does not establish that a worker receives a permanent house or a general rent payment.
Skill development and awareness
Boards may finance training, upgrading or certification, and may run awareness programmes so workers understand safety, registration and available schemes. Skill support can be especially useful when work is seasonal or a worker moves between projects, but the available course, location and selection process are State-specific.
Pensions and old-age support
Pension assistance and related old-age measures appear in government descriptions of board welfare. The qualifying age, contribution or registration history, payment frequency and interaction with other pensions must be checked in the local scheme. The Code on Social Security also names old-age protection among the broader unorganised-worker scheme categories.
Other possible State-scheme categories
The Social Security Code’s framework allows State schemes to cover areas such as provident-fund support, employment injury, children’s education, skill upgrading, funeral assistance and old-age homes. These are statutory categories that a scheme can address; they are not evidence that every State board currently offers each one.
Who can register as a building-worker beneficiary?
The Code on Social Security sets a basic national eligibility rule for building workers. A person must:

- be at least 18 years old;
- be under 60; and
- have worked in building or other construction work for at least 90 days during the preceding 12 months.
The 90-day test concerns construction work in the previous 12 months, not necessarily one uninterrupted project. State rules and board procedures determine how that work is evidenced and how an application is filed.
What happens at age 60?
The Code addresses cessation of beneficiary status. It also preserves eligibility for prescribed benefits for a person who was a beneficiary for at least three continuous years before reaching 60. The exact benefits preserved and the way a claim is made depend on the prescribed rules and the board scheme, so a worker approaching 60 should confirm the position before allowing registration to lapse.
Registration is not the same as receiving a benefit
Registration establishes beneficiary status. A separate scheme may require a qualifying event, a current renewal, a minimum period of registration, proof of a child’s study or a medical document. A worker can therefore be registered and still have a particular claim rejected if that scheme’s conditions are not met.
How to use the board system in practice
Because boards operate under State/UT rules, the safest process is to verify the local scheme before gathering documents or relying on an amount.
- Identify the correct board. Use the State or UT where the worker is eligible to register or where the board directs construction workers to apply. A project’s location, home address and migration history can affect which office handles the record.
- Check the current eligibility notice. Confirm the 18-to-under-60 age range, the 90-days-in-12-months work test, any definition of “building worker,” and whether a renewal or contribution condition applies.
- Use the board’s current application channel. The board may accept an online application, a facilitation centre or an office submission. Follow the current form and instructions rather than a document list copied from an older article.
- Prepare only the documents the board requests. Typical evidence can vary, so confirm the current identity, age, address, work-history, bank, nominee, family or study documents required by that board. The national sources do not establish one universal checklist.
- Keep the registration active. Record the registration number, renewal date and any required contribution or update. An expired record can delay a claim even where the worker otherwise meets the scheme conditions.
- Match the claim to the scheme. Read the qualifying event, amount, deadline, beneficiary definition and payment route for the specific benefit. Submit the claim through the board’s stated channel and retain an acknowledgement.
- Escalate a delay with the record in hand. Ask the board or its facilitation office for the status using the registration or acknowledgement number. If the problem concerns unpaid wages or unsafe work rather than a board claim, approach the appropriate labour authority or worker-support channel instead.
This process is deliberately general. A national source cannot establish the current amount, renewal interval, fee, document list or appeal route for every State and UT.
What the Labour Codes add for a construction worker
The Codes protect the employment relationship and create a broader social-security architecture. Government summaries issued by the Ministry of Labour and Employment describe the following protections and features.
Minimum wages and payment on time
The Code on Wages provides the framework for minimum-wage protection and timely payment. If a worker is paid below the applicable minimum or is not paid when due, that is an employment-rights issue, not a request for a discretionary board grant. The correct remedy depends on the worker’s wage rate, classification, contract and the rules in force for the establishment.
Appointment and employment records
Government explanations of the Codes include appointment letters. A written record can identify the employer, job, wage and other terms, making it easier to prove who engaged the worker and what was agreed. A board registration card does not replace an appointment letter or other employment record.

Health and safety at the worksite
The OSHWC Code provides the framework for workplace health, safety and working conditions. Government summaries also describe annual health checks. Construction work can involve falls, lifting, electrical hazards, machinery, dust, heat and traffic; safety duties and health protections operate through the establishment and employment framework, separately from a board’s education or medical-assistance scheme.
Portability for migrant construction workers
Government summaries describe portability of benefits for migrant workers. In practical terms, portability is meant to reduce the loss of protection when a worker moves for a project. The worker still needs to know which record, authority, registration and local facility will recognise the benefit. A promise of portability does not mean that every board counter, hospital or contractor has already implemented identical access arrangements.
Social-security schemes beyond one board
The Code on Social Security sets a framework for schemes for unorganised workers, including life and disability cover, health and maternity benefits, old-age protection, education and other centrally determined benefits. It also permits State schemes in areas such as employment injury, housing, funeral assistance and skills. Whether a worker receives a particular benefit depends on the scheme, registration, funding and conditions that apply.
How the welfare fund and cess fit together
The Social Security Code’s building-workers’ welfare fund is financed in part by cess collected from construction activity. The fund provides the financial base for welfare measures, while the State/UT board remains central to beneficiary registration and delivery. Cess paid on a project is not a personal cash balance that a worker can automatically withdraw. It supports the welfare system; an individual claim still has to meet the relevant scheme rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Migration, health convergence and uneven implementation
State boards remain important even after the Labour Codes took effect. The Ministry of Labour and Employment’s Annual Report 2024–25 records efforts to connect BOCW boards with PM-JAY health authorities and reports memoranda of understanding with 14 State/UT boards. That number measures documented convergence activity, not the number of workers receiving a health benefit and not nationwide rollout.
A migrant worker should therefore ask three separate questions:
- Is the worker’s BOCW registration recognised or transferable at the destination?
- Which board or local authority accepts the claim?
- Does the destination facility actually provide the health or other service under the current arrangement?
Keep the registration details, renewal evidence and claim acknowledgement accessible when moving between projects. If a facility says it cannot locate the record, ask which authority can verify it and what alternative proof is accepted under the current implementation.

| Worker’s situation | First route to check | Why |
|---|---|---|
| Wages below the applicable minimum or paid late | Employer and the labour-authority mechanism under the wage framework | This concerns a statutory employment payment, not a board welfare grant |
| Need an education payment for a child | State/UT BOCW board scheme | Education assistance is a board welfare category with local conditions |
| Injury or unsafe conditions at the site | Employer, site safety channel and labour/safety authority | Workplace safety and employment protections arise through the Codes |
| Medical or maternity assistance | Check the board scheme and any linked public health programme | Coverage, provider and qualifying conditions vary locally |
| Moving to another State for a project | Confirm portability with the board and destination authority | National portability policy still depends on practical local recognition |
| Death, disability or funeral expense | Board’s life, disability or funeral scheme and any employment-injury route | Separate schemes may apply, with different evidence and deadlines |
Questions to ask the State or UT board before applying
- Is the worker’s registration active, and when must it be renewed?
- Does the board count the worker’s 90 construction days across several employers or projects?
- What is the current amount and payment frequency for the selected scheme?
- Does the scheme cover the worker, a spouse, children, nominees or other dependants?
- What event date, age limit, course, medical condition or registration period qualifies?
- Which documents and attestations are required now?
- Where is the claim filed, and how is an acknowledgement obtained?
- What is the deadline, review process or appeal route if the claim is rejected?
- Can the registration or benefit be used after migration, and which office verifies it?
- Does the board have a current arrangement with a health authority or provider, and where can it be used?
Common mistakes that delay or defeat claims
Assuming a national benefit amount
There is no single amount established for every board scheme in the national descriptions. A figure from one State, an old notification or a social-media post may not apply to the worker’s board.

Confusing a board card with labour-law coverage
A registration card helps establish beneficiary status for board schemes. It does not replace wage records, an appointment letter, safety reporting or proof of employment.
Letting registration expire
Workers often focus on the original registration and overlook renewal or updates. Check the active status before a medical, education, maternity or death-related event occurs.
Using an outdated 1996-Act explanation
The 1996 BOCW conditions law has been subsumed into the OSHWC Code, and the cess framework into the Social Security Code. Use current Code terminology while recognising that State board offices still administer practical schemes.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAssuming convergence equals universal access
The reported 14 State/UT memoranda and efforts to connect boards with PM-JAY show active coordination. They do not prove that every registered worker has identical health access in every location.
A practical decision sequence for workers and contractors
- Classify the need: wage, safety, employment record, board welfare, health, migration or social security.
- Check the legal relationship: identify the employer or establishment for an employment claim and the State/UT board for a welfare claim.
- Verify current status: confirm the effective date of the worker’s registration, the 90-day work evidence and any renewal requirement.
- Read the specific scheme or rule: identify the qualifying event, amount, deadline, documents and payment channel.
- Keep parallel records: retain wage slips or payment evidence, appointment information, safety reports, board registration details and claim acknowledgements.
- Escalate to the right authority: do not send a wage dispute to a welfare-board desk or expect a board to substitute for a site-safety investigation.
Contractors and principal employers should make the same distinction when explaining rights to crews: provide employment and safety information under the Code framework, and separately help eligible workers find the correct board registration and scheme information.
Bottom line for a construction worker
The Labour Codes give the national baseline for wages, payment timing, employment documentation, health and safety, migrant-worker portability and social-security structures. The BOCW Welfare Board is the local delivery route for targeted assistance such as life or disability support, health and maternity help, children’s education, housing, skills, pensions and other State-approved schemes.
To find out what a particular worker can actually receive, start with the State or UT, confirm active registration and the 90-days-in-12-months eligibility test, then read the current scheme conditions. Treat every board benefit as conditional on that local scheme; treat wage and safety protections as employment rights under the Labour-Code framework. This approach avoids both extremes: missing a welfare claim because registration was never completed, and assuming that a general category on a government list guarantees an identical payment everywhere.
