Control construction labor cost with a detailed written scope, a documented and limited deposit, milestone payments tied to inspectable work, and clear rules for changes, delays and warranty claims. There is no reliable national “average” labor price: trade, region, access, schedule, scope and contract type can change the number substantially. Deposit limits, contract thresholds, cancellation rights and warranty periods are set by the law that applies where the property is located.
What a construction labor contract must establish
A contract is the cost-control system for the entire job. California’s Contractors State License Board (CSLB) describes the purpose clearly: “A thorough contract tells how the work will be done, when it will be done, what materials will be used and how much it will cost.” A quote or a few text messages rarely provide enough detail to resolve a disputed scope, delay or extra charge.

Identify the parties and authority to work
- Legal name, business address, phone number and license number of the contractor.
- Names of the owner, contractor and any party authorized to approve changes.
- Who obtains building, trade and utility permits, and who pays permit fees.
- Required insurance, workers’ compensation coverage and any statutory home-warranty or building-cover evidence required locally.
The Federal Trade Commission (FTC) advises consumers to obtain the contractor’s name, address, telephone number and license number, along with written estimates for start and completion. Verify those details with the relevant licensing authority before paying.
Define labor, materials and exclusions
Use a line-item scope rather than a general phrase such as “renovate kitchen.” Separate labor, materials, equipment, allowances, taxes, disposal and cleanup. State brands or performance standards where they matter, who supplies each item, and what is expressly excluded. Identify prime-cost items and provisional sums as estimates rather than fixed prices; Consumer Affairs Victoria warns that both can move the final amount.

Set the price and payment mechanics
State whether the price is fixed, unit-priced or time-and-materials. For a unit-price job, list each unit, estimated quantity and method of measurement. For time-and-materials work, state labor rates by trade, overtime rules, equipment charges, markup and the records that accompany an invoice. Include the deposit, each payment date or milestone, invoice-support requirements, retainage if any, lien releases where applicable, and the event that makes the final payment due.
Set the schedule and protections
Include the planned start date, milestone dates, substantial-completion date, final completion or punch-list deadline, inspection responsibilities and allowable delays. Explain how a delay notice is delivered, how many days the contractor has to notify the owner, and how an extension is calculated. Add warranty duration and claim procedure, cancellation rights, termination for cause or convenience, dispute steps and the governing law.
Every verbal promise and every change to scope, price or schedule should become a signed writing. CSLB says written changes become part of the contract, and CIAP Document 102 treats a written change order as the owner’s authorization for a variation whether or not the variation changes price or time.

Do not treat a deposit as a blank check. Ask exactly what it purchases, when those costs are incurred, whether materials are returnable, and what happens if the contractor cannot start. The FTC’s consumer guidance is direct: “Don’t pay the full amount for the project up front.” Deposit caps are not nationwide rules, so the examples below must not be applied outside their jurisdictions.
| Jurisdiction and source | Published guidance | How to use it |
|---|---|---|
| California, CSLB consumer guidance (current, accessed 2026) | Down payment should not exceed 10% of the contract price or $1,000, whichever is less, subject to the board’s stated bond exception. | Use the lower amount as a consumer-protection benchmark only when California law applies; confirm the exception and current wording with CSLB. |
| Virginia, Department of Professional and Occupational Regulation (DPOR) consumer guide (current, accessed 2026) | Suggested initial deposit of 10% or $1,000, whichever is less; custom or special-order work may justify up to 30%. | Require an itemized explanation and proof of the special-order commitment before agreeing to a higher amount. |
For a deposit that has been paid but work has not started, the answer depends on the signed cancellation clause, local law and whether the contractor has already bought non-returnable custom materials. Request a written accounting, ask which amounts are refundable, and follow the contract’s notice and dispute process. Do not assume that “nonrefundable” is enforceable in every jurisdiction.

How to schedule progress payments
Milestone payments protect both sides better than paying a fixed percentage on dates that do not correspond to completed work. Each milestone should be observable, documented and capable of inspection before payment.
| Example milestone | Evidence to require before payment |
|---|---|
| Mobilization and permitted start | Insurance and license verification, permits issued where required, site protection and delivery records. |
| Demolition or site preparation complete | Photographs, disposal receipts where relevant and confirmation that concealed conditions have been reported. |
| Rough-in complete | Trade inspections or approvals, installed quantities and a list of items still open. |
| Substantial completion | Operational tests, completed fixtures and a written punch list with target dates. |
| Final completion and acceptance | Resolved punch list, final inspection, warranties, manuals, as-built information and required lien releases. |
Put invoice timing in the contract: for example, an invoice may be submitted after a milestone, with a defined review period and payment deadline. Retain a stated amount until completion and acceptance rather than paying 100% early. Consumer Affairs Victoria cautions that home-warranty insurance may not cover work paid for before completion, so payment timing can affect protection.

1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesFederal procurement rules illustrate why payment language must be precise, but they are not household-construction law. Under the cited Federal Acquisition Regulation (FAR) text, qualifying federal construction progress-payment requests have a 14-day payment period, while retained amounts are due as the contract specifies or, if unspecified, 30 days after approval. The cited FAR Part 32 progress-payment rule also sets a 10% maximum retainage. A private homeowner should use those figures only as examples of contract administration, not as automatic rights.
Choosing a price structure
Fixed price
A fixed price provides a defined total for a defined scope. It works best when plans, selections and site conditions are sufficiently known. It does not make unknown work free: concealed conditions, owner-requested upgrades and signed changes can still add cost. The contract should state exactly what is included and the exceptions that permit an adjustment.
Unit price
Unit pricing is useful when quantities cannot be measured accurately before work begins, such as excavation or remediation. List the unit rate, measurement method, estimated quantity and approval process for quantities that exceed the estimate.

Time and materials
Time-and-materials pricing can start work before the full scope is known, but it shifts cost risk to the owner. Set hourly rates, overtime, equipment and delivery charges, material markup, daily records, a not-to-exceed amount or regular cost reviews, and the right to inspect supporting records.
Is there an average construction labor cost?
No reliable, current national average was established in the authoritative material for this topic. Labor varies by trade, region, access, project complexity, schedule pressure, subcontracting and whether the agreement is fixed-price, unit-price or time-and-materials. Obtain comparable written bids using identical plans, allowances, exclusions and completion requirements. A low headline number may simply omit permits, prep work, cleanup, supervision or finish work.
Change orders: the only safe way to change the deal
A change order is a signed amendment that identifies the added, deleted or substituted work; labor and material price adjustment; allowance or unit-rate basis; schedule effect; and any revised payment milestone. Require drawings, samples or product specifications when the change affects appearance or performance.
- Describe the requested change in plain language and mark the affected plan or scope item.
- Obtain a written price breakdown for labor, materials, taxes, equipment and credits for deleted work.
- State the number of days added or removed and identify any effect on inspections or successor trades.
- Have the owner and contractor sign before the changed work starts, except for an emergency needed to protect people or property.
- Attach the signed order to the contract and update the payment schedule and completion date.
“We’ll sort it out later” is not a substitute for authorization. If a concealed condition requires immediate action, document photographs, the reason for urgency, the work authorized and a not-to-exceed amount, then execute the formal change order promptly.
What happens when the contractor is delayed?
Start with the baseline schedule and the delay clause, not assumptions about weather or labor shortages. The contract should distinguish excusable events, owner-caused delays, permit or inspection delays, material lead times, subcontractor failures and events within the contractor’s control.

Use a written notice process
- Record the missed milestone, affected activity, date discovered and current site condition.
- Require the contractor’s notice to identify cause, expected duration, mitigation steps and revised completion date.
- Check whether the event qualifies for an extension under the signed clause and whether costs are allowed.
- Issue a written schedule update showing successor activities, inspections and material deliveries.
- If delay continues, follow the contract’s cure, mediation, termination and refund provisions rather than withholding arbitrary amounts.
FTC guidance recommends written estimated start and completion dates, and CSLB says contracts should include allowable delays. Neither source makes every weather event, labor shortage or late owner selection an automatic excuse. Apply the actual clause and the law of the property’s jurisdiction.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Warranty language that protects the owner
Separate three protections: the contractor’s workmanship warranty, manufacturer warranties for supplied products, and statutory rights that may apply regardless of contract wording. The contract should state what labor is covered, duration, exclusions, response time, who pays diagnostic or opening-up costs, how a claim is submitted, and whether the contractor must return to repair or reimburse reasonable correction costs.
New South Wales provides a useful example of statutory protection: government guidance says builders and tradespeople must guarantee that work is fit for purpose, performed diligently and delivered within a reasonable timeframe in line with the contract. The NSW Government also states that statutory warranties can apply even when they are not written into the contract. Other jurisdictions use different periods, standards and remedies, so do not copy a NSW warranty period into a California, Virginia or other contract.
At handover, collect warranty certificates, manufacturer instructions, serial numbers, inspection approvals, maintenance requirements and the address for submitting claims. A warranty that has no claim method or response deadline is difficult to enforce in practice.

How to compare labor bids without being misled
- Scope completeness: compare labor inclusions, materials, allowances, exclusions, cleanup and disposal line by line.
- Price structure: identify fixed, unit or time-and-materials pricing, escalation clauses, provisional sums and markup.
- Schedule: compare start date, milestone dates, completion date, inspection dependencies and extension rules.
- Cash exposure: compare deposit, invoice timing, retainage and the trigger for final payment.
- Protection: verify license, identity, insurance, statutory cover, workmanship warranty and dispute process.
- Documentation: assess the quality of plans, change-order form, invoices, daily records and acceptance checklist.
Ask each bidder to price the same drawings and allowances. Require written answers to exclusions and have the contractor identify assumptions about access, working hours, utilities, structural conditions and owner-supplied items. A bid that cannot explain its assumptions is not genuinely comparable.
If the contractor requests more money
Request a written explanation tied to a contract clause, allowance or signed change order. Check whether the increase results from an owner-selected upgrade, provisional sum, prime-cost item, concealed condition or agreed escalation mechanism. Compare the request with the original scope and supporting invoices or measurements. Do not pay an unsupported increase merely because work has begun; document the dispute and use the contract’s notice, withholding, mediation or court process. Avoid physically obstructing the site or directing subcontractors while a dispute is unresolved, because that can create additional liability.
Pre-payment and handover checklist
- Written contract signed by the correct legal parties.
- Current license, identity, insurance and required statutory-cover evidence verified.
- Line-item scope with labor, materials, allowances, exclusions and permit responsibility.
- Deposit amount checked against local law and tied to a documented purpose.
- Milestones linked to inspectable work, with invoice records and final-payment conditions.
- Signed change-order procedure covering scope, price and schedule.
- Start, completion, delay-notice and extension rules written into the schedule.
- Workmanship warranty, manufacturer warranties and claim procedure identified.
- Inspection, acceptance, punch-list, cleanup and lien-release requirements defined.
- Cancellation, termination and dispute steps understood before money changes hands.
These controls do not guarantee that a project will never overrun. They make the price, schedule and remedies visible early enough for the owner and contractor to make informed decisions.
