Can You Get a Mortgage for a House Built Without Permits?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Possibly. A house with unpermitted construction is not automatically ineligible for a mortgage, but approval depends on whether the lender can accept the property as sound collateral. The appraisal, insurance, title search, local building authority and the lender’s own rules all have to support the transaction.

Expect the unpermitted work to be disclosed and analyzed rather than ignored. A lender may approve the loan, require legalization or repairs, limit how the area contributes to value, or decline the application if safety, legality, marketability, insurance or title risks cannot be resolved.

What “built without permits” means to a lender

Permit problems range from a missing permit for a relatively minor alteration to an entire addition, basement conversion or second dwelling built without approvals. The mortgage decision turns on what was built, how it was built, whether it can legally be used and how the condition affects the lender’s ability to sell the property after a default.

Different parties control different risks:

  • The building department determines the permit history, zoning status, required corrections and whether after-the-fact approval, demolition or a certificate of occupancy is needed.
  • The appraiser reports the unpermitted work, comments on its quality and appearance, and analyzes its effect on market value and marketability.
  • The insurer decides whether the existing condition is insurable and whether a policy excludes losses connected with unpermitted work.
  • The title company or real-estate attorney checks liens, ownership, recorded permits, zoning matters and title exceptions.
  • The lender decides whether the combined evidence is sufficient and may impose requirements stricter than an agency guideline.

Because these decisions are separate, satisfying one reviewer does not guarantee approval by the others.

What conventional appraisal guidance says

Fannie Mae

Fannie Mae’s Improvements section of the Appraisal Report, updated June 4, 2025, addresses additions that lack required permits. It instructs the appraiser to comment on the quality and appearance of the work and its impact, if any, on the subject property’s market value. The requirement is disclosure and analysis; it is not a categorical rule that every unpermitted addition must be rejected.

Fannie Mae also places responsibility on the lender to ensure that the property provides adequate collateral. The lender generally must obtain an appraisal that accurately reflects market value, condition and marketability. If the report cannot support those points, the lender can condition the loan or decline it even though the agency guidance does not impose an automatic ban.

Freddie Mac

Freddie Mac Section 5605.5, effective June 3, 2026, likewise says that when additions or alterations were made without required permits, the appraisal report should contain comments on the quality and appearance of the work. The practical result is similar: the work must be addressed in the valuation, while the lender retains the final collateral decision.

How the appraisal can change the loan

The appraiser needs a clear description of the work and enough evidence to judge it. The report may discuss construction quality, visible defects, utility connections, access, conformity with surrounding properties and the effect on buyer demand. The appraiser also has to decide how the area can appropriately contribute to value under applicable appraisal and local-use rules.

When the area supports value

If the work appears safe, durable and usable, and comparable sales provide credible support, the appraiser may conclude that it contributes to market value. That does not make the construction legal, but it gives the lender evidence that the collateral is marketable.

When the area is discounted or excluded

If the appraiser cannot verify the quality, cannot find credible comparable sales or believes buyers would discount the condition, the report may assign little or no contributory value to the unpermitted space. A value conclusion that depends on an unsupported addition can create a loan-to-value problem or trigger a requirement for correction before closing.

What to give the appraiser

  • A precise description of every addition or alteration, including approximate dates and dimensions.
  • Information about who performed the work and whether licensed tradespeople were involved.
  • Plans, invoices, inspection records, photographs taken during construction and any correspondence with local officials.
  • Details about plumbing, electrical, heating, structural changes, bedrooms, kitchens and separate entrances.
  • Evidence of any after-the-fact permit, legalization application or certificate of occupancy.

Do not conceal the work or describe an addition as original construction when it is not. Inconsistent statements can undermine the appraisal and the lender’s fraud and documentation checks.

Reasons a lender may decline or condition the loan

Safety or durability cannot be established

Open structural issues, unsafe electrical or plumbing work, water intrusion, inadequate egress or other hazards can make the property unacceptable collateral. A lender may require a licensed contractor or engineer to identify the problem and document an acceptable correction.

The use is not legally supportable

A finished basement, bedroom, accessory unit or commercial-style conversion may not be legal for the way it is represented. Local officials might require a new permit, zoning relief, a certificate of occupancy, removal of the work or restoration to an approved configuration.

Marketability is uncertain

Even sound construction can be difficult to finance or resell if buyers, appraisers or insurers are likely to avoid it. If comparable sales do not show how the condition affects price, the lender may decide that the collateral risk is too high.

Insurance is unavailable or restricted

The lender normally needs evidence that the property can be insured. Ask the insurer in writing whether the current condition is covered and whether the policy contains an exclusion for unpermitted work. A policy that omits the addition or leaves a material gap may not satisfy the lender.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Title or lien problems appear

Unpermitted construction can coincide with contractor liens, ownership disputes, unreleased claims or title exceptions. The lender may require a title insurance policy or an allowed alternative, such as an attorney title opinion letter, before closing.

The lender has a stricter overlay

Agency guidance is a baseline, not a promise of approval. A lender can adopt an overlay that requires permits, legalization, specific inspections, a repair escrow or complete exclusion of the area from value. Ask for the lender’s policy before paying for an appraisal or waiving contingencies.

Steps to take before you apply

  1. Build a complete project history. List every unpermitted improvement, when it was built, its dimensions, systems affected and current use. Gather plans, receipts, photographs and contractor information.
  2. Request the municipal file. Ask the city or county building department for permit history, approved plans, inspection history and any certificate of occupancy. Ask what process applies to an after-the-fact permit or legalization, what corrections are typical and whether demolition is a possible outcome.
  3. Check zoning and legal use. Confirm setbacks, lot coverage, bedroom and occupancy rules, accessory-dwelling requirements and whether the present use is allowed. Get written information when the department will provide it.
  4. Obtain an independent inspection. Use a qualified inspector and, where the work is structural or technically complex, a licensed contractor or engineer. Request a written description of safety and code issues, not merely a verbal opinion.
  5. Ask an insurer for a written position. Provide the property details and ask whether the existing condition is insurable, whether the addition must be scheduled separately and whether any exclusion applies.
  6. Order a title and lien review. Have a title company or real-estate attorney examine recorded permits, liens, easements, zoning references and other exceptions. Resolve defects before underwriting if possible.
  7. Interview lenders before submitting an application. Explain the work in writing and ask whether the lender will consider it, how the appraiser should treat it, what repairs or escrow would be required and whether the lender keeps the loan in its own portfolio.
  8. Keep contingencies in place. Make the purchase contract contingent on financing, appraisal, inspection, title and any permit or occupancy resolution you need. Do not assume a prequalification covers an unpermitted structure.

Loan paths to discuss

Option How existing unpermitted work is handled Documentation or conditions identified in the available guidance
Conventional agency loan The appraisal must disclose and analyze the work; approval depends on collateral, value, marketability, insurance, title and lender overlays. Accurate appraisal; lender may impose repairs, legalization or other conditions.
Renovation financing using HomeStyle Refresh May help when the lender is willing to finance eligible corrective improvements, but existing unpermitted construction is not guaranteed to qualify. Fannie Mae guidance updated August 5, 2026 describes plans or contracts, an “as completed” appraisal when applicable, completion certification, and title or insurance updates.
Portfolio loan The lender keeps the loan and can set its own underwriting approach; some lenders may consider facts that do not fit an agency execution. Requirements, pricing and fees are lender-specific and must be confirmed directly.

FHA, VA and USDA financing can be worth discussing when you otherwise meet the program rules, but the relevant lender still has to accept the property’s condition, appraisal, insurance and title. The fact that a program is government-backed does not by itself legalize construction or override local requirements.

Using renovation financing to correct the problem

A renovation structure can be useful when the lender agrees that the required work is eligible and can be completed under its controls. HomeStyle Refresh guidance updated August 5, 2026 calls for supporting documentation such as plans or contracts, an “as completed” appraisal when applicable, completion certification and updated title or insurance records.

That process is different from simply financing a house that already contains an unpermitted addition. The lender may require a defined scope of work, approved plans, inspections, draw procedures and proof that the final condition is legal and insurable. Ask whether the program can address your specific correction rather than assuming any existing structure qualifies.

Common scenarios

Unpermitted room addition

Provide the addition’s plans or measurements, disclose it to the appraiser, and determine whether local officials will legalize it. If the appraiser cannot support its contribution to value or the lender requires a permit, the transaction may need a correction plan or a different property.

Finished basement

Check ceiling height, egress, moisture control, electrical and plumbing permits, zoning and occupancy rules. A basement that cannot legally be used as represented may be valued differently and could require removal of fixtures or completion of code work.

Extra bedroom or converted garage

Bedrooms and conversions often affect egress, ventilation, parking and fire separation. Obtain a written local determination of the permitted use and give the appraiser evidence of the construction and comparable market treatment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Detached unit or second dwelling

Verify zoning, utility connections, access, separate-address rules and certificate-of-occupancy requirements. If the unit is not legal, do not market rental income from it to the lender unless the lender specifically accepts that treatment.

How to choose among approval, correction or withdrawal

  • Proceed as-is only when the building authority, appraiser, insurer, title reviewer and lender each confirm that no unresolved condition blocks closing.
  • Correct or legalize before closing when the work is potentially acceptable but officials or the lender require permits, inspections, repairs or an occupancy certificate.
  • Use renovation financing when the scope, plans, valuation and completion controls fit the lender’s renovation program.
  • Seek a portfolio lender when the property is sound but does not fit an agency overlay, while comparing the lender’s rate, fees, reserves and documentation demands.
  • Walk away or renegotiate when legalization is uncertain, demolition is possible, insurance is unavailable, title defects remain or the value cannot support the loan.

Questions to ask before waiving contingencies

  • Will you accept an appraisal that identifies unpermitted work, and how must the appraiser describe it?
  • Can the area contribute to appraised value, and what evidence is required?
  • Do you require permits, a certificate of occupancy, a repair escrow or completion before closing?
  • What insurance form and exclusions will underwriting accept?
  • Will you accept an attorney title opinion letter if title insurance is not available?
  • Does your policy differ for structural work, bedrooms, basements, garages or detached units?
  • If the loan is denied because of the condition, what contract deadline protects my deposit?

What is not known in advance

There is no universally applicable approval rate for homes with unpermitted construction. Outcomes depend on the property and jurisdiction, and agency guidance does not replace local permitting, appraisal, insurance, title or lender advice. Treat any promise of automatic approval—or automatic denial—with caution until the responsible parties review the actual records.
