If an English local planning authority has granted your neighbour planning permission, you cannot normally appeal to the Secretary of State simply because you disagree with the result. A resident may, however, be able to challenge the decision in court on a point of law—for example, an important procedural failure. The published guidance gives a six-week time limit, so identifying the decision and getting advice quickly matters.
This article concerns planning permission in England. It does not automatically cover building-control approval, listed-building consent, permitted-development prior approval, enforcement decisions, development consent, Wales, Scotland, Northern Ireland or another country.

Start by identifying what was approved
“Building approval” can describe several legally different decisions. The remedy depends on the exact document, the authority that issued it and where the project is located. Before considering a complaint or court action, obtain the decision notice and answer these questions:
Recommended Free Tools
- Is the property in England, and which local planning authority dealt with it?
- Was the decision planning permission, building-control approval, listed-building consent, permitted-development prior approval, an enforcement decision or another consent?
- Who made the decision: the local planning authority, a planning committee, an officer under delegated powers or the Planning Inspectorate?
- What is the date on the formal decision notice, and has any appeal already been decided?
- What specific legal or procedural error do you believe occurred?
These checks are not paperwork for its own sake. A procedure that applies to a pending planning application may not apply after permission has been granted, and a challenge to a Planning Inspectorate appeal decision is a separate stage from a challenge to the council’s original decision.

Can a resident appeal a neighbour’s planning permission?
In England, a third party does not have an ordinary appeal to the Secretary of State against a local planning authority’s grant of planning permission to someone else. The applicant has specified appeal rights; a neighbour’s disagreement with the planning judgment does not create the same right.
That does not mean there is never a remedy. The official guidance states that a local-authority grant can be challenged in the courts on a point of law. A court challenge asks whether the authority acted lawfully and followed the required process. It is not a second planning application and does not invite the court to choose the design it prefers.
What a court challenge examines
Examples given in the official guidance include how the decision was made and whether the correct procedures were followed. Depending on the evidence, a legal issue might involve a failure to follow a mandatory consultation or decision-making requirement, a misunderstanding of the legal test, or a material procedural defect. Whether a particular concern is legally sufficient depends on the decision record and professional assessment; an objection that a development is unattractive, inconvenient or likely to reduce value is not automatically a point of law.

What it does not provide
A court challenge is not a rehearing of every planning objection. The court generally considers legality, procedure and the limits of the decision-maker’s power rather than substituting its own view of planning merits. A resident should therefore frame the alleged error precisely, preserve the relevant documents and obtain advice rather than assume that strong opposition alone establishes a claim.
The six-week deadline is critical
GOV.UK guidance says a challenge to a local planning authority’s decision must be brought within six weeks. Treat that as a short statutory deadline, not as a target to consider later. The relevant date and route can depend on the decision type, so check the actual notice and obtain qualified advice promptly.

Do not assume that writing to the council, asking for a review, contacting an elected representative or submitting a service complaint stops the clock. The published material distinguishes complaints about administration from legal remedies and does not establish that a complaint suspends a court deadline.
Information to record immediately
- The date the decision notice was issued and the date you obtained it.
- The application reference, site address and description of development.
- The authority’s officer report, committee report, minutes and conditions, where available.
- Consultation responses and representations relevant to the alleged legal error.
- Any subsequent appeal, inspector’s decision or revised permission.
- A short chronology showing what happened, when and who made each decision.
Three different stages, three different routes
The most useful way to avoid a wrong remedy is to separate the stage of the case from the question of who is unhappy with it.
| Stage | Who may use the route | What is reviewed | Decision-maker | Timing or qualification |
|---|---|---|---|---|
| Application still pending | Residents and other interested people can make representations through the authority’s consultation process. | Planning merits and relevant material considerations before a decision. | Local planning authority or its committee/officer. | Use the consultation deadline shown by the authority; this is not an appeal. |
| Local authority has granted permission to the applicant | The applicant has specified appeal rights in some circumstances. A third party has no ordinary Secretary of State appeal. | A resident’s possible court challenge concerns legal or procedural validity, not a fresh merits decision. | Court for a legal challenge. | GOV.UK states six weeks for challenging a local-authority planning decision. |
| Planning Inspectorate has decided an appeal | An aggrieved person may seek a High Court challenge, subject to permission. | Legality of the appeal decision, rather than a general re-run of planning merits. | High Court, after the required permission stage. | The procedural guide describes six weeks beginning the day after the decision. |
If the application has not been decided yet
While an application is pending, the practical route is to submit a clear, relevant representation to the local planning authority by its stated deadline. Explain the planning effects you want the decision-maker to consider and identify supporting facts. Keep a copy and note the date submitted.
This pre-decision participation is different from an appeal. It gives the authority information before it decides; it does not guarantee a particular outcome and does not create a right to challenge every later planning judgment.
If permission has already been granted by the council
Step 1: obtain the complete decision record
Download or request the decision notice, officer report, committee papers, minutes, plans, conditions and relevant consultation material. Confirm whether the notice is a grant, a refusal, a discharge of conditions or another decision. A later amendment or fresh permission may change which decision must be examined.

Step 2: define the alleged point of law
Write the concern as a legal question rather than a general objection. For example: what required procedure is said to have been missed, what statutory test was allegedly misunderstood, or what part of the record shows the authority acted outside its powers? Avoid presenting speculation as established error.
Step 3: obtain urgent specialist advice
Because the six-week period is short, ask a planning or public-law solicitor, barrister or appropriately qualified legal advice service to assess the notice and record promptly. They can identify the correct defendant, documents, permission requirements and filing method. General information cannot determine whether your facts meet the legal test.
Step 4: do not rely on an informal complaint
You may still raise an administrative or service concern with the council, but treat that as separate. It should not replace checking the court route, and you should not assume it extends the six-week period.
Applicant appeals are not neighbour appeals
The Planning Inspectorate’s newer procedural guide applies to applications submitted in England on or after 1 April 2026. It says only the applicant may appeal specified decisions, including a refusal, certain conditions or the authority’s failure to determine an application in time. The guide sets different deadlines according to the type of appeal.
An applicant’s right to appeal therefore does not give a resident an equivalent right to appeal the grant. Check the application date before relying on the newer guide: the earlier procedural guide applies to applications dated on or before 31 March 2026. Do not apply the newer procedure retroactively.

What if the Planning Inspectorate has already decided an appeal?
A Planning Inspectorate appeal decision is a distinct decision stage. The procedural guide says an aggrieved person may seek a High Court challenge, but must first obtain permission. The application must be made within six weeks beginning with the day after the decision.
This route is still about legality, not a general request for the court to re-weigh planning merits. Preserve the inspector’s decision, the appeal documents, the original application material and the date of issue. If the decision notice states a different procedural detail, follow the applicable current guidance and obtain advice immediately.
Can a complaint to the council reverse the approval?
A complaint can be appropriate for an administrative or service issue—for example, a failure to answer correspondence or a concern about how a process was handled. The available guidance does not establish that a complaint can revoke a valid planning permission, substitute for a court challenge or pause a legal deadline.
Keep the two tracks separate:
- Service complaint: asks the authority to investigate administration or communication.
- Legal challenge: uses the applicable court procedure to contest the lawfulness of a decision.
- Planning representation: comments on a pending application before the decision is issued.
Sending a complaint may be sensible, but it is unsafe to wait for the complaint response before checking whether a six-week court period is running.

Common mistakes and how to avoid them
Calling every objection an appeal
After permission is granted, a neighbour’s objection is not automatically an appeal right. Use the accurate description—representation, complaint or possible court challenge—so that the authority and any adviser understand the stage.

Challenging the merits instead of legality
“The building is too large” or “the authority should have preferred another design” may be planning concerns, but they do not by themselves show a legal error. Link each proposed ground to the decision record and the procedure or legal test said to have been breached.
Using the wrong date
Calculate timing from the relevant formal decision, not from the day construction starts, a neighbour’s message or the day you happen to notice work on site. Appeal decisions have their own six-week formulation, beginning the day after the decision, so confirm which stage applies.
Assuming one UK procedure applies everywhere
The material covered here is limited to England planning permission. Procedures in Wales, Scotland and Northern Ireland, and procedures for building control or other consents, require separate checking with the responsible authority and court.

1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesA practical decision checklist
- Locate the decision: save the formal notice, plans, conditions and issue date.
- Identify the regime: confirm that it is English planning permission and not another approval.
- Identify the decision-maker: council or Planning Inspectorate.
- Identify the stage: pending application, local-authority decision or appeal decision.
- Identify your status: resident/interested person, applicant or potentially aggrieved person.
- Describe the alleged error: state the legal or procedural issue and the document supporting it.
- Check the deadline: treat six weeks as urgent and verify the calculation for the actual decision.
- Get advice: seek qualified help promptly; do not wait for an informal complaint response.
This checklist helps determine which distinct procedure may apply. It is general information, not a case-specific legal opinion, and a short deadline can make delay significant.
