Building Regulations Approval vs Planning Permission: What Homeowners in England Need to Know

Planning permission and building regulations approval are different checks. Planning permission deals with whether a proposed development is acceptable in planning terms. Building regulations approval deals with whether the work is designed and constructed to the required technical standards. A single project can need both, one, or neither formal application, depending on its location, design, permitted development rights, exemptions and the work itself.

This guide explains the distinction for homeowners in England. Scotland and Northern Ireland operate different building-regulations systems, and local restrictions or property designations can change the answer anywhere. Confirm the position with your local planning authority and a building control body before work starts.

The short answer: they are not the same approval

“Building permit” is a common general term, but England’s official terminology is usually building regulations approval. It is not a substitute for planning permission.

Planning permission asks whether the principle of the development is acceptable: for example, whether a proposed addition, change of use or other development fits planning policy, protects neighbours and respects the character of the area. Building regulations ask how the work will be carried out safely and competently. They cover technical matters such as structural stability, fire safety, ventilation, drainage, access and energy performance where the regulations apply.

The UK Government’s Building work, replacements and repairs to your home guidance (England, updated 3 November 2014) puts the distinction this way: “They relate to the specifics of how a building should be constructed unlike planning permission which is about the principle of whether development should go ahead or not.”

Because the systems test different things, approval under one does not grant approval under the other. You should check both before committing to a contract, ordering materials or starting demolition.

What each system is designed to control

Planning permission: whether the development is acceptable

Planning control considers the proposed development as it affects the use and appearance of land and buildings. The local planning authority may assess matters such as the scale and position of an addition, its effect on neighbours, the character of the street, access, parking, trees, heritage interests and local planning policies. The exact issues depend on the proposal and the site.

Some work is not treated as requiring a planning application because a permitted development right applies. That is a conditional legal route, not a blanket exemption. The proposal must satisfy the relevant limitations and conditions, and rights may be restricted or removed locally. A conservation area, listed-building status, an article 4 direction or another local constraint can affect what is permitted.

Building regulations approval: how the work must be built

Building regulations concern the technical performance and construction of building work. The question is whether the proposed work can meet the applicable standards and whether it will be inspected or assessed through the correct building-control process.

The requirement can arise even where planning permission is unnecessary. Conversely, planning permission can be needed for a proposal whose building-regulations position is limited or exempt. Formal approval is not a quality guarantee for every aspect of a project, and it does not resolve ownership, boundary, party-wall or other private-law matters.

Can a project require both?

Yes. A house extension is the familiar example, but the same issue can arise with alterations, conversions, structural changes, replacements and other work. Planning permission may be required because the proposal is development and no permitted development right covers it. Building regulations approval may be required because the work changes or creates building elements that must satisfy technical standards.

Do not infer the answer solely from a label such as “renovation,” “loft conversion” or “extension.” Two projects with the same broad description can have different outcomes because of their dimensions, location, previous additions, construction details, property status and local restrictions.

Question Planning permission Building regulations approval
Primary purpose Whether the proposed development is acceptable in planning terms Whether building work meets applicable technical construction requirements
Typical decision or assessment Local planning authority considers the proposal against planning rules and site circumstances Building control checks plans, notices and/or completed work against building regulations
Can permitted development affect it? Yes. A qualifying permitted development right may remove the need for a planning application if every condition and limitation is met No. Permitted development does not remove building-regulations or other consent obligations
Can an exemption affect it? Planning routes depend on the proposal and applicable rights or restrictions Some categories of work are exempt from a building-regulations application, but the exemptions are specific
Does one replace the other? No No

How to check before you start: an England workflow

  1. Describe the work precisely. Record what will be demolished, built, moved or changed; the external dimensions and height; the distance to boundaries; the intended use; and whether the work affects structure, drainage, escape routes, ventilation or energy performance. Gather existing drawings and photographs.
  2. Confirm the jurisdiction and property constraints. Check that the property is in England and identify listed-building status, conservation-area location, article 4 directions, local designations and any previous planning decisions or conditions. These facts can change the route.
  3. Ask the local planning authority whether planning permission is needed. Explain the proposal and request location-specific advice. If a permitted development right may apply, check every condition and limitation rather than relying on a general description of the work.
  4. Consider a lawful development certificate when permitted development is uncertain. In England, a homeowner can apply for a lawful development certificate to confirm that a proposal is lawful and does not require a planning application. It is a way to obtain a formal planning-law position; it is not building-regulations approval.
  5. Check building-regulations coverage separately. Contact a building control body and provide the plans and construction information it needs. Ask whether the work is exempt, what application route is suitable and what inspections or certificates will be required.
  6. Resolve other consents before signing off the job. Planning and building regulations do not automatically cover every obligation. Depending on the property and work, separate issues can include listed-building controls, party-wall procedures, drainage arrangements, access rights, lease conditions or agreements with neighbours.
  7. Keep written decisions and certificates. Save planning decisions, a lawful development certificate if obtained, building-control notices, plans, inspection records and the final building-regulations certificate. A future buyer or lender may ask for evidence.

Permitted development: useful, but conditional

Permitted development rights allow certain qualifying householder work in England to proceed without a planning application. The right applies only when the proposal falls within the relevant class and complies with all conditions and limitations. A right can be restricted or withdrawn locally, and the property may have a designation or planning condition that changes the position.

“No planning application” does not mean “no rules.” A permitted development project still has to comply with the limitations that define the right. It may also need building regulations approval, a lawful development certificate, or another consent.

When the position is unclear

Ask the local planning authority for advice using a clear written description and scaled drawings where possible. If you need documentary certainty that a proposal is lawful and does not require a planning application, consider a lawful development certificate. Do not treat a contractor’s informal statement that “it is permitted development” as a formal determination.

Building-regulations exemptions are narrow and specific

The government identifies categories of repairs, replacements and other work that may not require a building-regulations application. The exemption depends on the precise work, not simply on the homeowner’s description of it. The guidance also lists exceptions and advises contacting building control if you are unsure.

An exemption from making an application does not provide permission to carry out unsafe work. The underlying safety and energy-efficiency expectations still matter where they apply. Ask building control to confirm the position before work begins, especially where a replacement changes performance, where structural elements are involved, or where the work connects to other parts of the building.

Building-control application routes in England

For ordinary domestic work in England, official guidance describes routes through the local council or an eligible private registered building control approver. The appropriate route depends on the project and the provider’s eligibility. Fees depend on the work and the provider, so there is no single national price that can be responsibly quoted for every homeowner.

Full-plans route

A full-plans application generally involves submitting detailed plans and specifications for assessment before or as the work starts. It can be useful where the design is complex or where you want the technical proposals reviewed in advance. Confirm the exact submission requirements and inspection arrangements with the building control body you choose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Building-notice route

A building notice is another route described in the England guidance for eligible work. It is not automatically suitable for every project, and it may provide less design detail for advance assessment than a full-plans submission. Ask the building control body whether the route is available and appropriate for your work.

Retrospective regularisation

If building work was carried out without the required approval, a building control body may be able to consider a regularisation application. This is a retrospective route, not a convenient alternative to applying before work starts. Opening up or altering completed work may be necessary so that compliance can be assessed, and the outcome depends on the actual construction.

Ask about the route before starting. Retrospective regularisation can be more disruptive and uncertain than arranging approval and inspections in advance.

Who deals with which question?

  • Local planning authority: whether the proposal needs planning permission, whether a permitted development right may apply, and whether a lawful development certificate is appropriate.
  • Building control body: whether building regulations apply, which application route is available, what information is required and how inspection or certification will work.
  • Other authorities or professionals: any separate consent or specialist issue created by the property or project. The planning and building-regulations checks do not automatically settle these matters.

A planning authority cannot issue building-regulations approval, and a building control body cannot grant planning permission. You may use the council for both functions or, where eligible, use a private registered building control approver for building-control work; keep the two decisions clearly separated in your records.

Common homeowner scenarios

The examples below show why the project label alone is not enough. They are decision prompts, not automatic outcomes.

Proposed work Planning question Building-regulations question
House extension Is it development requiring permission, or does a qualifying permitted development right cover it without breach of its conditions? Will the new structure, foundations, fire separation, ventilation, drainage and other affected elements meet the regulations?
Loft or internal conversion Does the external change, use or property history trigger planning control, or is a permitted route available? Do structural alterations, stairs, escape, fire safety, insulation and ventilation require approval?
Repair or replacement Is the work development, and are there local or heritage restrictions? Does the particular repair or replacement fall within an exemption, or does the change require an application?
Change to a building’s use Does the proposed use require planning permission or another planning route? Will the change affect technical requirements for fire safety, structure, access, ventilation or other regulated matters?

What can go wrong if you check only one system?

You rely on planning permission alone

A planning approval establishes the planning position, not the technical acceptability of construction. Starting work without the required building-control route can leave you without the expected certificate and may require disruptive investigation or remedial work.

You rely on building regulations approval alone

Building control does not make a development lawful in planning terms. Work can satisfy technical standards while still needing planning permission, or while breaching a permitted development condition or local restriction.

You assume permitted development covers everything

Permitted development rights are conditional and may be limited or withdrawn. Check the actual site and proposal, and consider a lawful development certificate if you need formal confirmation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

You treat an exemption as a blanket waiver

Building-regulations exemptions apply to defined categories. A similar-looking job can fall outside an exemption when its materials, structure, location or effect on the building differs.

You start before the route is agreed

Applications, notices and inspections are easier to manage before demolition or concealment. If work is already covered up, proving compliance can become harder and a regularisation route may be required.

Questions to ask before appointing a contractor

  • What exact work is included in the quotation, and which drawings describe it?
  • Who will contact the local planning authority and building control body, and who will pay the relevant fees?
  • Which written planning decision, permitted development assessment or lawful development certificate supports the planning position?
  • Which building-control application route will be used, and when will inspections take place?
  • What certificates and completion documents will be handed over?
  • What happens if an inspector or planning officer requires a design change?
  • Are separate consents or agreements needed because of the property’s status, lease, boundaries or neighbours?

Put the answers in the contract. A statement that approvals are “included” is not enough unless it identifies the authority, route, responsibility and documents you will receive.

England is not the whole of the United Kingdom

The explanation above is specifically for England. Scotland and Northern Ireland have different building-regulations rules and administrative arrangements. Wales also has its own planning and building-regulations framework. If the property is outside England, use the relevant national guidance and local authority rather than transferring the English process unchanged.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Even within England, the answer can vary by local planning authority and by property. Local restrictions, heritage status, previous permissions and site-specific conditions can alter whether a proposal is permitted development or needs an application.

A practical decision checklist

  1. Write a precise scope of work and identify the property’s location and status.
  2. Ask the local planning authority whether planning permission is required.
  3. Check every condition and limitation if relying on permitted development.
  4. Consider a lawful development certificate where the planning position needs formal confirmation.
  5. Ask building control whether the work is covered by building regulations and whether an exemption applies.
  6. Choose and submit the appropriate building-control application before work starts.
  7. Arrange inspections and keep plans, notices, decisions and certificates.
  8. Check for separate consents and confirm the final paperwork before treating the project as complete.

The safest sequence is to obtain a location-specific planning answer and a separate building-control answer before construction begins. That prevents a permitted development assumption from being mistaken for technical approval, and prevents a building-regulations certificate from being mistaken for planning consent.

Frequently Asked Questions

Do I need planning permission and building regulations approval for an extension?

Possibly both. Planning permission depends on whether the extension is development requiring consent or qualifies under every condition of a permitted development right. Building regulations depend on the technical building work. Ask the local planning authority and a building control body separately before starting.

Is building regulations approval the same as planning permission?

No. Planning permission concerns whether development is acceptable in planning terms. Building regulations approval concerns how applicable building work is designed and constructed. One does not replace the other.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I extend my house without planning permission?

In England, some qualifying householder extensions can use permitted development rights, but only when all conditions and limitations are met and no local restriction removes or limits the right. Building regulations and other consents may still apply.

What if work has already been completed without building regulations approval?

Ask a building control body whether a retrospective regularisation application is available. Assessment may require opening up or altering completed work, and the result depends on the construction. It is generally better to establish the route before work starts.

Where can I get a definitive answer for my property?

Give the local planning authority a precise description and drawings, and ask a building control body separately about building-regulations coverage and the appropriate application route. A lawful development certificate can provide formal confirmation of a lawful planning position in England.
