It must give children with disabilities an equal opportunity to enroll, move through the building, use toilets, communicate, evacuate, and participate in learning and play. Start by identifying which ADA title applies to your operation, then inspect the entire experience from drop-off through pickup. Use the checklist below to document barriers, make readily achievable corrections, and identify work that needs design, permits, or review by your local authority having jurisdiction (AHJ).
1. Determine which ADA rules cover your center
The operator and program determine the legal framework. The U.S. Department of Justice identifies privately run child-care centers, government-run centers, before- and after-school programs, and summer programs as ADA-covered categories. Private centers generally analyze their obligations under Title III, while programs operated by state or local government analyze Title II. A religious organization’s child-care program can be treated differently under the ADA, so obtain a jurisdiction-specific legal determination rather than assuming an exemption.

| Center or program characteristic | Initial ADA analysis | What to verify |
|---|---|---|
| Private, nonprofit, or for-profit center | Usually Title III as a place of public accommodation | Equal access, reasonable modifications, effective communication, new-construction and alteration requirements, and readily achievable barrier removal for existing facilities |
| State, county, city, school-district, or other public operator | Title II | Program access, nondiscrimination, effective communication, and applicable construction or alteration standards |
| Before- or after-school or summer program | Covered when operated by a covered public or private entity | Access to the host building, transportation or field trips, outdoor activities, and communications during schedule changes |
| Religious organization or program | Requires a fact-specific analysis | Organizational status, funding, facility use, and any overlapping state or local requirements |
| Family child-care residence | Some play-area rules contain a residence exception | Whether the site and use actually meet the exception; do not extend it to unrelated building or program obligations |
Document the operator, each program offered, the buildings and playgrounds used, and any shared spaces. Then check state licensing rules, building and accessibility codes, fire requirements, and lease responsibilities. The ADA is a federal baseline; a state or local rule can impose additional requirements.
2. Make enrollment and participation nondiscriminatory
Use an individualized assessment
A center must evaluate a particular child’s needs and the services it can provide, not reject an application based on a diagnosis, a perceived severity, or an assumption that the child will need too much help. The Justice Department states: “A child with a disability must never be turned away from a child care center based on assumptions about the severity of the disability or how much assistance they may need.” Assess toileting, feeding, medication, mobility, communication, behavior, sensory needs, and emergency assistance through a documented, collaborative process with the family.

Write a reasonable-modification process
Publish who receives requests, how families can submit them, the information needed, and when the center will respond. Review policies that automatically exclude children who are not toilet trained, need medication, use mobility equipment, require a communication device, or need behavioral support. A modification may be required unless it would fundamentally alter the program or create a direct threat that cannot be reduced through reasonable measures. Decisions should be based on objective, current information and recorded with the reasons, alternatives considered, and follow-up date.
Include families in communication
Offer accessible ways to receive enrollment information, schedules, incident notices, and policy changes. Ask each family about preferred formats and languages. For a weather closure, for example, a center might provide email or text in addition to telephone calls. Keep communication methods usable for parents and guardians who are deaf, hard of hearing, blind, have low vision, or have speech or cognitive disabilities.
3. Run a documented site walk
- Assign responsibility. Name a director or facilities lead, involve teaching staff and families, and identify the AHJ or accessibility professional to consult for complex work.
- Map the user journey. Trace parking or drop-off, the public entrance, reception, classrooms, multipurpose and dining rooms, offices serving families, toilets, playgrounds, gardens, evacuation areas, and exits.
- Measure and photograph. Record door clearances, thresholds, route widths, slopes, turning areas, fixture reach, surface condition, and sign locations. Photograph each barrier with its location and the activity it affects.
- Prioritize participation. Address barriers that block entry, toileting, evacuation, or access to core learning and play before cosmetic improvements.
- Assign and verify. Give every corrective action an owner, cost range, target date, permit status, and verification date. Reinspect after installation and retain plans, invoices, product specifications, and training records.
A useful deficiency log has these fields: location; barrier; affected child activity; proposed correction; responsible person; whether the work is maintenance, readily achievable removal, or a design/permit project; estimated cost range; target date; and completion evidence.
4. Arrival, parking, and entrances
Parking and drop-off
- Check accessible parking spaces, access aisles, signs, curb ramps, and the route from parking or drop-off to the entrance.
- Keep the route firm, stable, slip resistant, and free of vehicles, storage, snow, mud, hoses, and trip hazards.
- Inspect changes in level, drainage, cross slopes, lighting, and conflicts with gates or security controls.
Entrance and door operation
Provide at least one usable public entrance connected to an accessible route. If not every entrance is compliant, identify the accessible entrance with compliant signs and directional signs from the other approaches. Keep that route in the same general circulation area as other pedestrian routes rather than sending families through a service area.

Check each door’s clear opening, maneuvering clearance, threshold, opening force, hardware, closing speed, and ability to be used without tight grasping or twisting. A common existing-building correction is an offset hinge that increases the clear opening; confirm the door, frame, fire rating, and hardware remain compatible before ordering. Do not rely on a ramp if a heavy or narrow door still prevents entry.
5. Interior circulation and activity rooms
Trace a continuous, unobstructed accessible route to every space where children learn, eat, rest, receive services, or attend activities. Remove furniture, cubbies, stacked supplies, rugs, cords, and temporary displays that narrow the route. Include routes to family-service offices, staff-assisted areas, exits, and emergency shelters.
In each classroom and multipurpose room, provide enough maneuvering space for a child using a mobility device to enter, turn, approach activity stations, and remain with peers. Arrange tables, chairs, shelves, and sensory equipment so a child is not separated from the group. Check flooring transitions, glare, lighting, visual contrast, and the reachability of switches, controls, sinks, and storage that children are expected to use.

6. Toilets, diapering, and hygiene
Accessible toilet rooms and stalls
Provide an accessible toilet room or stall with the clear floor space, turning space, fixture locations, reach ranges, and grab bars required for the applicable construction standard. Verify the exact dimensions for the building’s edition, occupancy, and alteration scope; do not order components from a generic product diagram alone.
- Check the approach to the room, door maneuvering clearance, latch and closing force, and compliant sign.
- Confirm toilet centerline, transfer clearances, flush control, toilet-paper dispenser location, and grab-bar attachment to adequate structure.
- Check lavatory knee and toe clearance, faucet operation, pipe protection, mirror height, soap and towel dispensers, hand dryer controls, and accessory reach ranges.
- If the nearest compliant toilet is elsewhere, provide directional signs and a route that remains usable during operating hours.
Diapering and personal care
Review changing tables, diapering rooms, bathing areas, and hygiene procedures as part of the route—not as a separate staff-only issue. A child who needs assistance must be able to reach the service area and be handled safely without being denied participation. Keep transfer surfaces stable, maintain required clearances, secure supplies outside the maneuvering space, and train staff in respectful assistance and privacy.
Installing grab bars is a frequent barrier-removal project in an existing center, but wall reinforcement, fastener type, clearance, and corrosion resistance must be verified before installation.

7. Playgrounds and outdoor learning
Know when Section 240 applies
Section 240 of the 2010 Standards applies to play areas designed for children age two and older, subject to the specific family-child-care-residence exception where it actually applies. Confirm the age range, ownership, and use of each play area rather than assuming that a small or informal yard is excluded.

Connect ground-level and elevated play
Provide an accessible route to the play area and connect required ground-level and elevated play components and their entry and exit points. The route should reach meaningful play choices, not stop at the perimeter. Include gardens, sand or water tables, shade structures, outdoor classrooms, and gathering areas in the route review when children are expected to use them.
Inspect surfacing
Play surfaces must remain firm, stable, and usable, with openings, slopes, transitions, and impact performance appropriate to the equipment and standard. Loose pea gravel is a common barrier; the Justice Department gives replacing playground pea gravel with ADA-compliant material as an example improvement. Inspect after rain, freeze-thaw cycles, grading work, and heavy use because a surface that was accessible at installation can become rutted or displaced.

Communication access
Make schedules, menus, closure notices, incident reports, consent forms, and family meetings available through effective communication methods. Do not assume that a single phone call works for every family. Offer alternatives such as accessible electronic messages, text, captioned or interpreted meetings, large print, or other formats when needed.
Evacuation and shelter
Include children with disabilities in fire, severe-weather, lockdown, and shelter procedures. Create individual assistance plans with the family and staff who will be present, identify evacuation routes and refuge locations, and practice without isolating the child from peers. Assign assistance based on the child’s actual needs, mobility equipment, communication method, and the scenario—not on a diagnosis alone. Keep routes, exits, and refuge areas clear during normal operations.

9. Existing centers: barrier removal versus alterations
For an existing private center, Title III uses a readily achievable barrier-removal standard: removal must be easily accomplishable and able to be carried out without much difficulty or expense, considering the center’s resources and circumstances. DOJ examples include offset hinges to widen a door opening, installing grab bars in toilet stalls, and rearranging tables and chairs. Keep a written evaluation of the barriers, alternatives, resources considered, and work completed.
New construction and alterations must follow the 2010 ADA Standards’ scoping and technical requirements, including accessible routes, entrances, toilet rooms, signs, and play areas. A project that looks like maintenance can become an alteration when it changes a route, room layout, door, plumbing, playground, or surface. Ask the design professional and AHJ whether permits, plan review, structural work, fire-rating coordination, or inspections are required.

10. Choose upgrades by access outcome, not appearance
When several fixes are possible, compare them against the same criteria. The lowest purchase price may create more maintenance or leave a child unable to reach the activity.
| Decision factor | Questions to ask |
|---|---|
| Access outcome | Does the option create a continuous route and access to the actual activity, toilet, or entrance? |
| Dimensional compatibility | Does it fit the 2010 Standards and the existing building, equipment, clearances, and turning areas? |
| Durability and cleanability | Will it withstand frequent washing, spills, outdoor weather, and high child-care traffic? |
| Installation and permitting | Does the work affect structure, plumbing, electrical systems, fire ratings, drainage, or permits? |
| Total cost | What are purchase, labor, inspection, repair, replacement, and routine-maintenance costs? |
| Inclusion | Does it help users with mobility, sensory, hearing, vision, communication, or cognitive disabilities? |
11. Verify locally and keep the record current
Use this checklist to find issues, then confirm technical details with the AHJ or a qualified accessibility professional. Local amendments, licensing rules, fire codes, site drainage, historic-building constraints, and landlord responsibilities can change the correct solution. Retain surveys, photographs, measurements, product data, permits, inspection results, staff training records, accommodation decisions, and family communications.
Reinspect on a schedule and after construction, furniture changes, playground resurfacing, severe weather, or a reported access problem. A center is more likely to sustain access when the checklist becomes part of opening inspections, room-reset procedures, preventive maintenance, enrollment review, and annual emergency drills.
