Start by contacting your mortgage servicer—not by sending a generic bundle of paperwork. Ask for its current short-sale checklist, the correct submission channel, and whether your loan requires a Borrower Response Package (BRP) or qualifies for streamlined documentation. The investor that owns or guarantees the loan and the servicer’s instructions determine what makes your submission complete.
What a short-sale package does
A short sale is a sale of the mortgaged property for less than the amount needed to satisfy the mortgage. The package gives the servicer information to review the borrower’s situation and the proposed transaction. The exact requirements vary by loan and review path, so the servicer’s current checklist—not a generic online document list—should control.
How to submit the package

Ask the servicer for its current requirements
Call or write the company that services your mortgage. Request its short-sale checklist, required forms, submission method, signature and file-size rules, and a case number or contact person. Complete borrower forms if requested
When a BRP is required, Fannie Mae identifies Form 710, or an equivalent application, as a way to provide financial and hardship information and attestations. Follow the servicer’s checklist for supporting records; do not assume that every borrower must provide the same items. See Fannie Mae’s short-sale guidance.

Coordinate the listing with a licensed real estate professional
Fannie Mae’s workflow calls for a licensed real estate agent who is not a borrower on the mortgage. Freddie Mac requires the property to be listed with a licensed broker and sets specific MLS conditions. Confirm which rules apply to your loan before accepting an offer. Freddie Mac’s requirements appear in Single-Family Seller/Servicer Guide, Section 9208.1.

Send the signed offer documents
Once you have an offer, Freddie Mac requires a fully executed sales contract and addenda, plus a preliminary settlement or closing disclosure statement when available. Submit them through the channel the servicer specifies. If an initial offer arrives incomplete, Fannie Mae guidance says the servicer should provide a checklist of the additional required documentation.

Keep proof of submission and track requests
Save copies of every uploaded file, email, fax confirmation, and written request. Ask the servicer to confirm receipt and whether the file is complete. Respond promptly if it asks for missing or updated documents; an incomplete package can affect when review timeframes begin.

Check the approval terms before closing
Compare the final transaction documents with the servicer’s written approval and have the closing professional address any differences before the sale closes. Fannie Mae’s workflow includes oversight to ensure the closing follows approved offer terms and identifies execution of Short Sale Affidavit Form 191 where applicable. Documents to expect
Use the servicer’s checklist as the definitive list. Official guidance identifies these common components, but they are not a universal or exhaustive package:
- A BRP, if required, including financial and hardship information and attestations through Form 710 or an equivalent application.
- A fully executed sales contract and its addenda once there is an offer.
- A preliminary settlement or closing disclosure statement when available.
- Additional borrower, property, title, lien, or offer information the servicer requests for the investor’s eligibility review or to complete an initially incomplete offer.
- Form 191, the Short Sale Affidavit, in the Fannie Mae closing workflow where applicable.
Listing rules and review timelines differ
Do not assume one investor’s listing or response rules apply to every mortgage. For Freddie Mac, Section 9208.1 requires a licensed broker to list the property on the applicable MLS for at least five consecutive days. The period must include a Saturday and Sunday, and the listing must be active for the five days immediately before the borrower accepts and submits the offer to the servicer.
Fannie Mae’s servicing requirements set different milestones: acknowledgment of an initial offer within five business days; a written response within 30 calendar days after receipt of a complete BRP, if required, and the initial offer; a response to a revised offer within ten business days; and closing generally within 60 calendar days of approval unless an extension is requested and approved. These are Fannie Mae servicing-guide timeframes, not guaranteed deadlines for other investors or every case. The review clock described for the initial offer depends on receipt of the complete required BRP and offer, not merely on sending some documents.

What to do if the package is incomplete or delayed
- Ask the servicer to identify each missing or outdated item and whether it needs a new signature, a particular format, or a different submission channel.
- Resend only through an approved channel, and keep the confirmation or timestamp.
- Ask whether the servicer considers the file complete and what event starts the applicable review period for your loan.
- If an offer, approval, or closing date changes, tell the servicer promptly and ask what revised documents or extension request it needs.
