Can You Legally Hunt Animals That Invade Your Garden?

Garden damage does not automatically make wildlife legal to kill. Learn what to check about species, permits, firearms, trapping, relocation, and local rules.

Sometimes—but there is no single U.S. rule that lets you kill an animal just because it is damaging your garden. Legality depends on the animal, your state and local rules, your authority to act on the property, the damage or safety circumstances, and the method you plan to use. Identify the species and check the applicable wildlife rules and local ordinances before shooting, trapping, relocating, or hiring someone to remove it.

Why “critter” is not enough to determine what is legal

Wildlife laws generally turn on the animal’s species, not on whether a homeowner calls it a pest or nuisance. An animal that may be taken under specific conditions in one state may be protected, regulated, or subject to a permit in another. Some rules may also depend on the animal’s population or subspecies.

Garden damage does not automatically create permission to kill wildlife. For example, Virginia identifies particular nuisance species that may be taken at any time, but says other wildlife may not be taken unless a law or regulation allows it. What to check before taking action

  1. Identify the animal. Confirm the species as accurately as you can. If you are unsure or the animal may be protected, do not assume that a general nuisance rule applies.
  2. Check your state’s wildlife-agency rules. Look for the species classification, season, permit or license requirements, allowed methods, landowner exceptions, and any requirements for what happens after capture or killing.
  3. Check local rules for the exact property. City or county ordinances may restrict firearm discharge or trapping even when state wildlife rules allow a particular form of removal. State law and local safety rules are separate questions.
  4. Confirm who may act and where. Ownership or tenancy may affect what a landowner can do, but it does not necessarily override wildlife rules or authorize action on someone else’s land.
  5. Check what must happen afterward. A rule may specify whether an animal can be released, where it may be released, or how it must be handled. Do not assume that capture means you can relocate it anywhere.

How the rules differ by state

These official state examples illustrate why there is no nationwide answer. They do not determine what is legal in a different state or locality.

State What the official source establishes What that means for a garden owner
Oregon The 2025 edition of Oregon Revised Statutes Chapter 498 includes a general prohibition on taking wildlife contrary to wildlife law or rules, as well as a separate provision concerning wildlife that causes damage, poses a public-health risk, or constitutes a public nuisance. Oregon Revised Statutes, Chapter 498 (2025 edition) The damage-related provision is not a blanket authorization to kill any animal damaging a garden; the applicable rules and their context matter.
Indiana A resident landowner or tenant may capture certain listed wild animals without a permit on property they own or rent when an animal is causing or threatening damage or presents a health or safety threat. Other situations differ: rabbits outside legal season require a nuisance wildlife control permit, and taking wildlife on land not owned or rented requires a license or permit. Indiana also sets requirements for captured animals. Indiana DNR: Wildlife Removal Permits The exception is limited to covered animals, circumstances, people, and property. Check the agency’s current instructions for the particular animal and the required disposition after capture.
Virginia The wildlife department lists particular nuisance species that may be taken at any time, subject to local ordinances and land restrictions. Other wildlife may not be taken unless law or regulation allows it. Virginia DWR: General Information & Hunting Regulations Do not treat the word “nuisance” as sufficient: confirm that the species appears in the applicable rule and check local restrictions.
Illinois State law addresses permission to act on another person’s land and firearm discharge near inhabited dwellings. State administrative rules also require a permit for some paid nuisance-wildlife services. Illinois Compiled Statutes: Wildlife; Illinois Joint Committee on Administrative Rules: Part 525, Nuisance Wildlife Control Permission to act on a parcel does not settle whether a firearm may be discharged there, and paid removal can have separate requirements.
California The state wildlife agency publishes nuisance and living-with-wildlife guidance and notes that restricted or protected species may be governed by state or federal rules. California Department of Fish and Wildlife: Living with Wildlife—Nuisance Use the agency’s guidance for the animal involved; a general nuisance description does not establish that a particular removal method is permitted.

Does garden damage let you shoot the animal?

Not by itself. Before using a firearm, confirm that state wildlife rules allow taking that species in those circumstances and that the proposed method is lawful. Separately check local firearm-discharge restrictions and rules concerning inhabited dwellings or other people’s land. Illinois illustrates how land permission and firearm restrictions can be distinct legal issues; its rules should not be assumed to apply elsewhere.

If you cannot establish that shooting is allowed, do not rely on a generic “nuisance animal” label or on the fact that the animal is on your property. Contact the state wildlife agency or a properly authorized local professional for direction.

Can you trap or relocate an animal from your yard?

Trapping and relocation are also regulated; they are not automatic alternatives to hunting rules. Requirements can govern who may trap, which animals are covered, whether a permit is needed, and what must happen after capture. Indiana, for example, limits its landowner exception to certain listed animals and specified circumstances, and provides capture-disposition requirements. Indiana DNR: Wildlife Removal Permits

Before setting a trap, verify the rules for the exact species and location, including any release or handling requirements. If identification, safety, or legal requirements are uncertain, ask the wildlife agency or an appropriately licensed or authorized local professional rather than improvising.

What if you rent, hire help, or act on someone else’s land?

Check whether the rule applies to an owner, tenant, or both, and whether it limits action to property the person owns or rents. Indiana’s example distinguishes covered removal on owned or rented property from taking wildlife on land not owned or rented, which requires a license or permit. Hiring a remover does not necessarily eliminate permit requirements. Illinois administrative rules require a permit for some paid nuisance-wildlife services, so check the applicable state requirements before arranging removal. What can you do if removal is not clearly allowed?

  • Use nonlethal exclusion where suitable. Fencing or hardware cloth may help keep wildlife out, but the right material depends on the animal and site. Preventing access is not a substitute for checking rules that apply to handling or removing wildlife.
  • Ask the state wildlife agency about the exact species. Provide your location, what damage is occurring, and the action you are considering.
  • Check city or county codes before using a weapon or trap. State permission does not answer every local safety or land-use question.
  • Use an appropriately authorized professional when needed. This is especially prudent when the animal may be protected, is difficult to identify, or presents a safety concern.

How to get a definitive answer for your garden

To assess a specific case, you need two details first: where you are and what animal is involved. Then verify the current state wildlife-agency rule and local ordinance for the proposed action—shooting, trapping, relocation, or paid removal. Because seasons, permits, and local restrictions can change, check the official rules in force for your place and time before acting.
