Kauaʻi County Councilmember Fern Holland has introduced a bill that, as reported on October 6, 2026, would bar construction of a new landfill within six miles of a landfill that accepted waste during the previous 30 years. It is a proposal, not an enacted ordinance. Hawaiʻi Public Radio reported that it would not stop the County’s current work to expand capacity at the existing Kekaha Landfill.
What would the six-mile landfill bill do?
The proposed restriction would apply to construction of a new landfill within six miles of a landfill that accepted waste in the prior 30 years, according to Hawaiʻi Public Radio’s October 6, 2026 report. The report describes Holland as introducing the bill at a County Council meeting. The available reporting does not establish whether the Council has since advanced or adopted it.
Holland framed the proposal as a way to avoid repeating the decision to place Kauaʻi’s long-running landfill on a sensitive coastal plain. Kekaha has served the island since opening in 1953. “Kekaha has carried Kauaʻi’s islandwide waste burden for decades. We cannot undo the decision to locate that landfill on this environmentally sensitive coastal plain, but we can decide to not repeat that mistake,” Holland said, as quoted by HPR.
HPR also reported that residents who testified raised concerns about illness and landfill odors. Those concerns are testimony; the cited report does not establish that landfill exposure caused specific health effects.

Would the bill stop Kekaha’s expansion?
No, not according to HPR’s account of the proposal. The bill would not prevent ongoing work to expand capacity at the existing Kekaha site. That work is a separate County project: a proposed vertical expansion called Cell 3, intended as an interim measure while Kauaʻi develops a long-term landfill.
How do Cell 3 and the proposed Maʻalo landfill differ?

The two projects serve different roles. Cell 3 is meant to bridge the period before a new long-term site is ready; Maʻalo is the County’s proposed long-term site. The six-mile bill is a separate policy proposal and, as reported, would not halt Cell 3.

Where does Kauaʻi plan to build its next landfill?
The County identifies Maʻalo as its proposed long-term municipal solid waste landfill location. The County’s project description calls for a 270-acre facility, an approximately 2.8-mile access road, and supporting utilities. The County says permitting, design, and construction will take about 10 years. These are estimates for a proposed project, not evidence that permitting or construction is complete. The County says its selection followed three siting studies over 20 years and an evaluation of eight possible sites. The evaluation considered state and federal siting criteria, technical and engineering criteria, cost, and 26 community-based criteria; the County says Maʻalo ranked first in the community-criteria evaluation. This describes the County’s stated selection process, not a finding that the project has completed environmental review or received all approvals.

When will Kekaha run out of space?
Kekaha is Kauaʻi’s only permitted landfill. The County projects it will reach capacity around 2030. It describes Cell 3 as an interim expansion that could provide roughly 10 additional years of capacity, depending on future waste intake and waste-diversion strategies. That is a conditional estimate, not a guaranteed operating life.
County posterboards from a May 27, 2026 community meeting described Cell 3 as undergoing environmental review and forecast a final Environmental Impact Statement in July 2027, after a draft and public comment period. That was the schedule published at the time; the available sources do not confirm whether the milestones have changed.
