The applicant has the ordinary planning-appeal route. An affected person may be able to challenge the approval in court, but only on a point of law—not simply because they disagree with the planning decision. Government guidance gives a six-week period for challenging a local planning authority decision, so act promptly and verify the deadline for the specific decision.
Planning rules are devolved: this explanation covers ordinary local planning authority decisions in England, not Wales, Scotland or Northern Ireland.
Which route can an objector use?

The Planning Inspectorate’s planning appeal guidance describes appeals for applicants and says people can comment on an appeal. If a developer later appeals a refusal or conditions, making representations may let you put your views before the decision-maker, but it does not make you the appellant against the council’s original grant.
When can a court challenge a planning approval?
A court challenge is about a point of law in the authority’s decision-making. Government guidance on challenging planning decisions gives examples including whether the correct procedures were followed and whether an important consideration was taken into account. It is not an opportunity to ask a court to decide the planning balance again.

Disagreement with the council’s view of Green Belt harm, housing need, traffic or landscape is not, by itself, enough. A potential claimant needs to identify a specific legal flaw. Whether an error provides a viable ground depends on the decision and its record; this article cannot determine whether any particular approval was unlawful or whether a claim would succeed.
How long do you have?
Government guidance states a six-week period for challenging a local planning authority decision. Do not assume the clock starts when you personally discover the approval. The applicable start date and procedure must be checked against the decision and the type of challenge.

Because the period is short, do not wait for an informal complaint or correspondence with the council if that could put the deadline at risk. If you are considering proceedings, seek prompt advice from a solicitor experienced in planning law.
What to gather before seeking advice
- The decision notice, including its date and any conditions.
- The officer’s report or committee record explaining how the application was decided.
- The approved plans and other material documents for the proposal.
- The relevant planning policies and the specific legal error you believe may have occurred.
These records help an adviser assess the decision and the applicable deadline. An objection that the authority did not accept is not, on its own, proof of a legal error.

Does Green Belt policy make the approval unlawful?
No. Green Belt policy strongly restricts inappropriate development, but it does not impose an absolute ban on all development. The current England National Planning Policy Framework, published on 29 September 2026, says the Green Belt’s purpose is to prevent urban sprawl by keeping land permanently open; openness and permanence are essential characteristics. Its policy GB6 says: “Inappropriate development is, by definition, harmful to the Green Belt and should not be approved except in very special circumstances.”
Under GB6, inappropriate development should not be approved unless the potential Green Belt harm from inappropriateness and any other harm are clearly outweighed by other considerations. The policy gives substantial weight to Green Belt harm, including harm to openness. But the framework also sets out categories of development that are not treated as inappropriate, subject to their conditions. The decision therefore depends on what was approved, how the site and proposal were classified, and how the authority applied the relevant policy; being on Green Belt land alone does not establish that permission was unlawful.

The government’s Green Belt practice guidance explains that openness is assessed case by case and may involve spatial and visual aspects, volume, duration, remediability and the activity generated. Those matters may feature in the planning record. A court challenge would still have to identify a legal issue rather than invite the court to redo that planning judgment.
