For U.S. public highway bridges covered by the National Bridge Inspection Standards (NBIS), the State Department of Transportation (DOT) is ultimately responsible for ensuring required bridge inspections—even when a city, county, or other public authority owns the bridge. That is separate from construction-site worker safety: employers must maintain required safety programs and arrange regular job-site inspections by designated competent persons under OSHA rules.
Three different kinds of inspection
The word “inspection” can describe different work, performed for different reasons and under different rules. A person or agency responsible for one kind is not automatically responsible for the others.

These roles can involve different people. For example, an employer-designated competent person’s job-site safety inspection is not the same as an NBIS inspection by a qualified bridge inspector.
Who is accountable for NBIS inspections?
State and local public bridges
A state is ultimately responsible for ensuring NBIS inspections of covered public highway bridges located wholly or partly within its boundaries, including bridges owned by cities, counties, or other public authorities. A state may delegate inspection functions to a local agency or consultant, but delegation does not remove the state transportation department’s NBIS responsibility. A local bridge owner may perform inspection functions when those duties are delegated and the applicable state procedures are followed. The owner’s role in carrying out the work does not change which entity remains accountable under the NBIS framework.
Federal and tribal bridges
The federal agency with jurisdiction is responsible for ensuring NBIS inspections of public highway bridges under its jurisdiction. A federal agency may delegate functions, but delegation does not remove its responsibility. A tribal government is responsible for bridges under its jurisdiction and may delegate functions to the Bureau of Indian Affairs or FHWA through a formal written agreement. Private bridges
Whether a private bridge is covered by NBIS depends on its circumstances and jurisdiction. Where a private bridge is subject to NBIS, the responsible state, federal, or tribal organization must ensure the required inspection; that does not necessarily mean its own staff physically conducts it. FHWA also explains that it has no general legal authority to compel private bridge owners to inspect and maintain private bridges. For a private bridge carrying a public road, FHWA says states should encourage NBIS inspection or reroute the road. A particular bridge’s status should be checked with the relevant jurisdiction.
Who is responsible for safety during construction?
OSHA construction rules address worker health and safety at the job site, not the structural condition assessment of a bridge as an in-service public asset. Under 29 CFR 1926.20, employers must initiate and maintain programs needed to comply with the construction standards, and those programs must provide for frequent, regular inspections of job sites, materials, and equipment by competent persons designated by employers.

The construction standards also assign duties to prime contractors and subcontractors. OSHA’s 29 CFR 1926.16 states that a prime contractor is not relieved of overall responsibility for compliance for work under the contract, while subcontractors are responsible for compliance in their respective work. These duties concern OSHA compliance; they do not, by themselves, identify who accepts bridge engineering work or has authority to stop a particular operation.
What changes when a bridge opens to traffic?
Construction-stage duties and operational bridge-inspection requirements are distinct. FHWA’s NBIS Q&A says complete Structure Inventory and Appraisal data is entered into the appropriate inventory within NBIS timeframes after the owner determines that construction or rehabilitation is substantially complete—defined there as all lanes open to traffic. FHWA also says temporary bridges open to traffic are to be inspected under NBIS. These rules do not establish a universal assignment for construction quality assurance or stop-work authority. How to identify the responsible people on a specific project
The exact construction-phase engineering inspection and stop-work assignments cannot be determined without the state, owner, and contract documents. For a particular bridge, use these steps:

- Identify the bridge owner and the public authority with jurisdiction. For a public highway bridge, ask whether it falls under state, federal, or tribal responsibility.
- For NBIS responsibility, consult the relevant state bridge-inspection program or the responsible federal or tribal agency. If a local owner or consultant performs inspections, ask what functions were delegated and under which procedures.
- For construction safety, identify the employers on site and the competent persons they have designated under the applicable OSHA requirements.
- For engineering inspection, testing, acceptance, or authority to stop work, review the project contract, specifications, agency procedures, and applicable state or local rules. Do not infer those assignments from NBIS responsibility alone.
