A squatter is commonly understood as someone occupying property without the owner’s permission. In U.S. legal discussions, that person may be called an unauthorized occupant. The label does not by itself give the occupant ownership rights, and it does not tell you which removal procedure applies. Those questions depend on the facts, the state and locality, and whether the person is an entrant, a tenant-related occupant, or a holdover tenant.
Squatter: the plain-language meaning
In ordinary speech, a squatter occupies land or a building without the owner’s consent. The person may have entered without permission, stayed after permission ended, or moved into a property without being named on a lease.
“Squatter” is not one universal statutory category across the United States. Courts and government agencies may instead analyze the situation as unauthorized occupancy, trespass, a landlord-tenant dispute, or a claim involving adverse possession. The facts behind the label matter more than the label itself.

How a squatter differs from other occupants

Cornell Law School’s Legal Information Institute explains that an “occupant” can include people who are not named on a lease, including some unauthorized occupants and holdover tenants. That means a person described informally as a squatter may still require the procedure used for a tenant or other lawful occupant, depending on the evidence.

What adverse possession means—and does not mean
Adverse possession is a specific property-law doctrine. It can allow a person who possesses another person’s land to obtain title only if that jurisdiction’s legal requirements are satisfied for the applicable period. Mere occupancy, paying a utility bill, making repairs, or remaining undiscovered does not automatically create ownership.

Cornell’s overview identifies these commonly required characteristics:

- Continuous: possession continues as the law requires, subject to rules about seasonal or interrupted use.
- Hostile: possession is without the owner’s permission. In this context, “hostile” describes the legal relationship, not personal aggression.
- Open and notorious: possession is visible enough that an owner exercising reasonable attention could become aware of it. Standards and applications vary.
- Actual: the claimant physically uses or possesses the property in the way an owner ordinarily would.
- Exclusive: the claimant possesses the property rather than sharing control with the owner or the public as a whole.
States may define these elements differently, add requirements such as color of title or payment of taxes, and apply different limitation periods. There is no nationwide countdown that turns a squatter into an owner. Cornell’s examples of state periods demonstrate variation; they are not a national rule.
Why permission changes the analysis
Consent, a license, or a rental agreement generally defeats the “hostile” or adverse character needed for adverse possession while that permission exists. Cornell notes that a renter cannot claim adverse possession of rented property merely by possessing it under the rental relationship. If permission later ends, the date and manner of termination can become important, and local law determines what happens next.

How removal and eviction generally work
An owner should not assume that calling someone a squatter permits immediate lock changes, utility shutoffs, disposal of belongings, threats, or physical removal. Cornell’s eviction and landlord-tenant overviews describe procedures shaped by state and local statutes, leases, court rules, and related law. In most jurisdictions, a court order is required before an owner may have an occupant physically removed.
Questions that determine the procedure
- Which state, county, and municipality govern the property?
- Did the owner, a prior owner, or a tenant give the person permission to enter or stay?
- Is there a lease, sublease, written agreement, text-message consent, or other evidence of a rental relationship?
- Is the person a holdover after a fixed term, or an entrant who never had permission?
- What notices, filing deadlines, service rules, defenses, and hearing procedures apply locally?
A safer general sequence
- Document the facts. Keep dated photographs, ownership records, communications, lease documents, and a log of observed occupancy. Do not enter in a way that violates local law or another occupant’s rights.
- Verify the person’s status. Determine whether there was consent, a lease, a license, or a prior tenancy before choosing a legal route.
- Check local requirements. Use the relevant court, housing agency, or qualified local attorney to identify the correct notice, filing, service, and hearing rules. A general U.S. explanation cannot supply a state-specific deadline.
- Use the lawful court process when required. If the occupant does not leave voluntarily, the owner may need an eviction or other possession action, followed by enforcement of the resulting order.
Emergency situations involving violence, threats, fires, or immediate danger should be reported to the appropriate emergency or law-enforcement service. Police responses to a disputed occupancy can be limited when the facts suggest a civil landlord-tenant matter, so an owner should not rely on an informal label as a substitute for legal process.

Common misconceptions
“A squatter automatically owns the property after a fixed number of days.”
False. Adverse-possession periods and elements vary by jurisdiction, and satisfying a period alone is not enough if other elements are missing.
“Any person without a lease can be removed immediately.”
Not necessarily. A person may have permission from a tenant, may be a holdover tenant, or may receive procedural protections under local law. The proper classification must be established from the facts.

“Hostile possession means the occupant acted aggressively.”
No. In adverse-possession doctrine, “hostile” generally refers to possession without the owner’s permission.
“The owner can use self-help if the occupant entered unlawfully.”
Self-help rules differ, and physical removal without the required court authority can create additional legal exposure. Verify the local procedure before taking action.
What to establish in a real dispute
For a property in the United States, start with four facts: permission, occupancy status, the legal objective, and location. Permission asks whether anyone authorized entry or continued stay. Occupancy status distinguishes an unauthorized entrant from a person connected to a lease or prior tenancy. The legal objective distinguishes recovering possession from disputing a claim to title. Location identifies the state and local rules governing elements, notices, deadlines, and court enforcement.
